It's not beyond some people to just draw up papers and try to pass them off as "authentic and legal". There has to be the issuing court information, yours and his names, addresses, ssn's, docket #, etc. on top, and the judges signature, court seal, etc. at the end on the bottom. Also as it was earlier stated, he has to legally notify you, and you have to sign, then he submits those papers, and gets a "certified copy" of the judgement, which he then has to have someone deliver a copy of the judgement to you and fill out a "affidavit of service", which the server fills out to verify that you received it.


You can look up in your counties public records and it will say if you are divorced or not. It is usually online in most counties.

In Michigan it takes a minimum of 3 months w/o children/6 months w/children to get divorced.. and if there isn't any disagreements.

$150 to file a "do-it-yourself* divorce and the cost of a book, that they even tell you where to purchase it, it comes with ALL the forms you need for filing. :wink:

My wife claims she started the divorce & yet no papers, I wonder If I can just go to the court myself & file even though she has a lawywer, this as well in Mass...

True, he may have pulled some strings, or found some loophole to crawl through to do it without your consent. Though they can't open the file (sealed) unless you have the docket number and ID, but expain the situation to them, show them your ID, and ask them if there is at least a file there. Then ask them what to do to get a copy.

Where i live, if one person can not find the other, there is an option to do a posting in a newspaper for 30 days, if the spouse does not reply to the add, it can be filed within the courts and the divorce can be finalized 60 days later...

See the thing is, he has been asking me to come back the whole time. I am not even sure he would file for one anyway. His answer when I said he could file was that I was the one who didnt want him and wanted out, so I would have to do it. I am going to try to contact the courts tomorrow to find out. If there is a miracle and we have been divorced since January, then you will all know cuz I will be hosting a big huge mingle party! laugh drinker

ether party can file the divorce. her lawyer may fight you on some details, and may cause you to need a lawyer depending on how b!tchy she decides to be about it.

but you can file.. and it will most likely get done faster if you do as she doesnt seem to have any urgency in doing so.

I'm going to look into it, I don't understand why she got a lawyer, we don't have children nor do we own property & she makes double if not more than I make for income..
