Kelly..the problem with "allowing states to determine marriage standards" is that each state would have different standards...a couple "married" in New hampshire would not be considered married in Florida if they moved there.Hence it would create a never ending legal battle in the courts. Its better that it becomes a federal law rather then state by state.

Well congratulations, you agree with Bill Clinton and John Kerry. :)

As to your premise about the advisibility of states' right to regulate marriage trumping the federal government's fiat, even as we speak the age of consent (with / without parental consent below certain ages in some states) varies quite a bit. There's even more variation for the legality of Common Law marriages. Yet, that's never been an issue-- it's always been pretty much "If the state you were from says it's legal, it's okay with us".

The country hasn't self-destructed yet because of that, has it?

Besides, would you _really_ want to see the Federal Government issue marriage licenses?

No, I suspect the real issue is closer to the rhyme one of the Supremes used during hearing the Lawrence vs. Texas case about the two gay men having their door kicked down and arrested under the then sodomy statutes in Texas:

Roll Call, citing the report, said Sgt. Dave Karsnia made the arrest after an encounter in which he was seated in a stall next to a stall occupied by Craig. Karsnia described Craig tapping his foot, which Karsnia said he “recognized as a signal used by persons wishing to engage in lewd conduct.”


Ok, not to get off the subject of all the good posts in this thread, but WTF?? Did Craig just start tap dancing in his stall or something? Did the authorities ever stop to consider that he might have urinary touretts syndrome, a condition that causes him to tap his foot whenever he pees?

Baygal...I agree...could be listening to IPOD...but I guess from what I heard he was looking through stall, putting hand under too...who knows....doesn't really matter though, with all the other violent crime out there its crazy to make such a big issue about thislaugh

Yes, Scalia's dissenting opinion did have elements of Chicken Little in it, but no, Justice Breyer actually said that and it flummoxed the lawyer representing the State of Texas. Even Clarence Thomas dissented for a different reason than Scalia, citing state's rights instead of Borking Up the issue.

Hey, BayAreaGalflowerforyou ,

You mentioned the foot-tapping earlier. According to reports, the signal is when you tap your foot ON the foot of the person in the next stall. Hard to do that by accident. You have to really TRY to tap the foot os someone in the next stall.

As an Idaho girl...I gotta say. Senator Craig has done some very positive thing for our State. But this has not been the first report of him possibly trying to get some "male tail" on the side. I think if he were representing any other state it would not have been made into such a large issue. Idaho is a very conservative state that elects very conservative people to represent it. This year Idaho just voted to outlaw same sex marraige in our state FOREVER!!

I do not agree w/ it but it is just how it went down....doesn't look good to have your Senator not following the "practice what you preach" standards....and blatently get caught!

i think it would have no matter what. celebrities and politicians are always held under a microscope. i don't think the issue here is that he may like men but that he votes one way and lives another. being in the closet doesn't compare to being a hypocrit.
