      my fiance's daughter's mother was found guilty of child abuse by DHS and they are going to do an evaluation and replace his daughter with her mother the one who burnt her with a ciggerete

  Your future step daughter was removed from her mother's house, because of abuse....I got that bit, then what is being replaced by who?  |

      DHS is doing an evaulation and put his daughter back with her mother

      ok.. so she was found guilty but will still have custody...

      I think there are laws or lawyers that can stop that if the child is in real danger! Check you local laws!

  Does his daughter have her own representatio? And is the father of the child in a position to go for full custody? How old is the child?  |

      the daughter is four years old and we are trying to get full custody but might be changing lawyers

      Was it intentional abuse or an accedent? And by no means should the child be in her custody during an evaluation, if nessary!

      Unfortunately, this is not uncommon.  Trouble is, we live in such a litigious society, it warps everything.  If DHS doesn't cover their a** in a VERY significant way, Mommy could sue them.  The moral of my story is, if you're thinking about suing somebody, save a kid and don't do it.

      a ciggerette burn on top of her right wrist. and bite marks from her younger brother and unexplained bruses

      we don't want to sue we want his daughter to be out of harms way and to be in a safe clean loving environment

      Sorry, if I thought for one second my children were in an abusive situation I would not stand idle! I would have to be restrained. But I would have to know it was intentional abuse for a fact.

      you should get a lawyer and not a court appointed one either..

  find some other things that make her an unfit mother and go for guardianship.. or possibly talk the mother into guardianship too many stories now a days about mothers killing their kids.. dont need another one, for sure!  |
