I've been seperated for almost 4 yrs now and my "husband's" gf just emailed me asking me if I had gotten the divorce (yet again). She said that he had signed up for SSI and he received a paper from them stating we had been divorced since January. Since neither he nor I have filed then how could that be?? I asked if she was taking his word for it or had she personally seen the paperwork and she stated she saw it. Anyone with any ideas??

If neither have filed there's no divorce. But why have you been waiting 4 years to get a divorce?? lol

$150 you can file your own here in Michigan!

Your spouse must have notice that you have filed for divorce so that they can take part in the case if they want to. Once your spouse receives a notice that you have filed for divorce, he or she can choose to ignore the case or get involved in it.

If your spouse chooses to ignore the case, then you can go ahead without their involvement. But your spouse must be given notice so that he or she can make that choice. If you do not give your spouse proper notice that you have filed for divorce, the judge cannot give you a divorce.

That is exactly why I asked her had she saw the paperwork for herself or was just taking his word for it. She is as warped as I was with this guy! Trust me, had I been able to file I would have day 1 after putting him on the road. Life has a funny way of doing things to us.

In Oregon and Washington the law states that either parties can file for divorce, the other does not have to be present or served if they cannot be found. There is a 30/60 day waiting period and it is publicly posted as such and then the judge signs the decree and you are divorced.
It costs $385.00 to do yourself.
Just random info of no use to anyone unless you live in those states.......

Not all places have things like that. Some states the do-it-yourself paperwork is such a hassle that people have to hire lawyers to help them do that much. And that cost a lot more.

It's not beyond some people to just draw up papers and try to pass them off as "authentic and legal". There has to be the issuing court information, yours and his names, addresses, ssn's, docket #, etc. on top, and the judges signature, court seal, etc. at the end on the bottom. Also as it was earlier stated, he has to legally notify you, and you have to sign, then he submits those papers, and gets a "certified copy" of the judgement, which he then has to have someone deliver a copy of the judgement to you and fill out a "affidavit of service", which the server fills out to verify that you received it.

Stop talking to this woman, it's really none of her business. If they are living together, (there's a term for it, unfortunatly it eluded me right now) and she is his "illegal spouse" let him and her keep going, and you'll have a grand time in court...

Someone had to file. After a period of time they will grant the devorce even if you dont sign. You should check, because there can be something in the devorce papers the judge granted, without your knowledge. Good Luck
