I need some advice. Right now I'm receiving ssdi. But two years ago i got hurt working for a temp place. My settlement case was supposed to go in front of the judge for his approval yesterday. Well. i called my case manager of workers comp. And she told me that since I am getting ssdi, that the state wanted it to go into a medical set a side agreement. Now. That will delay me getting my settlement for at least another 3 to 6 months. Well. It would be great to get the settlement earlier than that. A friend of mine told me last night, that it would be best if I left the medical open. Meaning that instead of getting the money for future medical expenses for the injury and having to put it in an account. To turn down the $ amount for that. I need advice. Please help. Thank you. Workers compensation laws vary from state to state. You need to seek advice from an attorney who is knowledgeable about the laws in your state.

I didn't think about the laws being dif. in dif. states. I live in cali.

Been thru workmans comp 10 years ago.. sounds like they are going to give you an impairment rating ( how bad you were injured0 then they give you a lump sum. I cant remeber the pecentage they paid me but i got bout $20,000 but was on w c for 2 years prior..I have since had 3 back surgerys and live in pain to some degree on a daily basis. But im not bittewr, on ssd and have side jobs.. Oh and if you b s ing bout how bad your hurt or just faking.. watch out! they will watch you, put you in jail for insurance fraud..

Had my WC case from '04 - '07 ... knee injury at work. They covered all the ortho / MRI / doc bills and meds. Never received any 'replacement salary' money from 'em and my ortho docs (well, 2 of 'em) advised against surgery. The third wanted to 'git t' cuttin' right away and got pizzed when I said no, so he terminated my case by telling WC I had no ongoing problem. Anyhow, after that came a call from WC saying that they needed me to provide them with ALL my financial and income information for the last three years since they had paid my salary. It was at that point I had to tell 'em they weren't getting squat from me regarding my income because the only payments they'd made were medical, not income replacement. Be careful when you're dealing with these people - they'll act as if what they ask you to do is reasonable, normal, and expected ... they'll also lie about what they've actually done. Oh - the post about them keeping you under observation and taping your actions is true ... they sent a PI to my apartment's property mgmt office and lied to get information. Trust nothing when you deal with these people.

State by state and job by job. I was told in my job interview before I took the job that the place I work doesn't pay workman's comp. I thought it was a federal law. I think it has something to do with amount of workers. I work for the county and have to abide by state and federal laws. But where I work is set up as nonprofit. It is like the commercial says: "Big business has lawyers working hard for them. Shouldn't you?":smile: Good luck with it.
