LONGWOOD, Fla. - A 12-year-old was arrested and facing misdemeanor battery charges after pinching a boy's butt in school.

The incident was reported at Milwee Middle School on Ronald Reagan Boulevard in Longwood two weeks ago in between classes.

Breana Evans, 12, told News 6 pinching someone's butt and laughing at their reaction is a game that a lot of people play at the school and that she thought it was a joke.

"I regret it because I didn't know it would lead to this," Evans told News 6. "I feel like it's just stupid just a stupid charge that shouldn't have to happen."

According to the report, after the initial incident, the boy told the school resource deputy he didn't want to press charges and Evans was suspended. Evans said she didn't know the boy

But last week, the boy's mother got involved, calling deputies and saying that she wanted to prosecute Evans for battery.

"Lord lord lordy what has this world come to -- kids can't even be a kid and that's basically what it is -- she's 12 years old she was acting like a 12 year old child," said Evans' father, Ray.

Ray Evans said he thinks it's an overreaction from the mother of the boy who wanted to press charges.

"I'm sorry my kid touched your kid but I'm sorry -- because you need some help I think, too overprotective -- let your kid be your kid he might get some friends and that's all i have to say," Ray Evans said.

News 6 contacted the boy's mother, but has not heard back.

Evans was booked into juvenile detention. The Seminole County state attorney told News 6 if Breana Evans completes the diversion program and does the community service, the classes and passes all the drug tests, the charge will be dismissed and her record would be clean.

Even though I feel this could have been handled different. I do not feel that the whole story is being told.. Why would a 12 year old girl pinch anyone on the butt they did not even know.. She admits she did not know him.. Was this a dare to do to a kid that is being bullied???

Is this boy being bullied and picked on all the time by other kids?

Just think that there is more to this for the mother to feel like she has to make a example on this case....

No one not a child nor a adult should just go up to someone and pinch them on the butt...What if it was you it happen to, out in public by someone you don't know???

Would you just shrug it off or feel like someone just invaded your space??

What?!?! Oh no! I forgot schools were supposed to be safe havens to make sure kids never grew up and remained as young and carefree for as long as possible.

For a minute I thought they were learning centers for educational purposes...like learning how to stop acting like a child where there are no consequences.
Better stop teaching them that if they do their work, they get graded. If they do a good job, on time, show their work, don't cheat, they get a better grade.
Can't have that.
Gotta avoid consequences to things. Teaching them good things have good consequences and bad things have bad consequences, well screw that...let them be kids dammit!

I'm just waiting for the "I let my kid pinch my butt all the time! It's no big deal! Even I go around pinching the butts of random children!" justification.

It states very clearly this is something that a lot of the kids are doing to others at the school.. Sounds like the group of kids doing this is doing it to kids that are not within their circle...

Humm so guess if the boy had went up to the girl and pinched some girl he was not even friends with or knew, it would have been a different story. At 12 these kids know better if not then they will learn the hard way...

To me, they are just 12 yrs olds, being 12 yr. olds.
She had consequences for her actions. Having criminal charges pressed against her, is probably over doing it.

In any event. She is being made an example of as a deterrent to curb the behavior of the other kids.
If is win win for the school, the press & the politically correct.
Let's face it. If they charged a boy we wouldn't even had heard about it.
And they could of charged one already.

Actually in the news story I read it said as long as she completes the community service ect that all will be taken off her record... It basically is to teach her a lesson and her friends..Which I'm sure the boy that his mom took it a step farther will only be bullied more...

As I said earlier I feel that it should have been handled different.. But regardless at 12 she knew better then to go pinch the boys butt seems to me her little group thinks they can do as they please to others and pass it off on a joke...

I'm sure the kids that they are bullying does not think it is just fun or the boy would have never reported it.. They do that and go off laughing on the reactions they get from the kids they do that to..

I was noshing on a juicy cheeseburger on my lunch break the other day when I came across a fascinating story in the Washington Post written by Eugene Volokh.

The story involves a New Jersey sixth-grader who ran afoul of the state’s Anti-Bullying Bill of Rights Act after he poked fun at a vegetarian classmate. (For you folks on the professional barbecue circuit, a vegetarian is someone who abstains from pork butts.)

“Vegetarians are idiots,” the youngster declared. “It’s not good not to eat meat.”

The 11-year-old, identified in court documents as C.C., went on to tell K.S. (the vegetarian) that “he should eat meat because he’d be smarter and have bigger brains.”

The vegetarian child reported the incident to officials at Lower Middle School in Montgomery Township.

At that point, the school’s anti-bullying specialist launched an investigation to determine if the meat-lover had “committed an act of harassment, intimidation or bullying.”

By the way – Montgomery Township employs ten anti-bullying specialists. Ten.

The school district’s investigation determined the youngster’s anti-vegetarian comments “were reasonably perceived as being motivated by a distinguishing characteristic between the two boys, namely vegetarianism, which substantially interfered with the rights of K.S. and had the effect of insulting or demeaning him.”

Instead of being forced to eat tofu or fermented soy, the child was slapped with five lunch time detentions.

Volokh, who also teaches free speech law at UCLA School of Law, weighed in – calling the punishment “modest.”

“Once the law calls such speech ‘harassment,’ ‘intimidation’ or ‘bullying’ in one area, it’s easy for these labels to be applied in other areas as well, especially because the labels are so ill-defined and potentially so broad,” he wrote.

The 2014 vegetarian smack down landed in the lap of an administrative judge after the local board of education affirmed the school’s findings.

On March 7, an administrative judge also upheld the local school’s handling of the matter.

This is what our nation’s public school system looks like, folks.

Are students no longer allowed to opine on the virtues of pork chops or chicken-fried steak?

Are those who dine on butter beans and rutabagas so feeble they can’t handle some good-natured ribbing?

And why does a school district need to employ 10 anti-bullying specialists? Do unkind comments made by an 11-year-old really rise to the level of an official investigation?

I will concede that vegetarians are not idiots. Perhaps unfortunate would be a better description.

But based on my reading of the events in New Jersey – the only idiots are the township’s anti-bullying specialists.
