Canada’s highest court has just ruled that some sex acts between humans and animals are legal.
In a quixotic ruling, the country’s high court ruled that a man who was on trial for raping and sexually exploiting his own daughters wasn’t guilty of “bestiality.” The man reportedly, “smeared peanut butter on the genitals of his victims and had the family dog lick it off while he videotaped the act.” The convicted man took his case to the Canadian Supreme Court, demanding that the bestiality charge be nullified. In the end, the court agreed. As a result of the rape case, the court ruled 7 to 1 that humans having sexual contact with animals is OK if there is no “penetration” involved in the act. In its ruling, the court decided that the legislature had not clearly defined the terms in the country’s bestiality laws and the way the statute is written should be read to only outlaw animal penetration, whether that penetration is animal to human or vice versa. “Although bestiality was often subsumed in terms such as sodomy or buggery, penetration was the essence — ‘the defining act’ — of the offense,” the court’s ruling states as reported by The Independent. The high court’s lone dissenter, though, said the ruling would mean open season for the sexual exploitation of animals. “Acts with animals that have a sexual purpose are inherently exploitative whether or not penetration occurs,” Justice Rosalie Abella wrote in her dissent. Animal rights activist Camille Labchuk agreed with Justice Abella. “As of today, Canadian law gives animal abusers license to use animals for their own sexual gratification,” she told the paper. “This is completely unacceptable, contrary to societal expectations, and cannot be allowed to continue.” The question is a troublesome one here in the U.S. as well, dividing liberals and serving as a watchword to conservatives. Recently, for instance, animal rights activists in Ohio were rallying for the legislature to make it more explicit that sex between humans and animals is forbidden by state law. In April, animal advocates were seen protesting at the state capital in Columbus to raise awareness that Ohio has no law outlawing sexual exploitation of animals after a 61-year-old man was arrested for committing sex acts with dogs. Ohio is one of only eleven U.S. states that don’t have any bestiality laws on the books, advocates say. The U.S. and Canada are no outliers in having a mixed record when dealing with bestiality. IMO kind of a big difference between: "Non penetration sexual contact with animals doesn't fulfill the definition of bestiality" vs. "sex with animals is legal." The high court’s lone dissenter, though, said the ruling would mean open season for the sexual exploitation of animals.
Does that guy really think there are a bunch of animal molester's out there saying "Oh man, I wasn't doing anything with animals before...but now that it's okay, me and some Jif are going cruising at the pound!" There's still "animal abuse" and "animal cruelty" and such things. Just because a certain act doesn't fulfill one particular legal terms definition it doesn't mean it doesn't fulfill another. Ohio is one of only eleven U.S. states that don’t have any bestiality laws on the books

One caution.
There is actually TWO big things involved with this, being mooshed together as though they are one thing. The Canadian thing looks like a case where a very specific situation was decided in favor of the criminal, and not thought through very well by the judges involved. If bestiality HAS been effectively legalized in Canada because of this, I expect that their parliament will act fairly quickly to adjust the laws accordingly, so that it isn't. The UNRELATED activities here in the US, where people are fussing about bestiality laws, has nothing to do with that Canadian mess. It's much more complicated. For one thing, the motivations and concerns of the people doing the pushing, and those resisting, aren't necessarily about actual bestiality at all. And it's not a "liberal versus conservative" thing either. Suggesting it is, is part of the problem, part of what is driving up suspicion of, and resistance against the people who want more anti-bestiality laws. It has become VERY common in America, for people who continue to resent some social change, to try to come up with an end-around cheat, to re-institute whatever version of the world they want to have back. We have lots of instances of people pushing for new "rights protection" laws, NOT because anyone needs protecting at all, but because they want to re-establish the ability of one group to oppress another, and or force them to live according to their prejudices. It's similar to the fake efforts to deal with the huge, non-existent danger of elections being decided by illegal immigrant voters. Fighting to add new anti-bestiality laws, when there has been no spike in apparent bestiality crimes going unpunished, is VERY suspicious, and should be resisted, until the real motives and goals of those pushing for the laws is revealed. |
