Montgomery County judge sets hearing on request to dismiss Bill Cosby charges Published: Thursday, January 14, 2016 By Carl Hessler Jr. chessler@21st-centurymedia.com NORRISTOWN >> Entertainer Bill Cosby’s preliminary hearing on charges he allegedly sexually assaulted a woman in his Cheltenham home has been postponed a second time so a judge can consider a defense request to dismiss the charges. Montgomery County Administrative Judge Steven T. O’Neill issued an order on Wednesday setting Feb. 2 as the date a Common Pleas Court judge will hear arguments on requests made by Cosby’s defense team to dismiss the charges and to disqualify District Attorney Kevin R. Steele from handling the Cosby prosecution. Cosby’s preliminary hearing had been set for Feb. 2, but now has been postponed and a new date will be set later. It’s the second time that Cosby’s preliminary hearing has been rescheduled. The preliminary hearing originally had been scheduled for Jan. 14 before District Court Judge Elizabeth McHugh but was later rescheduled to Feb. 2 in order to give defense lawyers more time to prepare. On Tuesday, Cosby’s lawyers filed court papers arguing the sexual assault charges should be dismissed against Cosby because current prosecutors intentionally breached a 2005 agreement that specified Cosby would never be charged. Defense lawyers Brian J. McMonagle and Monique Pressley also want the newly-elected Steele disqualified from the case, accusing him of injecting the Cosby allegations into his recent political campaign. McMonagle and Pressley contend Steele repeatedly violated ethical rules by injecting the Cosby case into his fall election bid “that served no purpose other than to advance Mr. Steele’s political ambitions by inflaming the public against Mr. Cosby.” Steele has said the defense requests have “no merit.” Judge O’Neill, in his one-page order on Wednesday, gave prosecutors 14 days to file a written response to the defense requests in preparation for the Feb. 2 hearing. William Henry Cosby Jr., as his name appears on charging documents, faces three felony counts of aggravated indecent assault in connection with the alleged sexual assault of former Temple University athletic department employee Andrea Constand at his home in the 8200 block of New Second Street in Cheltenham between mid-January and mid-February 2004. The charges were lodged against Cosby, 78, on Dec. 30, before the 12-year statute of limitations to file charges expired. The newspaper does not normally identify victims of sex crimes without their consent but is using Constand’s name because she has identified herself publicly. If convicted of the charges at trial, Cosby, an entertainment icon who remains free on 10 percent of $1 million bail, faces a possible maximum sentence of 15 to 30 years in prison. The alleged assault took place in Cosby’s Cheltenham home. Constand, then 30, according to court documents, was invited by Cosby to his home to discuss her career. Over the course of the evening, Constand allegedly told Cosby she felt “drained” because she had been missing sleep. In response, Cosby allegedly gave the victim three blue pills, saying, “these will make you feel good,” and telling her they were herbal, according to the arrest affidavit. Constand, who also allegedly was provided wine by Cosby, reported feeling odd after taking the pills, with blurred vision and unsteady legs. She told police that Cosby proceeded to sexually assault her on a couch in the home. The victim did not report the incident to authorities until January 2005 after returning to her home in Canada. The investigation initially was undertaken by former District Attorney Bruce L. Castor Jr., who in February 2005 determined there was insufficient evidence to prosecute Cosby, who claimed the alleged contact was consensual. Current prosecutors reopened the investigation last July after Cosby’s deposition connected to a 2005 civil suit Constand filed against him was unsealed by a judge. In that deposition, Cosby gave damaging testimony, allegedly admitting he obtained quaaludes to give to women with whom he wanted to have sex. Bad news for Bill Cosby. As if he needed more bad news.
A judge has shot down the scandal-plagued comedian’s attempt to appeal a ruling in his criminal case, according to court papers obtained by TheWrap. Cosby was charged with aggravated indecent assault in December. The charges stem from accusations made by former Temple University employee Andrea Constand, who claims Cosby drugged and sexually assaulted her in his Pennsylvania home in 2004. After former Montgomery County (Pa.) district attorney Bruce Castor declined to pursue criminal charges, Constand filed suit against Cosby in 2005, later settling with him. Earlier this month, Cosby’s legal team argued that either the case should be tossed, or that Montgomery County District Attorney Kevin Steele — who made the Cosby case a prominent part of his campaign for office last year — should be removed from the case. Lawyers for Cosby contended that there was an agreement with Castor that the comedian wouldn’t be prosecuted. Judge Steven T. O’Neill shot down that argument, and late last week Cosby filed notice that he was appealing the case. O’Neill again put the brakes on Cosby in an order issued Tuesday, noting that his previous Feb. 4 orders “do not involve controlling questions of law as to which there is substantial ground for difference of opinion, and (2) an immediate appeal from these orders would not materially advance the ultimate termination of the matter, therefore, it is hereby ordered and decreed that the motion is denied.” Cosby has been accused of rape or sexual assault by dozens of women, many of whom claim he drugged them beforehand. Numerous lawsuits have been filed against the comedian. Cosby has denied the allegations, and in some cases sued his accusers for defamation. |

The deposition, believed to be the first she has given since dozens of women came forward to accuse him of sex assault, was given under heavy security at the Springfield Marriott. Hotel staff cordoned off the area of the hotel near the conference room where Cosby gave her deposition and later pulled heavy draperies across the hallway so no one could see the door to the room. Depositions in civil cases are typically given in private, with only the people being deposed, their lawyers and a stenographer in the room. Written transcripts of depositions are generally sealed from public view because they are considered discovery materials shared between lawyers on both sides. But depositions can sometimes become public when they are attached to support a motion in the case. Camille, 71, has been married to Bill for 52 years. She has also been his business manager. After numerous women went public with sexual assault allegations against her husband, Camille Cosby issued a supportive statement, calling him “a kind man, a generous man, a funny man, and a wonderful husband, father and friend.” “He is the man you thought you knew,” she said in December 2014. She also suggested that her husband, not the women, was the party being harmed. “None of us will ever want to be in the position of attacking a victim,” she said. “But the question should be asked –– who is the victim?” Lawyers for the Cosbys have argued that she does not have any information on the accuracy of the women’s claims and that her conversations with her husband are confidential under the Massachusetts marital disqualification rule. They attempted to quash the deposition. A judge had ruled Friday that Camille Cosby’s deposition must proceed. However, defense lawyers filed an emergency motion late Saturday requesting it be delayed, saying she “has had no involvement with the facts or allegations underlying this case.” They argued her public testimony would create “an unnecessary media circus and personal security threat that serves no purpose other than to harass and embarrass her.” In a ruling late Sunday, a judge said Monday’s deposition can take place. The Cosbys have a home in Shelburne Falls, about an hour’s drive from Springfield, where the lawsuit was filed. They have five children, one of them deceased. A lawyer for the women argued that because Camille Cosby has been the TV star’s wife and business manager, she could have useful information. The plaintiffs in the Massachusetts defamation case are among about 50 who have accused Bill Cosby of sexual misconduct. But only for 'criminal'. So yes, she must testify, by court order for 'disclosure'. She is there because of her husband being charged with defamation. ( calling lots of women liers, etc) But..she does NOT have to reveal or repeat ANY conversations she had with her husband. But she is ordered say what she knows. Examples: had lots of affairs, gave lots of women money etc. Problem is.. Once information is out, it is out & it WILL be used against him. |

I don't think Camille Cosby will be of any help in this case. This classy intelligent woman is reduced to a vacuous entity anytime she sits next to her husband for an interview. She is a textbook study in cognitive dissonance. I feel almost as sorry for her as I feel for the rape victims.The whole thing is depressing on so many levels :(

Hi Peggy It'easy to feel sorry for her but consider that she was his manager and most likely was making all the accommodation arrangements while on the road back then. There's no way she didn't notice something over the years. Then consider that Bill was prescribed these drugs by a gynecologist, I bet they shared the same gynecologist? No, I think this lady knew about her husbands penchant for unconscious victims, for her sake, I hope none of those scripts were to her name for example. See Bill didn't take drugs or hardly drank for that matter. I hold very little hope for any convictions in this case except for defamation maybe but they're both guilty... her being an accessory to the fact IMO. |
