Bill Cosby Will Be Deposed By Accuser's Lawyer This Fall

For the first time in nearly 10 years, Bill Cosby will be questioned under oath about allegations of sexual assault. California's Supreme Court recently allowed a woman's lawsuit against Cosby to continue, and the judge in the case has now set a date for the comedian to provide a deposition.

From Los Angeles, NPR's Mandalit del Barco reports for our Newscast desk:

"Judy Huth is suing Bill Cosby, contending that he molested her when she was 15 years old. She claims she met him in 1974 on a movie set and he invited her to the Playboy Mansion, where the incident allegedly took place.
"The statute of limitations for filing criminal charges has passed, but she is suing him for causing psychological injuries. The judge in the case has ordered Cosby to give his sworn testimony, planned for Oct. 9.
"This would be Cosby's first deposition since 2006, when he testified in another case against him. That suit was settled out of court and [the deposition] was recently released to the media. Cosby has been accused by dozens of women who say he raped or sexually abused them, sometimes after drugging them."
In July, the California Supreme Court denied Cosby's petition to review Huth's lawsuit against him, clearing the way for the October deposition. Huth will also provide a sworn deposition on Oct. 15 — and in a strategic win for her, she'll do so nearly a week after Cosby. The comedian and his legal team had sought to have Huth go first.

In 1999, Bill Cosby released a book for recent college graduates called, Congratulations! Now What? Though the book has been out in the world for 16 years, some disturbing aspects take on second meaning in light of recent allegations.
In the book, the comedian tells readers how lucky they are to have graduated, since they no longer have to deal with "campus sex police." In a chapter titled, "No More Pre-Caressing Agreements," Cosby describes how silly it is that men need to get permissions to have sexual relations with women they find attractive.
In the chapter, Cosby makes fun of how affirmative consent --a standard that replaces "no means no" with "only yes means yes" -- is unrealistic to how sex works. Cosby goes on about "manuals" (italicization his) that "tell the men the permissions they need" before they can start making moves.

Per Cosby, "campus sex police" are always "ready to charge you with sexual harassment if you put your hand on any woman besides one who had asked you for help in crossing the street."

At the time of Cosby's book, campus sexual assault did not receive nearly as much attention as it does today. Some colleges at the time did not adjudicate sexual assault cases. Among those that did, some schools were mocked for embracing affirmative consent. Antioch College, which became the inspiration for a "Saturday Night Live" skit called "Is It Date Rape," was one of those schools. It wasn't until 2011 that the U.S. Department of Education clarified that all colleges and universities receiving federal funds needed to respond to and investigate reports of sexual assault among students.
Cosby's thinking certainly seems to be in line with contemporary critics of affirmative consent. Even today, 16 years after the release of the book, conservative columnists insist that "yes means yes" is too difficult, confusing or that it would kill the mood to ask for consent in sexual encounters.
In the chapter, Cosby paints a hypothetical situation, four pages long, between a college male and female. The obviously ludicrous depiction is supposed to prove how awful and comical it is when sexual permissions are required. The Huffington Post has obtained a copy of Congratulations! Now What? and has recapped the scenario below.
The scene is set in "a leafy college lane" ...

Two students attempt to go on a date. They stroll along three feet apart, on a "typical" college date. The first line of dialogue comes from the male, "calling" to the female, "I'm really glad you agreed to go out with me, Louise." The female calls back, "Well, I heard violins when you filled out the pre-foreplay form."
The female student then derides the male student for saying she looks lovely in the moonlight:
FEMALE: Max, I don't want you to have a record, so I'll pretend you didn't say that without permission. Do I have to quote the Supreme Court on Ruddy v. Weinstock and Kansas State?
MALE: Sorry. Okay, Simon says: May I look at your face?

The female student warns her male counterpart not to "wonder if [she's] ovulating." She then claims that she's trying to stop her ovulation cycle, and suggests the male student try and lose his testosterone as well.
As the male student in Cosby's depiction sneaks a glance at the moon and the female student "snuggles up to her copy of The Illinois Criminal Code," the two negotiate whether hand-holding would be all right. She initially says that she's saving hand-holding for her husband, but eventually offers a "couple of knuckles."
The two can't do much more because the harassment office was out of the right forms. The male student says an oral contract could work, but the female responds, "Do you really think I would be involved in anything oral? That's for Sodom and Gomorrah."
The above scene ends the "No More Pre-Caressing Agreements" chapter, and Cosby switches back to writing financial and career advice.
Earlier this week, a judge ordered Cosby to give a sworn deposition in a lawsuit, where he is accused of sexually abusing a woman at the Playboy Mansion when she was 15 years old.

His words were do to his " king of the hill" mentality. Right to the end he had no shortage of words or advise to others. Words of wisdom from the "mentor"

Now.. well, now not so much.

But a judge is now forcing his mouth open.

It sure will be interesting to see what comes out ;)

In my opinion, there is more.. a lot more... that he is praying does not come out. That is one reason he is dead quiet. You see, sick people like this usually have a history of their conquests.. a memento. Be it photos or some other sort of trinket to remind them of the "good times". That is also a characteristic of a serial criminal. Over time, these "trinkets" sometimes find there way to other people.

We'll see what pops up in time.

Well Cosby certainly broke the act of sex down to a game.. his game. And he "won" those games by knocking the opponent out with drugs.. then raping them..

First of all these woman are not repeating a story. The are explaining what happened to them. All have a certain common denominators which are found in ANY serial criminals M.O.

Secondly, the public is not " finding it easy" to believe . They based their judgment not only on what the woman said but by his OWN, words, which sealed his fate in the public eye.

third, family values???.. Again his OWN words destroyed that myth. Is was a charade.

And lastly, the vast majority (if not all) institutions or charities that had any donations from him still avalible have given them back to him. All have stripped any mention of him from their organization Including colleges, scholarships, Disney, cities, and charities.

Across both the white AND black communities. Across ANY community

The institutions, colleges, charities & corporations are run by some very smart people who do not take stances lightly. They all did this for one reason.. they believe he is guilty too.

I have yet to read one story.. not one.. or read of one protest.. not one. form any person who felt that any of these entities did the wrong thing
.
I see no grassroots protest from any group of people to protest any of the actions taken against Cosby. None.

He won't even come to his own defense.. because he has none.. plain and simple

According to TheWrap.com, one of Cosby’s accusers, Andrea Constand, and her attorneys filed legal papers on Monday (Aug. 3), accusing the embattled comedian of waging a “thinly veiled defamation campaign” against her.
The New York Times highlighted a portion of the deposition in a recent report in July, despite obtaining the full transcript of the deposition. Legal papers filed in July by Cosby’s legal team accuse Constand of breaching her confidentiality agreement with the comedian and suggesting that Constand and her team might have played a part in the leak of the deposition Cosby gave in 2005, requesting discovery to prove that they did, TheWrap reports..
News of the leak generated recent headlines while influencing public opinion on Cosby. Constand’s sexual assault lawsuit against the funnyman was ultimately settled in 2006. Cosby’s team is requesting discovery to prove that Constand’s legal team had a hand in leaking the information, a claim Constand’s legal team dismissed in its filing.
“Neither counsel was aware of, or had participated in the release of any testimony,” the papers read. “In fact, [Constand’s] counsel believed that Defendant had orchestrated its release.”
“A simple phone call to the court reporting service which released the deposition should have been sufficient to allay [Cosby’s] ‘suspicions’ and cause his counsel to forgo filing a meritless claim,” the papers added.


Constand’s team countered claims made by Cosby and his lawyers, saying that they are trying to bury Constand with motions.
“Each motion is more vitriolic than the last, and all these motions do is create a circus atmosphere that brings disrepute upon the profession of law,” the papers said while noting that , adding that Constand “requests that the court stop Defendant’s thinly veiled defamation campaign under the guise of ‘legal motions’ and sanction defense counsel.”
In addition to defamation, the legal papers go on to accuse Cosby attorney Patrick O’Connor, who it said “exhibited open hostility toward [Constand’s] counsel.”
“His conduct was indefensible and now he seeks to ‘sling mud’ in an attempt to divert attention from his own bad conduct,” the papers added.
Accusations made by Constand’s team have been denied by Cosby’s attorney, Martin Singer. Monday’s filing by Constand’s team is the latest development as Cosby stands accused of sexual assaulting and drugging women.

With the number of his accusers up to 47 and another disastrous deposition fast approaching, some folks are worried that Bill Cosby might make a break for it. According to the latest gossip news updates, several of the popular TV dad's victims fear that he will soon take his millions and flee the United States, for a country with a more liberal sense of sexual consent. After being able to effectively insulate himself from criminal prosecution thanks to his hit show, it looks as though The Cos might be able to escape having to compensate the women he has reportedly harmed as well.

Although he honestly seems a little old to start a life on the run, word has it that some of Bill Cosby's alleged victims are scared to death that by the time their civil suit makes it to court, the defamed comedian will be living far, far away in another country.

One source in the latest August 17, issue of Star magazine explains that it would surprise very few of those involved if Cosby somehow slipped out of the U.S. all together in order to escape ever having to actually live with court's verdict:

"He's bene so shady and flat-out dismissive of the amount of hurt he's caused these women that they're worried he will run rather than pay damages."

According to the insider, it is not as though Bill couldn't pull up stakes in the United States and settle down in any one of the foreign countries to which he already has ties:

"The longer this goes on, the more tempting exile becomes.

"He has friends in Saudi Arabia so that it a possibility.

"His money could go a long way there."

For now it looks like Cosby and his team of lawyers are content to battle it out in court for a little while longer yet.

Cosby's legal team have responded to the request to depose Bill, reports the Philly.com, with their own demands for answers:

"Cosby's lawyers have filed a motion seeking to grill some of his accusers' attorneys, claiming in court documents that they 'may have played' a role in releasing the comic's damning deposition to the New York Times and other media outlets.

"But lawyers for three accusers filed a counter-motion on Friday seeking to block Cosby's request.

BILL COSBY'S lawyers have filed a motion seeking to grill some of his accusers' attorneys, claiming in court documents that they "may have played" a role in releasing the comic's damning deposition to the New York Times and other media outlets.

But lawyers for three accusers - Tamara Green, Therese Serignese and Linda Traitz - filed a counter-motion on Friday seeking to block Cosby's request. They also filed a motion to financially sanction Cosby's legal team, Patrick J. O'Connor and George M. Gowen III, with Cozen O'Connor, for its motion.

Lawyers for the accusers argued that the motion "is frivolous" in court documents.

The legal back and forth stems from the July 18 release of Cosby's two-day 2005 deposition in a civil lawsuit brought by former Temple University employee Andrea Constand, who had accused him of sexual assault.

A memorandum that included excerpts of the deposition was unsealed by Judge Eduardo Robreno early last month July after the Associated Press requested the records. The complete deposition had been under seal, but the New York Times obtained it from the court reporting service Kaplan Leaman & Wolfe, hired by Constand's lawyer, Dolores Troiani.

Cosby's lawyers were furious with the release, telling the Inquirer that the deposition told only one side of the story.

In the motion seeking to depose the plaintiff's lawyers, O'Connor argues that "[t]he circumstances are suspicious. [Cosby] should be entitled to explore whether Ms. Constand's lawyers played any role in the transcript's release." He also wants to ask about Troiani possibly violating an order that O'Connor says would have barred her from releasing confidential documents.

There "are legitimate questions about the role that she [Troiani] and Ms. Constand's other lawyers may have played in creating the 'recent events'- that is, the public release of [Cosby]'s complete deposition - that she had so earnestly sought to bring about and from which she is now trying to profit," according to the filing.

But other alleged victims' lawyers said that the motion "is frivolous, has been filed in bad faith and is an attempt to vexatiously multiply the proceedings," according to the sanctions motion submitted by Joseph Cammarata, with Chaikin, Sherman, Cammarata & Siegel, in Washington, D.C., and Robert Sachs Jr., of Shrager, Spivey & Sachs, in Philadelphia.

they can go after the money, which Im sure they will, which Im sure was the purpose because its not unknown to anyone in the legal field that the statute for rape is well over,,,,

and he may 'flee' to avoid CIVIL penalties, which have a different standard of proof (instead of beyond a reasonable doubt, on the accusers part, they only need a preponderance, which can be a subjective standard based on upon those on the jury and in the judges seat)

Jay Leno has mixed feelings on fellow comedian Bill Cosby, but he was clear on what he thought about the scandal.

Leno decried the media for initially casting doubt on the women who accused Cosby of molestation.

"Fifty women come forward and (the media) calls them liars, and says 'Oh, you waited 40 years,'" Leno said, according to Deadline. "Men waited 50 years to say that a priest touched them and got $7 million. How can we believe them and not the women? It seems terribly sexist to me. It seems unfair and I'm surprised no one has made that analogy."
Leno was at the Television Critics Association press session for his new CNBC show "Jay Leno's Garage," and he shared his thoughts on Cosby and the scandal that continues to grow: Three new accusers stepped forward on Wednesday.

"Bill Cosby is a wonderful comedian and has always been a nice man, I feel bad about this as anybody does," said Jay Leno, "but I don't know how he comes out of it."

He suggested that Cosby confess to what happened: "I think you admit what went on."

Cosby has been accused by more than 30 women of sexual misconduct; 35 of them were profiled in a New York Magazine story. Most accusers said Cosby gave them drugs before sexually assaulting them.

Cosby, 78, once admitted in court to giving drugs to women he wanted to sleep with. Many celebrities like Whoopie Goldberg and Jill Scott who originally supported Cosby have now changed their opinion. Reruns of the "Cosby Show" have been pulled from TV channels like BET and TV Land.
