White House lawyer to AG Barr: Mueller report 'suffers from an extraordinary legal defect'

"In a letter obtained by ABC News, White House attorney Emmet Flood wrote to Attorney General Bill Barr in mid-April regarding special counsel Robert Mueller's report into meddling in the 2016 election saying the findings “suffers from an extraordinary legal defect: it quite deliberately fails to comply with the requirements of governing law".

"The letter squarely attacks the Mueller team for not making a decision on obstruction of justice, a federal crime in which someone "corruptly" attempts to “influence, obstruct or impede” the “due and proper administration of the law” in a pending proceeding, according to federal code" Meanwhile, what White House attorney Emmet Flood fails to acknowledge is DoJ policy prevents the indictment of a sitting president. That is why Mueller did not charge Trump and it is also why Mueller specifically tasked Congress to use their Constitutional powers in prosecuting the president. Flood cannot call himself an attorney if he cannot understand those legal facts in this case. The DoJ will not indict a president even with the wealth of evidence uncovered.


Mr. Flood omits a singularly important detail. Not being a legal scholar, I do not know where the presumption that the Justice Department, led by the Attorney General, a Cabinet member, may not indict a sitting president originated. I believe it is merely a convenient (for the President) custom, which has seldom been questioned or tested.

Yet it has served as the basis for the sort-of-declination on the obstruction grounds, which so confounds both sides of the question. While it is apparently true that the Special Counsel did, in fact, do the country a disservice by revealing so much evidence of questionable behavior which, depending on one's perspective, is either highly incriminating or not, hiding behind the premise that the President's own Executive branch prosecutor's office may not indict. Of course, Mr. Flood would opine that Mr. Mueller's investigation failed in its duty (from his one-sided perspective) to decline to prosecute on the basis of lack of evidence.

What would anyone expect him to say? The fact that the special prosecutor could not decline to prosecute (upon acknowledging that he was not permitted to even recommend prosecution to the House of Representatives, the ONLY legal authority with the right and the duty to charge the President, is de facto evidence the investigation determined there is more than enough evidence to impeach.

Whether on not it is wise to do so remains, as it should, in the decision of the House, and more specifically, the Speaker. Mr. Flood's abundant use of words stands in contrast to Mr. Barr's oversimplification, but both statements do the same injustice of obfuscating the truth while hiding behind a rule which isn't.

I find that people have moments of support and moments of objection, especially over a period of decades, when they can make many decisions and take many actions.

Im sure, going back twenty or thirty years, we can find every politician has once had support from one side or another at some points and not at others.

I will not argue that Yahoo does or doesn't lean left. But what I will argue is whether the story is true or not. I've said it a bunch of times, at least what I post is the truth. What I post has either already happened, or it's about to happen. No rabbit holes here. I know that any news service can get a story wrong. That happens to the best of them. I've seen Yahoo print a retraction because they got a story wrong. So far though, I've never caught Yahoo in an outright lie. Just lying for the sake of leading people wrong.

I've never seen any of the news sources I post deliberately post lies to lead people in the wrong direction. No far flung conspiracy theories. Just political news of the day. And no rabbit holes.

Trump doesn't understand that unions very seldom endorse Republican candidates. Republicans have been anti-union for many decades. Trump may not be but whether he is or not they'll almost always endorse Democrats. nevertheless, the endorsements really don't mean much as the rank & file pay little attention to it. They vote the way they want to.

By his own admission, Barr has said he hasn't read the full report. The man has had over a month, and it's "his baby", as he characterized it. So why has he not read the entire thing? And on what basis did he draw the conclusions within his 4-page memo days following the report's release to him? He is supposed to work for "WE THE PEOPLE". Not just Trump.

If I turned on to watch the hearing and didn't know who Barr was, you would think he was Trump's attorney.

Establishing that Trump continually violates both the foreign and domestic clauses would put enormous pressure on both parties to impeach Trump, and force Republicans senators to finally choose between Trump and upholding their oaths of office.

The contempt charge is about subpoenad documents.
