IRS: So Our Computer Crashed And Erased All Of Lois Lerner’s Emails



The Internal Revenue Service (IRS) claimed Friday that it cannot produce Lois Lerner’s emails to and from the White House and other administration departments due to a supposed computer crash.

The IRS previously agreed to hand over all of the ex-IRS official’s emails from 2009 to 2011 to the House Ways and Means Committee, chaired by Rep. Dave Camp. But the IRS claimed Friday that it has Lerner’s emails to and from other IRS officials but it cannot produce emails to and from the Treasury and Justice Departments, the Federal Election Commission, or Democratic offices.

The IRS’ computer crash may go down in history next to the eighteen and a half minute gap in the Watergate tapes, which was supposedly caused by a mistake by Richard Nixon’s secretary Rose Mary Woods.


“The fact that I am just learning about this, over a year into the investigation, is completely unacceptable and now calls into question the credibility of the IRS’s response to Congressional inquiries,” Camp said in a statement. “There needs to be an immediate investigation and forensic audit by Department of Justice as well as the Inspector General.”

“Just a short time ago, Commissioner Koskinen promised to produce all Lerner documents,” Camp continued. “It appears now that was an empty promise. Frankly, these are the critical years of the targeting of conservative groups that could explain who knew what when, and what, if any, coordination there was between agencies. Instead, because of this loss of documents, we are conveniently left to believe that Lois Lerner acted alone. This failure of the IRS requires the White House, which promised to get to the bottom of this, to do an Administration-wide search and production of any emails to or from Lois Lerner. The Administration has repeatedly referred us back to the IRS for production of materials. It is clear that is wholly insufficient when it comes to determining the full scope of the violation of taxpayer rights.”

The Internal Revenue Service (IRS) said it can't provide emails sent between 2009 and 2011 that were requested by congressional investigators because of hard drive crashes.

The agency said that emails stored on dead drives were lost forever because its email backup tapes were recycled every six months, and employees were responsible for keeping their own long-term archives.

The IRS had a contract with email backup service vendor Sonasoft starting in 2005, according to FedSpending.org, which lists the contract as being for "automatic data processing services." Sonasoft's motto is "email archiving done right," and the company lists the IRS as a customer.

Lois Lerner....what a bum. Yeah, Obama sure had to twist her arm big time to get her to attack fellow citizens from the other party. Not to mention....you do not get to tell your side then plead the fifth. That's not how it works. Last thought....they can't keep a hold of emails....because they threw out several supposedly crashed computers.....but we trust them to keep our healthcare information protected??? Gads!

If you think missing emails are so rare, then how do you explain the missing emails in nearly every investigation that the Bush Administration was ever involved in? Think Cheney ever turned over all the emails subpoenaed from him? Nope. They just went missing. The man had a half dozen closet-sized safes for storing the printed emails (and other files) but they couldn't be bothered to turn everything over for the waterboarding investigation.

But now Con's cannot imagine a single hard drive failure in a government agency for which they're tripping over themselves to cut the budget. Surprise.

If you think missing emails are so rare, then how do you explain the missing emails in nearly every investigation that the Bush Administration was ever involved in? Whereas, fairness and Due Process demand that the American taxpayer be granted no less latitude than we afford the bureaucrats employed presently at the IRS;

Now, therefore, be it resolved that it is the sense of the House of Representatives that unless and until the Internal Revenue Service produces all documentation demanded by subpoena or otherwise by the House of Representatives, or produces an excuse that passes the red face test,

All taxpayers shall be given the benefit of the doubt when not producing critical documentation, so long as the taxpayer's excuse therefore falls into one of the following categories:

1. The dog ate my tax receipts
2. Convenient, unexplained, miscellaneous computer malfunction
3. Traded documents for five terrorists
4. Burned for warmth while lost in the Yukon
5. Left on table in Hillary's Book Room
6. Received water damage in the trunk of Ted Kennedy's car
7. Forgot in gun case sold to Mexican drug lords
8. Forced to recycle by municipal Green Czar
9. Was short on toilet paper while camping
10. At this point, what difference does it make?

The crashed hard drive was reported way before the investigation ever started. This isn't a simple 'dog ate the homework' thing. It's a fishing expedition conflicting with technological reality.

The retrieved emails are a result of cross-matching emails sent/retrieved from other drives. For example, if I send you an email and my computer subsequent gets destroyed, you would probably still have that same email. Since the emails sought for the investigation were those sent around the Government, then other government machines (also being subpoenaed) often have those emails. Have you ever forwarded or replied to an email? It's very common to include the previous message in-line on the same message, including time, date and names.

Can you please try to keep up?

How many investigations were made into the Bush Administration? And how many for Cheney? A half dozen closet-sized safes for storing the printed emails (and other files)? Never heard of those please enlighten us with more of you astute wisdom.

Get to the core of the issue:

Conservatives are angry about the IRS close scrutiny of some political groups 501(c)(4) status.

IRS 501(c)(4) generally requires civic organizations described in that section to be "operated exclusively for the promotion of social welfare".

Treasury regulations interpretion is that the organization "is operated PRIMARILY for the purpose of bringing about civic betterments and social improvements". As a result, the IRS traditionally has permitted organizations described in IRC 501(c)(4) to engage in lobbying and political campaign activities IF those activities are NOT the organization's PRIMARY ACTIVITY.

My question is, why are we not ANGRY that many of these political groups are TAX EXEMPT?

The primary reason many of them exist is for political purposes.

We really need to get all the money out of political campaigns.
