Topic: Has Sterling been clipped? Really? | |

Not to mention, in his many, many years of preaching hate, has Fairycan ever been sued for bigotry and promoting separatism. BTW, the NOI has 0, that's ZERO white folks as members. A bit racist, no? Thank you, Mr Invictus V for reminding all of us that each conversation we wish to tape, the other party needs to be advised. Ex. This phone call may be recorded for training purposes. (And, to use whatever info you may give us agin' ya.) willing2 sooner or later I'm going to google what the freak you're talking about... but for now I'll simply say... it depends on which state you live in whether both parties have to know what's going on. |

California, where he lives, is a two-party consent state, which means that recording is permitted only when both parties are aware it's taking place. Here's a legal explanation from the Laguna Hills firm of Jackson and Wilson: "Donald Sterling's Alleged Racist Rants and Legality of the Recorded Telephone Conversation."
"The test of whether or not you or Sterling have a reasonable expectation of privacy is an objective one. Absent Sterling’s consent, then I believe that expectation is present in a private telephone call as in this alleged call between Sterling and Stiviano. "If the call was made by a person on a speaker phone in a public or semi-public place and all parties knew this was happening, then the issue of whether or not there is a real objective expectation of privacy is probably not present." But most states, including Oregon, require single-party consent to recording of telephone conversations. That means that, when you call your kid's soccer referee to share your views about his deployment of yellow cards, he may legally record your call. Generally speaking, as long as one party is aware and both parties are in Oregon, the Society of Professional Journalists and other authorities say it's legal record a telephone call. There are exceptions regarding criminal behavior, enforcing the law and other situations. The rules governing in-person recording are different. In that situation, generally, both parties must be aware of the recording. But not always, as shown by the Oregon Supreme Court's 1987's opinion in Oregon v Lissy, (partial paywall) which followed a gruesome murder in Lane County. One issue at trial was the use of recordings by a witness wearing a concealed wire, capturing the defendant's description of the murder. The defendant, Lissy, argued that the conversations were private and that recording them was illegal. The court ruled otherwise. http://www.oregonlive.com/business/index.ssf/2014/04/donald_sterling_tempest_raises.html |

The court ruled otherwise. http://www.oregonlive.com/business/index.ssf/2014/04/donald_sterling_tempest_raises.html Weird I didn't get the impression their conversation was by phone as I heard no beeps or tones at any time even if they were on speaker. In fact at one point when Donald's voice became more alluring as he described a BIG problem they were having you could tell the mood between them changed as he said almost begging... "If you didn't like "him", someone that I was with, I would, stop seeing that person. and she replied... "I'm sorry I don't have anymore friends, what would you like me to do? Remove the skin color from out of my skin? I got the distinct impression they were in close proximity and this was an edited recording that was mixed together from several conversations. Especially towards the end when he says, "Why are you forcing this down my throat? I'm finished talking to you. I have nothing more to say." Yet they don't hang up? Instead, she continues talking to rile him up, and after a short outburst he says, "Please leave me alone, Please, Please." To which she says, "I'm sorry, is there anything I can do to make you feel better?" And he ends the conversation by saying, "No, you can never make me feel better. You're just a fighter, and you want to fight." There was never any sincerely angry tones or emotionally aggressive words spoken between them. And we don't hear them say goodbye at the end of the conversation, unless I haven't heard the whole original recording. Also, it appeared to me after listening more closely to what they were saying that they were following a script rather than having an impromtu discussion or argument. There's way more to this than I originally thought when I was basing my assumptions on limited information. And I still don't get the complete picture yet. But something tells me this story is far from over. |

Aahhhh my dear soul, how nice it would be to have genuine faith in our Constitution, freedoms, and rights that are eroding. When I was young and inexperienced I believed... then I grew up and discovered there's no such thing as free... we all pay a very high price to be living in America. Where so many are homeless and destitute. |

What has happened to Mr. Sterling's right to free speech? Especially when his words didn't infringe on anyone else's rights, regardless to how revolting they are to some? What is our country becoming when a person can be punished for simply stating their political opinions and or expressing their cultural beliefs and practices even if they aren't popular? Yes, I believe there is something more to this story and this taped discussion is simply a tool being used to unmask it while trying to destroy a man that certain people don't like. And I wonder what kind of lurid details will be exposed as the real reasons for his sought after banishment becomes apparent. While further satisfying my curiosity I looked back to see how the media purposefully selected only the most flaming sound bites to enhance a racial intolerance frenzy in the eyes of the public, while they intentionally withheld all the nice things Mr. Sterling was saying in his message. (I mean unknowingly taped conversation.) To be followed by Kevin Johnson, a former all-star turned NBA adviser proudly boasting that... "This is a defining moment in our history. Today stands as one of those great moments, where sports once again transcends, where sports provides a place for fundamental change on how our country should think and act." And Lebron James thanked Commissioner Silver for being a great (albeit new) leader "for protecting their beautiful and powerful league." curiosity peeks deeper and deeper... what do they need protection from? A few controversial words between a man and his woman? While the Clippers went on to win the game they played on the same day they ousted their owner they've obviously and yet secretly despised for a long, long time. Coincidence, or a celebratory victory dance that was all part of the show? After all, games have been thrown before for far less conspicuous reasons. Yes, my dear Watson, this is a strange story with many turns and twists and rope to hang who? Can't wait to see how and who it continues to unfurl... WTF! Sports is the catalyst being used now by which we Americans are being schooled on how to think and act... With it's long history of immoral behavior on the part of some players and... Yikes... me thinks following the leader is a game I'll sit out for this particular moment while all the skeletons still in the closet begin to come out when this case hits the courts for trying to force a man to part with his favorite toy and obsession... his team... Sometimes it's in the best interest of all concerned to let dead dogs lie rather than riling them... But what do I know I'm just a bubble headed woman that doesn't know the first thing about basketball and what it takes to become a "STAR". Me thinks they protests too much... but then again... who will walk away a winner, and who will run away and hide... Lebron James speaking on behalf of the NBA says, "No matter how long it takes, no matter how much money it costs we need to get him outta there, and whoever's associated with him. He doesn't belong in our league." Such broad strokes Mr. James is using to paint all of Mr. Sterling's associates the same way. Does the NBA really intend to turn this scandal into an all out manhunt based on what real evidence? Opening every closet to see who they can kick to the curb along with Mr. Sterling? Guess we just have to wait and see what kind of accusations the NBA is going to lobby against him. This story could get very interesting as we hear Mr. Sterlings response that will all depend on how much he wants to keep his team I would think. Far more compelling will be to see how many of his fellow team owners turn against him after being associated with him and his proclivities for years. Certainly they can't say, well, we just didn't see any harm in him, but now that the public outcry is so great, he has to GO! And whether they vote against him simply out of fear of being found guilty by association and ousted along with him now that Mr. James has already voiced a public ultimatum. The plot thickens. Will the racially charged conversation fan the flames hot enough to burn down Mr. Sterlings world all around him? Or will cooler heads prevail and a more diplomatic solution be reached in remedy? |

Pay to play, this is the American way! And it appears that V. Stiviano prefers gold to silver as she banks her own way to success after devising a clever way to catch her ex-boyfriend in a predictable and compromising situation. Ms. Stiviano, while knowing her ex-lover's proclivities and previously established boundaries made it a point to antagonize him by making a public move that she knew could draw him out. I dare say she was hoping he would utter the very words she wanted to elicit from him for her own benefit, as well as for the benefit of those who are helping her promote this tactic. Donald Sterling, owner of the Los Angels Clippers has a well established track record of sponsoring his personal minority preferences by including some while excluding others. And regardless to which side of the track his feet are firmly planted it appears that everyone around him grows richer either by earning or winning a piece of the American pie he shares willingly or begrudgingly depending on the circumstances. Only now however, while everyone involved plays politics putting on airs of disgust and outrage, and publicly takes sides in their effort to oust him from the limelight do his previous supporters strip him of his lifetime achievement award they were to honor him with next month. It's reported that Mr. Sterling earned this public recognition because his organization gave more to the minority community than all the others. So ultimately, who is going to be served and who is going to be benched by shining a light on this lucrative, albeit sensitive, and public opinion generated agenda now being broadly exposed? Can't wait to see how this new game plays out... On the other hand, while not knowing the details, if the Sterlings are in the midst of divorcing over Mr. Sterling's lifestyle choices, perhaps this maneuver is meant to divest them of their capital before divvying up their assets in the final decree... Like I said my dear Watson... this case is very, very interesting... and we have to wait and see... I don't understand what money is to be gained from this,, its not like its something that can be used as blackmail since everyone heard it,,,, at worst, he will lose some players or be replaced,, and the money being paid to him will be paid to someone else,,,,well, except for the agreed upon severance and other payments that will no doubt be negotiated behind closed doors nothing will be lost or gained,, he may just have to 'retire' earlier and lose a few black companions(or mixed,,lol) neither involved are angels, for me, its not about the one going with a married man ,,,,its just about the oddness of having a life so enriched by black people and yet feeling like it is somehow beneath a 'white' woman to be seen with them,,, to his companions, I imagine its the most shocking imagine having a boyfriend , no matter how good he was too you or others in your race/ethnicity,,,,and finding out that he felt it beneath him to be 'seen' with you or them,,,it would be hurtful and no doubt change ones desire to be 'seen' with him as well, or to be around him at all,, I mean I have heard and even due to Americas history, can understand(though not agree) with older people feeling like interracial 'dating' is somehow not right or appropriate but this feeling that even just 'being seen' with someone of another race is so terrible, is just,,,,,,the strangest version of 'non hateful' racism I have ever heard,,,lol IDK harmony it sounds like pretty hateful racism to me....I remember the old Sidney Poitier movie with Katharine Ross "Guess Whose Coming To Dinner?" Both parents (black & white) were not pleased with inter racial dating. In traditional cultures in the past it had been frowned upon.....but education is a wonderful thing.....lol I would give ALOT of leeway, in declining to call it hateful, because he BELIEVES and APPEARS To believe that he can admire black people and associate with black people,, they are at least GOOD enough for that,,,,, he just doesn't think 'delicate white' women should be seen in PUBLIC With them,,,,, If he had said something derogatory about blacks BESIDE them not being good enough to be in a photo with a white woman, Id have considered racism of the blatant and hateful type, in this case I consider it racism of the passive and ignorant kind though |

If there is no audible or written consent required to be present then why bother to have wiretapping laws? Anyone can just claim that they were told 2 years ago that they were allowed to tape someone yesterday.. That is moronic.. what is NOT MORONIC is if it is an IN PERSON Recording with a visible device and the person in question never DISPUTES That permission was given,, and if a WITNESS is there which would eliminate an expectation of privacy,,, |

Will the racially charged conversation fan the flames hot enough to burn down Mr. Sterlings world all around him? Or will cooler heads prevail and a more diplomatic solution be reached in remedy? WOW! Talk about blowing my mind! The more I'm learning about the NBA Players Association (Union) and their connection with MJ, and his connection with former player and Mayor Kevin Johnson and his connection with President Obama... I understand now why our president spoke up against Mr. Sterling too... Talk about choosing sides... And Mayor Johnson's innate views about bigots... when he said... "I hope that every bigot in this country sees what happened to Mr. Sterling and recognizes that if he can fall, SO CAN YOU!" OUCH! This public statement feels like a veiled threat to me, does it to you? Mr. Johnson appears to have let his power go to his head... And it looks to me like an all out national war has been instigated and declared against everybody that certain influential black men have a grudge against. People better duck their heads as we watch to see who winds up with egg on their face as hidden motives and secret agendas come to light! V. Stiviano was a key player in hatching this scheme... as the plots seem to be one thing but are actually another. So who is going to really want to associate themselves with the Clippers in their self righteous stance if their own negative opinions about and towards others starts becoming more of a massive distraction then Mr. Sterlings comments he stated while being goaded by a woman that definitely has eyes on reaching for the American presidency, according to her. Curiously, I can't help but wonder if she's already got her man picked out that she's going to promote for that position so she can be the woman behind the throne? Of if she really believes she's convinced the majority of Americans that she deserves our allegiance and our Vote? Twists and turns... WOW! The more I dig the deeper I see, and now realize I haven't heard all the tapes being used to disparage Mr. Sterling, but when I do will I see him as a villain or a victim of prey? Seems he might have plenty of political reasons himself not to want to socialize with people who want to exclude everybody else who doesn't fit into their way of viewing the world too. Talk about a pot calling the kettle type affair... It will be very interesting to see if our American president promotes affirmative action by backing Mr. Johnson's seemingly bigoted position too? |

Talk about a pot calling the kettle type affair... It will be very interesting to see if our American president promotes affirmative action by backing Mr. Johnson's seemingly bigoted position too? Everyday the story unfolds... Now the worldwide public is informed that Mr. Sterling has been battling prostate cancer for an extended period of time. No doubt the locals already knew this too. And I can't help but wonder if his impending death is the motivating factor behind this timely grab for his team, his life's legacy. It surely looks like MJ is happy about this turn in events as he dances on Mr. Sterlings grave before his body is even cold. While addressing his fans at a news conference MJ admits that he will be an NBA team owner soon enough when asked if he wants the Clippers or not. And he responds off the cuff, "I've been saying no so far, but, uuhhh, we'll see what happens." and laughs heartily along with his adoring audience. Meanwhile, Ms. Stiviano who posed in a hate faced, eyes glaring photo she would soon gloat over and goad her ex-lover with by saddling up to Mr. Johnson, now denies she had any participation in the release of the tapes. Instead she claims she gave copies to her friends for safe keeping and they must have needed the money bad enough to sell them to the media for worldwide exposure. and so the story goes... If this is how the big boys play, their games leave a lot to be desired... |
