Topic: Statutory rape should not be a legal issue.

Then there's the case of stupidity on the Judges side.

Two kids are hanging out together since she was 12 and he was 14. They have sex when she is 15. They have sex again on his 18th birthday, have a fight and she wants statutory rape charges pressed. He gets convicted, has to register as an offender and has this stigma follow him for life.

I've read court cases where Judges do just that.

Nobody said it was a perfect law...But...Are you faulting the law or the judge or both?....

seems it's time to overhaul those Laws!

We finally did here, and also added an Exception-Clause if the Age is close!

The age of consent in Switzerland is 16, as specified by the Swiss Federal Criminal Code, Article 187(1). However, there exists a close in age exception if the difference between the ages of the participants is three years or less (Article 187(2)).

Many states have exception clauses based on age Conrad....The legal requirements here vary from state to state...

not only should statutory rape laws remain but they should be strengthened. If you are an adult and not certain your partner is Old Enough under the law, then they probably are not old enough and you have no biznezz there....under the law or otherwise. If you are having sex with someone you do not know well enough to know enough about them to know their age you are probably in the wrong. period. If you take that chance you may pay the piper.

be ready....most guys know the law here so no sympathy

plus there are other related deliquency of a minor charges here

if a 14 y/o is having an abortion she should have to declare the father to do so...and if he over 18....come on out shootin'

just my thought

And you were carded before you got naked when?

Sex is not buying booze.

Let's switch the flip.

You're in a club and you seeone hot checking you out. Theysend the waitress over to you with a drink before they approach you. You spend the night drinking with them, and take them home, only to find out the next morning, that they're late for school.

Turns out you just bedded a 16 year old wearing beer (or martini) goggles.

How much time should you do?

Whatever the judge decides based on that states requirements and the merits of case as presented....If you are stupid enough to let a minor pick you up, if you are dumb enough to have sex with a stranger, you could find yourself in a similar predicament....

I wouldn't complain...

As long as she gets prosecuted for possession of the fake ID she used to get into the club, and the underage drinking she engaged in while in the club AND fraud for falsely presenting herself to be of age in an establishment where it was illegal for her to be.

That should equal at least if not more time in jail than I would get. shades

What law, what judge? There is but a statute and a magistrate that is doing criminal acts.

Isn't it amazing at how some citizens slutty daughter can do whatever they please but then others can be held responsible for those actions, all in the name of justice for the sake of corporate profits.

What a marvelous country we live in.

Lets start with the fact that some underage females are
very mature and experienced and do consent to having
sex with there older boyfriend any 15,16,17 yr old female
are sometimes the more aggressive in the relationship!! a male
up to his mid 20s sometimes is no more mature sexually or
mentally than the female ages listed above!! sometimes age is
just a number its hard to except a 35-40 yr old male dating
a underage teen!! a 18 - 27 yr old male would not be that
hard to except besides the fact these young girls have dated
older men usually that people usually have no knowledge of
NOW if the teen has been attacked ,forced, raped with force
there is no excuse for any person this is a crime and should be

sent to the cell with bubba to figure out whos going to be the husband and whos going to be the wife !!!!!! thats alll

I dont think this age difference should be a issue the fact the
female was enjoying all that was going on when things are going
good !! the facts should be stated and she should without a doubt
be convicted of falsifying a police report especially if the
couple has friends to testify she consented to the affair
and all the acts !!I dont see no crime of any kind this
age difference should be overlooked !!!and at the discretion of
the courts to determine or take special interest in the case this has to happen now for any manditory min sentence to be altered by the judge otherwise the judge is just there as a referee between the piece
of crap da and the defence attorney and client the da can give one person 1 month and another 2 yrs for the same offence the judge wont
say anything he just convicts!! unless you study law you are subject
to have the da basically rape you!!!! so the bottom line is some
cases are the same some different and should be dealt with on a case by case basis upon the circumstances!!! im sure if some underage girl was sneaking up on it while your sleeping you will be charged .,so dont wake up then your safe from any criminal wrong doing !!! stay a sleep

10 times out 10, the DA is nothing more than a paid hypocrite.

Look at the case of the "child" Lauren Bush in the news.

If she gets laid, this 16 year old is a "child" that MUST be protected.

But since she used a knife to cut someone, this "adult" MUST be punished!

Hypocrite much? shades

Well there are "laws" and lawyers to justify about everything criminal in the United States! Then there is "The Parents Law"! In my opinion i raised my Daughter to know right from wrong and "Was" the Father!! Let the pervert or little puppy come sniffing and i deal with it "personally" and believe me i've kicked a many"puppy azz"in front of my Daughter!! The Hell with any law that says i can't raise my Children or protect them!! That is what a REAL PARENT does! She was raised by knowing the consequences of her actions as well!! My daughter is 33,Married,2 children, with Selfrespect and Morals, and the same attitude as me!! That is something to be Proud of in todays society!! To this day i would Give up my Freedom or Life for my family. Todays Laws are for the Criminals anyway!!

A felony is a criminal charge that is DEFINED in terms of possible punishment...It almost always starts with an arrest...Once "a police report" is presented to the District Attorney's Office, they decide what charges (if any) should be filed...Police may also investigate a crime and identify a suspect and, rather than arrest that person, present the case to the DA who in turn files charges...Either way, the charges are decided by the DA, not the victim, not the judge, and certainly not the police or the perpetrator...In law, anyone under the age of majority is considered a juvenile...Typical age is 18, but can vary depending on jurisdiction and application...Federal government declares the official age of majority is 18, states have the right to implement a different age...The distinction between a juvenile and an adult is different and so carries different prosecution efforts...Juveniles are tried in juvenile court and the juvenile court system does not include adult incarceration unless the court decides that, due to the seriousness of the crime (usually a violent crime), said child will be tried as an adult...If you don't understand why the primary focus of a juvenile court systems is to rehabilitate as opposed to punish a child, perhaps the best safety precaution FOR YOU would be to avoid having consensual or nonconsensual sex with minors...whoa slaphead sad2
