To apply for the amnesty, they have to prove they have worked and supported themslves for the last 5 years. If they are working, they have to provide ID for the job. It's called a three-pack. To be working, an Illegal has to have this three-pack. Being in possesion of this three-pack is a violation of Federal Law. If U.S. Attorneys Office waives prosection, that could set precidence for prisoners previously convicted of like crimes grounds to sue them. Along comes a CIR law. The person now wants to apply for whatever legal status the new law authorizes. Applicants likely will have to prove that they have been employed, paid taxes, and so on, but this process could leave them open to the discovery of illegal employment-related crimes. They now must rely on the U.S. Attorney’s Office to exercise discretion to decline any prosecution according to 18 U.S.C. §506 (for the purchase and use of the “three pack”). Any conviction under this statute would make the person an “aggravated felon” according to Section 101(a)(43) of the Immigration and Nationality Act (INA) and subject to removal/deportation for life. For this example, the U.S. Attorney’s Office decides not to prosecute the person (and a couple hundred thousand others in the same situation), so the person subsequently applies for the new CIR benefit. Now appears the state of Florida as an involved sovereign. Florida has a comparable law (in this case, Title XLVI, Chapter 817.568(9) of the 2009 Florida Statutes) to the federal statute dealing with fraudulent use of personal information. The Florida State Attorney could decide to prosecute the person according to the Florida statute for the person’s fraudulent use of the “three pack” documents. The Florida offense is considered a third-degree felony, punishable by imprisonment for up to five years. The person is so charged by the Florida State Attorney; indicted, convicted, and sentenced to two years in prison by a Florida criminal court; and if the fraud is considered to have caused the person’s victim(s) a loss valued at least $10,000 (which can take many forms), the person also qualifies as a deportable aggravated felon (INA §101(a)(43)(M)(i)). Okay I do think it is unfair for those who wait in line to get a legal citizenship and are denied after doing everything they are suppose to do, whereas an illegal just hops a fence or crosses the border and finds a job through the help of a coyote.
I believe if the government truly wanted to stop illegal immigration they could have a long time ago. With a Army of almost a million is it? how can it not happen. Well we know why, or at least some of us do. If the millions of illegals were to be sent home at this moment without notice, would you as an American pick tomatoes, potatoes, oranges, clean windows, pick up the trash, paint houses, clean windows, scrub toiletes, work at a meat slaughtering house, and do all the jobs that they are doing for the price they are working for? So if you are then why aren't you? Why are you sitting at home refusing to work those jobs when nothing else is available? If you are then my respects to you! I know of one American who is working at a job for now until he can get his profession he went to school for. He cares less about his reputation and more about putting food on the table. So in the long run, I think most Americans don't want to do those jobs. It is funny for you guys have done them for over 200 years! Now suddenly many don't want it anymore. Then you complain about the country not doing well! Come on! What is it? There was a famous quote Kennedy once said. I don't have the exact words, but he mentioned the following: Don’t ask what the country can do for you, but ask what you can do for your country. So this means doing those jobs that Central and South Americans don’t hesitate to do! If the Americans agree on taking on those jobs then perhaps sending illegals back home is a good idea, yet if not then I would suggest that you find a different alternative for these hard working people. Afterall, your ancestory also came here with nothing and made a country through hard work. |

I think the issue is exploitation, it isnt just that these laborers do jobs that americans wont do, its that americans wont do it for the Same price. I dont think americans should be expected to lower their standards about the value of their work in order for the immigration issue to be enforced. The price of goods and services have increased exponentially in my lifetime and the wages have, mostly, barely increased at all....where does all the extra profit go? ITs corporate and individual greed that keeps these laws from being enforced. People should be paid what they are worth, so long as we defend and fight for peoples 'right' to settle for less, we do nothing to improve the conditions at home for ALL citizens.

Americans can go on the streets right now and protest. What will happen? Perhaps the government will enforce corporations to pay fair wages to sustain here in the country, but will the corporations comply? I don't think they will go against the governments will if they had to, but they will find a way to bring their business else where as you are seeing at the moment. So now what do you do? What would be a better alternative? You have either the choice to work for lower wages to make somekind of money or you have the corporations leave the country and the Americans would have to rebuild small or medium size businesses like we knew them in the 50s. I figure this won't happen either. As long as other countries are willing to work for very low prices corporations will take advantage of it. |

Exploitation for the sake of greed. Those are the fols DHS should be targeting. Take out the Illegal and see how many Americans and Legal Migrant workers flock to fill those jobs. Fact of the matter. Just about every point in that amnesty bill can be argued and the Feds can be sued by at least one group for blatant discrimination. |

For example just outside of Miami illegal immigrants, which are Argentinians, Nicargua, Hondurus, and Mexicans earn 40 dollars the whole day picking oranges. They start at 8 am all the way until 6 pm in the hot sun. I don't see any Americans doing that for a living. If you want to see a good documentary that isn't demorcratic or republican but just tells it how it is then watch "Fast Food Nation". There you will get more examples of how illegals get jobs through the help of coyotes supported silently by corporations and what kind of money they make. Construction is at 70 dollars for many of them. They work very long hours over here past 12 hours with breaks. So yes I am aware of the workforce without checking the internet or watching the corporate news in which I never do anyway. The majority who do these jobs are also latinos. And yes they get no benefits whatsoever, which is lucrative for corporations, but inhumane for most people who think about it. |

Concerning jobs overseas that corporations set up.
I also know that the stores such as Gap, Nike, and other big corporations in were you can wear that shirt you are probably wearing are created by the poorest countries that have no law of how long a worker needs to work. They go by delivery. If the US wants a million gap shirts in two weeks then the staff has to work 36 hours straight before getting actual time off for a few hours under no air conditioning, no breaks, no complaints and for less then a dollar a day. Since the demand is high in Europe and America the long hours is persistent all year round. And yes it is 36 hours at a time. This is no exaggeration. Those who work in those conditions just earn enough to buy sticky rice and some old salty fish for their family. They have no health care and if so they can't afford it and their basic neccesseties are beyond hygiene and acceptable. Yet we don't care because we have nice boot boots or a nice pink shirt for our children. So yes, most Americans as of Europeans don't care and turn their heads and those who do care are usually silenced quickly or ousted out of the media quickly. |

One worker wrote; We work hard and long hours for little pay. There is no other work available for us. If you boycott the Corp. who hire us, we will lose what little we have. If you are a humane people, you will understand and not take away our only way to make our lives. The way the Rep. and Dems are ruining our economy, the Americans who are out of work, out of Unemployment and homeless will be lookin' to get whatever type of work they can. They are the ones you don't see on the internet day in and out. I have my office in the home and I sometimes get carried away here and have to hurry up and get things done. You brought up some good points.Americans have had problems stopping illegal immigration mainly because the Liberals and Democrats keep blocking bills to do something about it.Remember how they wanted to build a new fence on the border and how Pelosi and the other Democrats were having melt down because of it?Remember how Pelosi wanted to have Safe haven cities for illegal's and didn't want to deport people once they were caught.Bush deployed the National guard to the border.Bush also deported more illegal's than any President in history.He would have deported more if we didn't have Pelosi and Congress stopping all of his progress. As far as Americans not doing the work that the illegal's do.That is such total BS!There isn't a job out there than Americans won't do.You will find Americans working on farms,in slaughterhouses,steel mills,cooking in restaurants,and working as janitors.You actually believe if for some reason all the illegal's left American the hotels couldn't find a janitor to clean their rooms?You ever watch "Dirty jobs" on the discovery channel?Seems the majority of those dirty jobs are being done by Americans. You also need to realize a great deal of illegal's or not working for dirt wages.Many of them are working union jobs making very good wages using a stolen SSN.I have worked many jobs as a blue collar worker and on occasion I would work with illegal's and the majority of the time they were making around the same wage as I was or maybe a few dollars less. |

While living in Seattle I worked with a great deal of immigrants from Vietnam,Russia,Somalia and other countries.Those wages are almost always exagerated.Yes it is true many people work long hours and may only earn $20.00 a month but what you fail to realize is how cheap everything is to live there.Rent is only $5.00 a month.You can buy bread or rice for 1 penny.A good meal may cost you 30 cents.It is all realitive.I can make $2,000 a month here and spend $500.00 on rent and $1.00 for a loaf of bread.It's all the same. You might want to think twice about blasting overseas workers.You think living in a slum and resorting to garbage sorting,prostitution or drug dealing is a better alternative then working in a factory making shoes or shirts?You think starving to death because there is no jobs in the village you are in better than a big overseas company hiring 1,000 low wage workers?Trust me a low paying job with a steady paycheck is like heaven to people who have nothing.Tell a few hundred people you want their jobs taken away because you think they are treated bad and see the reaction you get. The working long hours and working till you drop is a myth.Most workers work a normal 8 or 9 hour shift with most factories having 3 shifts.Most companies work 6 days a week.Working people too hard or for too long only increases your chances for damage to the machinery or people,stops production lines,and results in a high turn over rate which is expensive and time consuming since you need to train new people.If you have any common sense in running a large factory you will keep your people happy and well rested and not burned out and tired.They typically don't have medical insurance but if the person is a good worker the company will pay for medical problems and hospital treatment to get them working again. China is also not stuck in the 16th century like the media portrays it as.China factories are just as industrialized and modern as any found in America. |
