My neighbor never complained about my smoking in my apartment before now!! She says the smoke from my cigs goes through her vents!! Can that happen?? I've never heard of that. I always thought the vents for apartments were separate!! Are they connected to each other?what



It is very possible, cigarette smoke can be very strong. Id check with the management office regarding the 'official' rules but I believe it would be neighborly to consider your neignbors children and find times and places when your smoking will not harm them.

If she's only lived there a short time, she may actually be smelling the smoke from a previous tenant in her apartment. In which case, it would be a psychological thing. If you are a heavy smoker, or if you've lived in the same apartment for many, many years, the smoke may have seeped through the walls. But even then it would only be a slight residue on the adjoining walls that she may smell. Or some smoke may have drifted out into the hall under your door, in which case people walking by can breathe a VERY small amount of smoke. I would think that if the ventilation system were connected, that they would not allow smoking inside the apartments. Honestly, it sounds like she has an axe to grind. Some people are like that. The suggestion about the fans may be worth a try. And, yeah, quitting smoking is ONE option, but I'm not going to attack you for smoking. That isn't the point of this forum, I don't think. I also don't want to be one of "those kind of ex-smokers."

Sounds like your new neighbour has a control issue to me.If your lease does not mention anything about not smoking in your little corner of your world then there is nothing she can do about it except move.

that is one reason I never live in apartments...one reason though. I smoke but I smoke outside, but that is my choice because I know it bothers my sister. I believe you do have "legal" rights if it is a smoking apartment.

If you want to be "nice", maybe you can circulate the air or something?

im prolly going to give the least popular answer here.

allow me to start by saying that i used to be a heavy smoker...and even as a smoker i respected other peoples right not to inhale this $hit.

the ppl before maybe didn't mind it, the new ppl do mind it.
you are paying rent for your appt but as soon as that smoke enters my home, now you are bring uninvited toxins into my appt that i am paying for.

IMO if you want to slowly take your own life than feel free, but second hand smoke is worst than smoking its self.

please at the very least consider my life even though you clearly do not consider yours.

Cigarette smoke permeates the walls. It's definately possible that it went through vents and even the walls, especially if they're thin.

They sell KILZ paint that's supposed to trap the cigarette smoke in. Works on mild cases, but not heavy. We've had to tear out sheetrock walls one some make-ready appartments because there wasn't enough paint in the world to cover it.

I'd have to agree with Edy about if it's coming into my place. Then it's over the line. The person sounds like they're trying to go a decent way by letting you (OP) know first. I could easily see a lawsuit on the management by the other person for allowing harm like that. They can move out, but they also deserve and expect some semblence of health safety.

If she talked to the landlord and there is a problem I'm sure the landlord would have come to you...wouldn't you think?

I smoke, I don't smoke inside and haven't for 20 some years but that's because of my kids. If you are allowed to smoke there it is just kinda to bad for the neighbor. I mean, I don't want to sound like a jerk..I know non smokers don't like smoke. But if your allowed to then the neighbor just will have to get over it. Or get some sort of device to filter it in her/his place.

edit to say..how in the hell did you find a place in Utah that lets you smoke inside? Maybe it is just Utah county, but I have even had people NOT rent to me because I'm a smoker. Even when I tell them I never smoke inside because of my kids.

Cigarettes are nasty...it is her choice if she wants to smoke. I choose to smoke outside in the cold if it's winter, in a blizzard if I have to..that is part of being a slave to this nasty addiction.
I don't want my boys to have to smoke with me...however she is paying rent in an apartment where she is allowed to smoke.
When I am house hunting I want to know what the rules are..I want to know what the neighbors are allowed to do so I know if it is a suitable place for me and my children. If I have a child who gets sick from cigarette smoke I would be asking the owner..."Is this a smoke free apartment?"

There are very few places a smoker can smoke any more..if a smoker chooses to smoke at home that is the one place they should be able to without getting a bunch of crap...especially from here from people who don't even have to deal with it...

everything that is legal is not neighborly. because a neighbor may be within their RIGHTS to call me a foul name does not make it the neighborly thing to do. IT never hurts to be considerate of others, even if the law doesnt mandate it.

Oh I can't imagine...that's one of the first things I ask...how can some one forget about their pet..that's sad. I have had my cat 11 years now. If no pets is a rule I move on...

That's why I stay put right now..between my cat and my smoking and being single..it is hard here to find a place. I got lucky and I'm not going anywhere even if the place is a dump.. slaphead

I have actually had people not want to rent to me before because I'm a single mom..radical. The OP and I live in the same state..but I'm in Mormonville, she is down south and not.

There is no freaking way smoke from your apt is getting into your neighbors unless there is a hole in the wall big enough to walk through. She might have got a wiff of something as she walked past your door and is a whiny old b!@#$ or an ex smoker looking for something to complain about.

Rdsox is hardly being a bad neighbor..fowl name calling has nothing to do with the op and her concern..she is concerned here or did you not pick up on that? The neighbor has some responsibility here..if it is making her child sick she should be looking into a air filter instead of just complaining.

Smoke in your car or at your door with it opened. Smoke can get through small cracks, vents, attics, etc. You say it is your right, if I lived next to you I would not want to smell smoke either. I have a right to a safe living environment maintained by a landlord that is not negligent. If I had that problem I would take the landlord to the magistrate for breach of lease and then he/she would be forced to evict. For crying out loud the neighbor has children!
