Decapitation or strapping a bomb on someone is death (murder) whereas torture is the threat of death caused by physical, emotional or mental harm inflicted upon another.
Note that terrorists (Al-Qaeda) do not represent a nation which can be brought before a War Crimes Tribunal where as the U.S. instigated torture can have the U.S as a nation brought before a War Crimes Tribunal.

Just as there was a real need for the torture of people in WW2 Germany for 'medical knowledge' and extraction of information for military purposes. This had those responsible before an Allied Military Tribunal and some are still brought before a War Crimes Court today. The excuse wasn't found acceptable then but should be now?
