She recorded the conversation, Nehoray said, but had no role in providing the damaging tape to TMZ, the website that first broke the story. The conversation occurred at her home in September in the presence of another person and Sterling knew he was being recorded, Nehoray added

http://www.latimes.com/local/lanow/la-me-ln-v-stiviano-attorney-someone-leaked-sterling-tape-for-money-20140430,0,7230834.story#ixzz30TD7zjfD

perhaps this is why he is one of few who hasn't immediately played 'victim' to a 'setup' or unconsentual recording,,?

the law doesn't require the consent be included on the tape,,,

as to freedom of speech concerns,, I think people look at it with tunnelvision

freedom of speech for me, does not take away freedom of movement, freedom of choice, or the right to 'pursue happiness' of others

it merely means, one is not going to be able to be imprisoned for speaking

it does not mean that someone can come on my property to 'protest' blacks in the neighborhood, their removal wouldn't be due to using their 'freedom of specch', their removal would be due to illegal trespass and disturbing the peace,,,

it does not mean that I, for instance, must continue DATING a man who is verbally abusive, I have the freedom to refuse to see him anymore

it does not mean that a business has to continue to employ a cashier that is regularly insulting its customers, they still have the freedom to FIRE that employee in the interest of their relationship with their customers

so, as stated before,

though Shirley Sherrod was never IMPRISONED for revealing she had trouble helping a white farmer years before, her EMPLOOYERS were 'free' to let her go because that PUBLIC knowledge than affected a PUBLIC IMAGE Which would adversely affect the office she held

though Don Imus was never IMPRISONED for calling women nappy headed hoes, his EMPLOYERS Were 'free' to let him go because the PUBLIC knowledge of that statement affected the PUBLIC IMAGE/BRAND they promote and adversely affected THEIR BUSINESS

though Sterling will not be IMPRISONED for saying that a white woman merely being SEEN with black people was hurtful and demeaning, his EMPLOYERS are 'free' to let him go because the PUBLIC knowledge of that sentiment/statement affects the PUBLIC IMAGE/BRAND they promote, and adversely affects THEIR BUSINESS

I wonder if people would be so quick to jump to Oprah Winfreys defense if she were heard saying that its demeaning to be seen with white folks and the networks refused to air her material anymore,,,lol

this guy is just not gonna be the innocent victim people jumping to his defense are hoping to make him,, just a billionaire who said the wrong thing and something detrimental to his job,,,,

Actually it does..

I live in a state that requires consent for being recorded.

You must notify the person that they are being recorded and there must be an audible acceptance of this recording by that person or the taping of the conversation is illegal.

If there is no audible or written consent required to be present then why bother to have wiretapping laws?

Anyone can just claim that they were told 2 years ago that they were allowed to tape someone yesterday..

That is moronic..

what is NOT MORONIC is if it is an IN PERSON Recording with a visible device and the person in question never DISPUTES That permission was given,, and if a WITNESS is there which would eliminate an expectation of privacy,,,

I don't care if she had a microphone taped to his forehead..

If he goes to court and says he never gave consent then how in the hell is she going to prove he did if there is no audible evidence of that?

Come ON...

and still, no statement from him of outrage that he didn't know or consent to being recorded,,,

but hope springs eternal, perhaps he can be a victim by the time its all over,,,,

He isn't a victim he is an idiot that thought he could buy off these gold diggers with houses, cars and the attention they crave.

The exact same thing happened with a woman named Alexandra Castro in 2002 and I guess the only difference is that she didn't have the tapes to bring him down..

Sterling Not Going Quietly, Says Clippers Aren't For Sale

Happily, Donald T. Sterling isn’t a broken man.

I say “happily,” because it’s tragic to see a sad, elderly man bring the world down on his own head, however tenuous his hold on reality.

Unhappily for the NBA, this means that Donald won’t just accept Commissioner Adam Silver’s lifetime suspension, sell the franchise and go away.

Fox Sports’ Jim Gray spoke to Sterling just before Silver announced his decision. Sterling declined to be quoted directly but Gray, characterizing his remarks, said, “The team is not for sale. He will not be selling the team.”

Sterling, a developer worth $1.9 billion according to Forbes, has widespread holdings in the upscale Wilshire corridor and says he has never sold a property, much less one worth $750 million or so. It’s one of his proudest boasts.

Meanwhile, showing the chasm between Sterling and the rest of the franchise, the Clippers released a statement, accepting Silver’s decision “wholeheartedly,” concluding, “Now the healing process begins.”

Yet to be seen is whether Sterling will sue the NBA–which Clipper insiders say is surely his first instinct.

-----------------------------------------------------------------

The NBA wants to avoid a strike and make money on BB, they be needin' to smoove thangs over with the press and git back on Mr Sterling's good side.

Oh, and an apology from Hoosein would be in order.smokin

If I was Sterling, I'd say, let 'em strike and boycott.

The whole NBA will lose lots of money. Sterling will remain a very rich man.

fortunately, he signed an employment CONTRACT agreeing that they have the authority to figure that out themselves,,,

NBA constitution, section 34 A

(c) Any person who gives, makes, issues, authorizes or
endorses any statement having, or designed to have, an effect
prejudicial or detrimental to the best interests of basketball or of the
Association or of a Member or its Team, shall be liable to a fine not
exceeding $1,000,000 to be imposed by the Commissioner. The
Member whose Owner, Officer, Manager, Coach or other employee has
been so fined shall pay the amount of the fine should such person fail to
do so within ten (10) days of its imposition.
(d) The Commissioner shall have the power to suspend
for a definite or indefinite period, or to impose a fine not exceeding
$1,000,000, or inflict both such suspension and fine upon any person
who, in his opinion, shall have been guilty of conduct prejudicial or
detrimental to the Association.

ID say being aware that you are such an embarrassment may be detrimental to your morale in playing for the team, or your interest in supporting the team,,

and since

its at the commissioners discretion, I say fire his behind, let him spend more quality time during his last days with his family instead of dealing with those embarrassing black folks,,,lol

Just got busted?

He has a history of this..

Where were all these black players and the NBA when he was sued and settled for racial discrimination against poor minorities that rented from him?

Were they silent because it was just some poor people that got screwed by Sterling and his wife?

All of these players signed on the dotted line to get "theirs"..

The sponsors... The league.. All the organizations that he "donated" to.. the gold diggers over the years...

All got "theirs"....

This outrage today by the above mentioned is to cover for the fact that as long as they got "theirs" and the only offended parties were poor renters they were willing to look the other way..

So to give Stiviano some credit..

She also exposed the hypocrites that were more than willing to take Sterling's money as long as he didn't offend them..

that's not what the contract says

its PUBLIC KNOWLEDGE and therefore has a 'detrimental' affect

the consent will not be an issue , in my opinion, it was an in person recording with a witness, removing the expectation of privacy and if it were an issue I believe his representatives would have long since been yelling from the rooftops about it,,,,

I believe and I don't think he will deny, that recording conversations was a status quo between them,,,,and not an issue here, and certainly not an issue as to whether the statement leads to detrimental effect,,,

All the time it will take to sue him over the paltry fine and other time consuming BS, the whole NBA, its other owners, staff, players, etc. will be going into the red.

How many years will players and staff be willing to work without pay?

One of the demands is, he sell his team. Won't happen.

The fans say, he don't sell, they strike the NBA.

Perhaps, it's the wife who's the racist.

She's suing to get back millions of dollars worth of cars, home and other gifts her husband gave to a black chick he was banging.

How can a dude who is/was banging a black chick be a race hater?

It will be very refreshing to hear the court has awarded her the community assets her husband gave Stiviano - AKA, Vanessa Maria Perez, Monica Gallegos, Maria Monica Perez Gallegos and Maria Valdez

There's a difference between being a true race hater and not wanting to socialize with others who we just don't want to rub shoulders with.

Just like everybody against him is using his personal conversation as a weapon to publicly ostracize him.

To me there's no difference in what they're saying and doing.

It's just that Mr. Sterling wasn't saying it with decorum or political correctness because he probably didn't think he'd have to eat his words.

There's more to this back story then we know right now that's caused the extreme reaction to a harmless conversation.

I've pretty much got my suspects and ideas in mind just from the research I've done since this story first broke.

And I hope the NBA Board who's been issued an ultimatum by Mayor Johnson to see it his way or get the boot too, bases their decisions on whether they want to force the man to sell over this slight of words or not, uses their discretion wisely and fairly.

After all, they have access to the facts and their motives better than we do, and it's not difficult for them to find out the who, why, what, and how much involved to take logical and not emotional action from here.

They are setting a dangerous precedent after all, and if it's going to be this easy to "fell a bigot" according to Mayor Johnson, (and one of the more wealthier ones) then people all over the world better be prepared for the future fall out...

....

Mr. Sterling is an 80 year old man with cancer. He's under a lot of personal stress. Might even be on heavy pain medication or going through chemo.

And he was being mindf**ed by his obvious to everybody else but him gold digging vengeful ex-mistress. He lost his patience with her incessant badgering and asked her to leave him alone several times and she refused to let up until she got the damaging evidence she was after.

Any good lawyer can see right through all this and should be able to get his name cleared if he really wants too.

At the most he should have been suspended pending review of the allegations instead he was unmercifully spiked and hung there to die right in front of the entire world.

Believe it or not elderly people are fragile. Even the men who have to put on a brave face so they don't expose any weakness. And when you know you might not have long to live your psyche becomes even more delicate.

And it's a shameful thing to have to witness how all this went down while everybody puffs themselves up acting like they've conquered one of our real biased enemies from the middle east.

Shameful indeed. embarassed

I wonder what the world really thinks of us now. sad2

Obama Denounces NBA Team Owner's Racist Remarks

www.youtube.com/watch?v=lq2T0BtnVI4

"With respect to the statements by the owner of the Los Angeles Clippers, for our Malaysian audience this is a sports team, basket team in the United States. The owner is reported to have said some incredibly offensive racist statements that were published. I don't think I have to interpret those statements for you they kind of speak for themselves. When ignorant folks want to advertise their ignorance, you don't really have to do anything, you just let them talk. And that's what happened here. I have confidence in the NBA commissioner Adam Silver, a good man, will address this. Obviously, the NBA is a league that is, it is beloved by fans all across the country. It's got an awful lot of African American players, it's steeped in African American culture, and I suspect that the NBA is going to be deeply concerned in resolving this."

"I will make one larger comment about this. You know we, the United States continues to wrestle with the legacy of race, and slavery and segregation, that's still there, the vestiges of discrimination. We've made enormous strides but, you know you're going to continue to see this percolate up every so often. And I think that we just have to be clear and steady in denouncing it, teaching our children differently, but also remaining hopeful that part of why some statements like this stand out so much is because there has been this shift in how we view ourselves. And like Malaysia, we constantly have to be on guard against racial attitudes that divide us rather than embracing our diversity as a strength. And I know that the people of Malaysia are committed to wrestling with those issues as well, and we have to be committed to staying on top of it, and we will."

Shameful indeed. embarassed

I wonder what the world really thinks of us now. sad2

Woman Behind Donald Sterling Scandal: V. Stiviano Speaks Out

www.youtube.com/watch?v=pMtGQNSOcUs

AN ABC News exclusive interview with V. Stiviano.

The woman at the center of the Donald Sterling controversies; speaking out about the firestorm sparked by a taped conversation between her and the billionaire LA Clippers owner.

In the face of the scandal she's been hiding behind a visor, until now. She sat down with ABC's Barbara Walters for the first time just a short while ago.

Barely audible... A man walking with her and the news crew tells Ms. Stiviano... "Daily skate everyday just right there." To which she replies, "Just one block?"

Barbara Walters: "You have seen her all week; skating in front of her house with that odd visor covering her face hoping to quench the paparazzi's thirst for her story."

Stiviano: "You guys want some water?"

Walters: "Or exiting a restaurant espousing presidential aspirations."

Stiviano: "One day I will become president of the United States of America."

Walters: "Who is she? She is 31 year old V. Stiviano, the woman often at Sterling's side at Clipper games, and she is nearly 50 years his junior."

Stiviano: "I'm his confidant, his best friend, his silly rabbit."

Barely audible in the background... Interviewer: "His what?" Stiviano: "His silly rabbit."

Walters: "Tonight, V. Stiviano speaking for the first time."

Stiviano: "Our relationship started off, me working for Mr. Sterling in his non-profit organization the Donald T. Sterling Foundation. And it's evolved to so much more, on a level in which it's become a big scandal."

Walters: "It became a scandal?"

Stiviano: "Yes."

Walters: "Yeah, why?"

Stiviano: "How and why doesn't even matter anymore, its here. And some things needed to be brought to the light."

Walters: "The woman at the center of the Donald Sterling controversy. The billionaire's confidant, heard first on these tapes."

Sterling: "Yeah, it bothers me a lot if you want to broadcast that you're associating with black people."

Stiviano: "Do you know that you have a whole team that's black that plays for you?"

Sterling: "You just, do I don't? I support them and give them food, and clothes, and cars, and houses."

Walters: "Racist comments from LA Clippers owner that rocked the nation and may cost him what he loved most."

NBA Commissioner Silver: "I am banning Mr. Sterling... FOR LIFE!"

Walters: "But now, V. Stiviano is defending him."

Walters: "Is Donald Sterling a racist?"

Stiviano: "No, I don't believe it in my heart."

Walters: "Had you heard him say derogatory things about minorities in general and blacks in particular?"

Stiviano: "Absolutely."

Walters: "You've heard him say derogatory things?"

Stiviano: "Yes."

Walters: "Don't they sound racist to you?"

Stiviano: "I think the things he says are not what he feels. Anyone can say anything in the heat of the moment."

Walters: "Not everybody makes alleged racist remarks in the heat of the moment. Sometimes in the heat of the moment you say things..."

Stiviano: "That you mean."

Walters: "That you mean."

Stiviano: "Or that you feel."

Walters: "Yeah. Explain how he says these things."

Stiviano: "I think Mr. Sterling's from a different generation than I am. I think he was brought up to believe those things."

Walters: "What things?"

Stiviano: "Segregation,"

Walters: "Uh huh."

Stiviano: "whites and blacks, he was brought up to believe these belief in his own way, and they're ingrated in him deep and rooted in his body and in his mind. But through his actions he's shown that he's not a racist. Through his actions he's shown to be a very generous and kind man."

Walters: "She claimed that these conversations were never intended to become public."

Stiviano: "These conversations were in private nevertheless they became public, and because they did a lot of people have been hurt by it. His wife, his children."

Walters: "So how did they come to light?" "These things that he said to you were recorded, did you know that?"

Stiviano: "Yes, I recorded them."

Walters: "But then how did they become public information?"

Stiviano: "Someone leaked the audio, or sold the audio, or gave the audio to what I believe to be TMZ. A friend or a so called friend of mine, I was planning on quitting working with Mr. Sterling a few months back. No one understands my pain and feeling, and I was reaching out to a few of my friends. I shared an audio with them where they can empathize and sympathize my feelings, my way of being."

Walters: "You are half black and half Mexican, and you were very close to Donald Sterling?"

Stiviano: "Yes."

Walters: "You do not consider him a racist?"

Stiviano: "No."

Walters: "No." "Stiviano says that over their two and half year relationship she was helping him to change his point of view."

Stiviano: "People were used to Mr. Sterling being Mr. Sterling. And here comes a V and everything change. Mr. Sterling is nice and kind to everyone; he greets and treats people with equality. And I brought that light to him."

Walters: "So you helped him to become a better person?"

Stiviano: "In every way."

Walters: "Uh huh."

Stiviano: "In every way."

Walters: "But the question on everyone's mind." "Can you tell me what your relationship with Donald Sterling is?"

Stiviano: "I'm Mr. Sterling's right hand arm, MAN."

Walters: "Are you in love with Donald Sterling?"

Stiviano: "I love him."

Walters: "I'm not sure that's what I asked." "Are you in love?"

Stiviano: "No, I'm not in love."

Walters: "You love him what, like a friend, you love him like a romance?"

Stiviano: "I love him like a father figure."

Walters: "Like a father? Do you and Donald Sterling have a financial arrangement? You say you're his assistant, does he pay you?"

Stiviano: "Yes. At first started paying me as an employee, and then he started paying me off the books."

Walters: "Is he still paying you off the books?"

Stiviano: "No."

Walters: "No." "You are one of his assistants?"

Stiviano: "I'm HIS assistant."

Walters: "You are his assistant."

Stiviano: "Yes."

Walters: "You were very honest so I'm going to be blunt as well. Donald Sterling has been married for over 60 years, where do you fit into that life?"

Stiviano: "I don't. Mr. Sterling's marriage is Mr. Sterling's marriage and relationship. I'm not part of that life."

Walters: "What's the biggest misconception about you?"

Stiviano: "That I'm a mistress, or a whore, or a woman of the night."

Walters: "People have seen you walking with a visor, why the visor?"

Stiviano: "I'm hurting, I'm in pain. It hurts to see someone that you care about hurting. It hurts to see people speculate; assume, say, throw darts at you when they don't know you. When they don't know your story, when they don't know the truth, all based on here say and assumptions, it hurts."

Walters: "She was with Sterling just moments before she sat down with me. "Ms. Stiviano you just left Donald Sterling. What is his state of mind right now?"

Stiviano: "Confuse. I think he feels very alone, not truly supported by those around him. Tormented, emotionally traumatized."

Walters: "From what?"

Stiviano: "From everything. I think he's highly more traumatized and hurt by the things that he said himself. I think he can't even believe or understand sometimes the things he says."

Walters: "Do you think that Donald Sterling should apologize?"

Stiviano: "Absolutely."

Walters: "Will he apologize?"

Stiviano” "Only God knows."

Walters: "What advice are you giving Donald Sterling now?"

Stiviano: "I just want him to come to his senses. I want him to believe it and feel it and to genuinely feel apologetic to the world. I’m giving him the advice that he should apologize to the nation, to the world, for his racist remarks." (Her V. dance)

"For Nightline, I'm Barbara Walters, in Los Angeles."

whoa

It's even more obvious from this one on one interview that V has ulterior motives. And her intent was to destroy and conquer while reaping whatever rewards she could glean from her dismissed employment with Mr. Sterling.

She admits planning on quitting and giving up her lucrative job with him several months ago and showed her hand to her friends who helped her plot his demise that they together intended to air publicly as more leverage to manipulate/force him into submission.

She admits that her private knowledge needed to be brought to the light, while feigning innocence and culpability when her goal was accomplished. I'm surprised that a man in his position didn't get his employee to sign a nondisclosure agreement though.

It does appear that V felt an intimacy with Mr. S to such an extent that she coveted his wife and children's place in his life. And she intended to hurt all of them by any means available to her.

Mr. S was paying V to be his right hand arm (assistant) and she saw a way to get even with him if she couldn't get everything she wanted for her services.

I see jealousy, pride, hurt, anger, manipulation, vindictiveness and triumph all throughout her public testimony, and would really like to see those she plotted against him with her brought to answer for their conduct too.

Now that she's instigated his severe public punishment for cutting ties with her after seriously over compensating her in the two and half years they were together, she's gloating, even strutting in righteous indignation over what she sees as her take down of a wealthy and powerful yet wayward man.

And she still wants more by using the media and the public to get Ms. S to fall in line with her gold digging agenda.

Ultimately she wants to see him grovel by having him publicly apologize for a predicament she created with intent to scam and pillage.

Before Mr. S apologizes to anybody he inadvertently offended though, I'd like to see V and her accomplices admit their part too, and also publicly apologize for involving the worldwide public in their nasty grownup game of show and tell.

My personal advice to Mr. S at this point would be that if he needs an assistant now that V's position is vacant it would be wiser to hire an outsider without ties that can be used to string him up to the nearest tree.

Of course these are just my thoughts and way of viewing this situation. But I'm very interested to see how all this pans out.
