Depends on the state. Sounds like you are in a zero tolerance state. Contact a group called NORML. The are 4:20 advocates that might be able to help. The thing is what drugs did they accuse your friend of distributing? If it was Meth they just had their bust hosed. They may try to lie but a good attorney can find out. The whole 'firearms and drugs' thing is federal anyway. Still, you can also fight the bust on a profiling rap. If the herb you were busted with matches the stash prepare to say ouch. If they were looking for something else in your house besides weed and could not find it can you say "Illegal Search and Seizure?" I bet you can!
At that point I would say find an attorney who loves cops and sic him on them with a nice fat as**d law suit! There are attorneys who would take one look at a case with proper merit and dump their money into getting the heap of cash the city will be offering to keep it out of court (work it Pro Bono).

Hope you are on the right end of this! the reason they like to pick on 4:20 is that 4:20 does not get violent like trying to bust up someone with whiteness under their noses (or in their glass pipe!).

Also look up 4:20 advocacy groups! They can also be a great source of information for defending yourself. Still, doing it in their face is not very smart either even if it is your living room.
A little paranoia can save you a lot of misery.


He doesn't need help trying to get away with using illegal drugs. I hope he does time for whatever he had in that little bag that he didn't want to tell about. Then he will get the help he needs. What are the guns for? So he can shoot up some innocent person for money to get his next fix?

Should we get his dope dealing buddy help as well. Who probably sells to children as well and makes our streets unsafe to walk down.

People of the 4:20 persuasion do NOT go around shooting people to get their next fix. Meth monkeys? Trusting one of them is the same as trusting the police to protect and serve you! Why should the cops have guns? They shoot people for no reason!

Long boring story, but i wanna tell it anyway so will try and make it quick. Cops were watching my buddy. Saw me visit and leave real quick. They came to my house next day asking what I was doing there. They said he's a known dealer and I was buying drugs there. They came in my front door without permission and saw some weed on the table. They asked to search the house. I told them to kiss my ass.

They put me in cuffs for 4 hours while they got a warrant. They found no more weed, but a postage scale so added an intent to distriubute charge. Then they found my guns and charged me with posession of firearms during a felony. They also found another small bag of something I won't mention in detail.

So I got to spend a day and a half in jail. The judge let me bond myself out. So I'm free for a couple weeks. I'm speaking with the public defender and a couple more lawyers next week. Think I can beat the charges for illegal entry. We'll see how it goes.

then everyone with a scale has drug paraphernalia what about those that use one for diet or mail a lot of packages

only if it has drug residue on it and if it does not it kinda throws their intent case out the window

be careful what we say there is to much abuse going on already ya want it to get worse

the police broke the law to get evidence wonder if you would like one of those loop holes then

just curious

all laws are put in place for a reason

it is better ten guilty go free than one innocent go to jail

Alright, yes I opened the door, but just barely wide enough for my shoulders. The cop was shorter than me and at the angle he was at, can't see the coffee table at all. I got pictures. They would not let me step past them to get outside and shut the door. He kept inching his way towards me until he was pretty much in the front door looking around my house.

I'm not looking for any sympathy from anybody. Maybe just some opinions, advice and points of view or experiences or something to that note.

I have never shot, nor would ever consider shooting a living thing except with a water gun. I have never even been in a fist fight and I wasn't going to start one with the cop to try and keep him out my house.

I didn't really tell him to "kiss my ass". I offered them the highest respect and cooperation until they started yelling at me and treating me like crap. At that point I just became quiet.

The other bag, from what my paperwork says, is the least of my problems. I am not a hardcore drug user. I smoke weed and cigarettes and barely drink.

I'm among 80 million other Americans who are perfectly aware that there are consequences to smoking pot and don't believe there should be. I don't carry it around with me. It goes straight from dude's house to mine where I smoke peacefully indoors. I don't believe this should be a punishable offense so you're damn right I'm gonna fight it through legal loopholes or any other means I can find. 2/3 of you act like you've never done anything wrong and tried to get away with it.

Dude does not sell to kids. I don't smoke with kids. I don't even know any kids any more. I'm not hurting anybody but myself, and don't believe I'm even hurting myself much at all with the little bit I do smoke.

So there you have it. Call me what you want, but I'm not a junkie loser. I'm an ungodly talented artist, designer, and builder whose career and life stands to be seriously harmed because of this. If that's what happens, so be it. But I'm going to do everything possible to keep my life just the way it is.

If you were posting from the UK, id actually say you should be severly punished. Only gangsters and criminals really have them here, and a relatively small number of licenced enthusiasts. And farmers.

'preciate ya, man. I could understand being punished for the guns by an intolerant society. But hell, this is America. We love guns so much it's the 2nd right in the costitution. I have them solely for sport, and by sport I mean shooting non-living targets. I didn't even have even home defense in mind as I am not worried about being robbed or hurt by anyone.

But if you've ever seen a bullet rip through an old computer printer by your own actions, it's freakin' awesome! You guys might become hooked too.

tha is why the govt is able to run over anyone they want

to many that feel hey it does not effect me take what ya get attitude

but when it does come to effect them who will be left to help them

unlawful entry is not a loophole it is the law

anyone entering a home uninvited is a criminal even a law enforcement official unless they have a warrant

it is better 10 guilty go free than one innocent be punished

Doubtful, but you can try. You were at a known drug dealers house, that alone puts you in a difficult position. It is tricky these days, I was hit the same way 5 years ago. Pretty much if they have due cause to believe something they can do really whatever they want.

You can beat the charges, but you will need a paid attorney...not a public defender.

Don't know about where you're from but in my state, illegal substance out in the open means proable cause. Gives them the right to put you under arrest and then execute a search warrant.

I agree with Jess, play with fire, you're gonna get burned. Not to sound harsh but you know what you had was illegal. Stand up and take whatever punishment you're given. shades


Same here. What's visible without searching is the rule. It's the same with a car.

If the police knocked on your door and you answered it, and they saw, in plain view, weed or something else illegal in your place, you have not got a leg to stand on.

Police do not have to have a warrant to knock on yur door and look inside. Even if it was a cop collecting for the cops kickback fund. If they see it in plain view, you're f**ked!

And heres some more bad news...if you're using an indigent defender, and you're living in any state except California, you're already guilty.

Take my advice, pay an attorney and ask his advice. I HATE to give that advice cause I hate lawyers. But they're like a handgun....when you need one, nothing else will do. And you do need one.
