Little Girl’s Lemonade Stand Shut for Not Getting a $3,500 Permit

Orange County, CA – Annabelle Lockwood makes the best homemade lemonade around Fountain Valley. Using her grandma’s recipe, a homemade stand built by her father and a lot of passion, she serves the gourmet refreshments – classic or pink lemonade, and flavors like peach, blueberry ginger and watermelon – to eager customers and charitable events.

But her passion is being tested by the regulatory hand of the State. Orange County authorities shut down Annabelle’s “small business” and gave her 30 days to get the proper permit and license.

The permit will cost around $200, but in order to secure the permit Annabelle will have to meet a bevy of government requirements – costing $3,500 – just to serve fresh-squeezed fruit juices to thirsty passersby.

According to the GoFundMe account set up by the Lockwood’s to help meet this financial burden levied by the State:

“1. She needs to upgrade her cart to get it up to commercial standards, in order to pass the inspection.
2. She needs to make the lemonade in a licensed facility. Licensed kitchens require: Liability insurance, a business license, a deposit and an hourly or monthly fee for use.
3. She needs commercial grade dispensers and bottles.”

The family has received enormous support after media began telling Annabelle’s story, but in the meantime she has had to “turn down a wedding, corporate events, movies in the park and church events,” according to local KTLA 5.

Annabelle had previously set up her stand to help charities such as children’s cancer research and homeless services, but that was put on hold pending government permitting. She’s also had to turn down “a wedding, corporate events, movies in the park and church events.”

“This isn’t just another business venture… it’s becoming a life lesson for a young ambitious entrepreneur. She will be able to do so much more in the community as well as at charity and school events to help others. She’s extremely passionate about her business, and we are so proud of her for creating something that so many others can enjoy!”

It’s turning out to be a hard and fast lesson in how government requirements on business – many of which play no role in protecting people or the environment – put a heavy, unnecessary burden on aspiring entrepreneurs. Revenue collection is often the only driver of government permits and licenses.

Bearing down on the age-old tradition of youngsters setting up lemonade stands demonstrates how obsessed the State has become in “regulating” small business.

It appears that Annabelle made it through the gauntlet, with the help of many who donated to her GoFundMe account after reading her story. Others are not so fortunate, though.

In Portland, Ore. an 11-year-old girl wanted to sell mistletoe from their farm at a holiday market to help her dad pay for her braces, which cost $5,000. But the Parks Bureau refused to let her set up without a permit, lease or concession agreement. She was told she could beg instead.

It's not like she's setting up in her parents driveway on a saturday afternoon with a pitcher of kool aid.

I mean it's like the article is: "little girl arrested for playing doctor with her brother, government says practicing without a license.
- OMG! Government overreach! It was just a harmless little game. So what if she was using real scalpels and removed his appendix! Do you know how much money it takes to get licensed? She was only 11! She said they were just playing doctor! The government puts an onerous burden on people that are just starting out in medicine and on little kids."

Not just setting up a stand alone kiosk on private property hoping people come by.

Free thought doesn't seem to include common sense.

It’s turning out to be a hard and fast lesson in how government requirements on business – many of which play no role in protecting people or the environment – put a heavy, unnecessary burden on aspiring entrepreneurs.

It's also keeping every illegal Tomijab, Dik pho, and Javier from setting up "reel merikan fud!" kiosks on every corner selling fresh from the e.coli tainted fields of Mexico produce, authentic Lewie Button handbags, and straight from China real iPhanes and Polex watches.

Reminds me of my childhood...The cutie next door use to setup her stand on the curb, wipe her runny nose with her fingers, then proceed to thrust them into the pitcher and hand stir a fresh batch of lemonade....nowadays she slides down a brass pole at the local strip club... her fingers are still sticky.tongue2

By the way, I'm specifically NOT suggesting that these laws were competently written. We suffer from a lot of badly written legislation, which, although it is actually supposed to be targeting people who do "bad" things, end up hamstringing people who shouldn't be subject to them.

But the thing to do, is to get the laws rewritten to make them work right. Not throw EVERYTHING out in a fit of emotional/political pique.

The frustration I have with stuff like this, is that I've run across similar things all the time, and most of the time, it isn't a simple matter that "some meddling resentful liberal or conservative person with an agenda forced a dumb law to be passed and enforced," as most people seem to want to assume.

Instead, what has usually happened, is that a law was passed to deal with things like amateur restaurants opening up without sufficient attention to cleanliness, and people got sick.

Then when someone like this young girl started her project, some petulant person demanded that the authorities apply the restaurant laws to her, maybe because they didn't like her dad, or for some other petty reason.

The thing is, as always, I want to ACTUALLY FIX THE PROBLEM. Just demanding that the government never pass any laws to regulate healthy business practices, isn't a clever response, nor is saying that children should be allowed to do whatever they want, and that only grownups have to behave responsibly, or whatever OTHER knee-jerk idea people respond to this kind of thing with.

But again, I have only very very rarely run across a situation like this, where someone ACTUALLY managed to get so much control of the government, that they were able to directly pass a law designed to be mean to any and all people who wanted to sell lemonade or whatever.

And it's sure that nothing will get fixed, if the actual problem hasn't been identified. And no, that doesn't include slapping a general "It's the COMMIES!" kind of label on it, and then clapping for each other for saying such things.
