The PA has been hard at work of late lining up votes in the UNGA for the recognition of the state of Palestine with pre ’67 borders with the eastern part of Jerusalem as its capital.

They intend to use the “Uniting for Peace” procedure to avoid a possible UNSC veto regardless of whether the procedure is legal. (See; The UN Charter Cannot Support GA Resolution 377). Were they to get such recognition the repercussions would be significant.

Alan Baker, who was legal counsel for Israel in the drafting of the Oslo Accords and is currently associated with the Jerusalem Center of Public Affairs, recently wrote:

“Such unilateral action outside the negotiation process would constitute a fundamental breach of the 1995 Israeli-Palestinian Interim Agreement, thereby releasing Israel from its reciprocal commitments.”

“While such a resolution would not have the authority to alter the legal status of the territories, the negative consequences of such a course of action would nevertheless serve to void the very basis of the peace process. It would undermine the legal existence of the Palestinian Authority and violate commitments by Yasser Arafat to settle all issues by negotiation.

This would go so far as to release Israel from the confines of UNSC Res 242. How so?

According to the Palestine Mandate passed in 1922, Great Britain, the Mandatory power, had the following obligation with respect to all of that part of Palestine lying west of the Jordan River.:

“The Administration of Palestine, while ensuring that the rights and position of other sections of the population are not prejudiced, shall facilitate Jewish immigration under suitable conditions and shall encourage, in co-operation with the Jewish agency. referred to in Article 4, close settlement by Jews, on the land, including State lands and waste lands not required for public purposes.”

The Plan of Partition (Res 181) passed by the UNGA in 1947, though it violated this provision, was accepted by the Jews and paved the way for the recognition of the state of Israel six months later. Had the Arabs accepted this resolution, they too would have had a state and that would have been the end to Jewish rights of close settlement in Judea and Samaria (West Bank). But they didn’t and so Jewish rights to same didn’t end.

So why isn’t The Government of Israel asserting those rights now?

The answer finds its origin in UNSC Res 242 passed in 1967 which authorized Israel to remain in occupation until she had secure and recognized borders. Israel’s acceptance of this resolution effectively waived Jewish Mandate rights in exchange for such borders. Israel obviously preferred such borders over exercising her rights of “close settlement” which would have necessitated managing the Arab population in these lands. Once again the Arabs rejected this resolution preferring instead “no negotiation, no recognition and no peace” as resolved in their Khartoum Conference in Sept 1967.

Notwithstanding this, Egypt broke ranks and made peace with Israel in 1979 as did Jordan in 1994.

In 1993 Rabin and Arafat signed the Declaration of Principles on the White House lawn, which aimed to

“establish a Palestinian Interim Self-Government Authority, the elected Council (the “Council”), for the Palestinian people in the West Bank and the Gaza Strip, for a transitional period not exceeding five years, leading to a permanent settlement based on Security Council Resolutions 242 and 338.”

As a pre-condition to this mutual declaration, Arafat delivered two letters to Rabin promising to amend the Charter of the PLO which called for the destruction of Israel and Rabin delivered a letter to Arafat confirming his intention to allow normalization of life in the territories. Arafat and the PLO never did amend their Charter. For that matter, Fatah and Hamas have similar provisions in their Charters even to this day.

This Declaration made no mention of a Palestinian state as the goal, nor did it call for a cessation of Israeli settlement activity.

In 1995, Israel and the Palestine Authority (PA) entered into an Interim Agreement which provided, inter alia, for the creation of the PA and for its exercise of power. It obligated both parties “to carry out confidence building measures as detailed herewith”. Those details involved Israel releasing prisoners in stages. No other confidence building measures were required. That never stopped the US from continually demanding that Israel offer more “confidence building measures”.

Article XXXI provided;

“Neither side shall initiate or take any step that will change the status of the West Bank and the Gaza Strip pending the outcome of the permanent status negotiations.”

“Nothing in this Agreement shall prejudice or preempt the outcome of the negotiations on the permanent status to be conducted pursuant to the DOP. Neither Party shall be deemed, by virtue of having entered into this Agreement, to have renounced or waived any of its existing rights, claims or positions.

Both of these agreements became know as the Oslo Accords.

As Baker points out, such a move by the PA would clearly be a fundamental breach of this provision. To my mind there have been numerous fundamental breaches by the PA which include their daily incitement, their Intifadas and their massive rocket attacks from Gaza. In these instances over the years, Israel chose not to declare the Oslo Accords null and void. But not this time. For example, Israel has mooted the idea of annexing part, if not all, of Judea and Samaria (West Bank), were it to happen.

It may be argued that if the Agreement is abrogated, that Israel’s Mandate rights still apply.

Likewise the Arab League has similarly rejected Res 242 in putting forth their initiative which was based on the armistice lines rather than “secure borders. By demanding 100% of Judea and Samaria, they are demanding that Israel retreat from all of the territories which is also contrary to the intent and meaning of the resolution.

Thus it would appear that not only will the Oslo Accords be no longer binding on Israel, neither will Res 242 because the Arabs have never accepted it.

The Obama Administration understands the risks of the UN granting recognition to the state of Palestine. Dennis Ross, speaking to the ADL recently on behalf of the US said,

“We have consistently made it clear that the way to produce a Palestinian state is through negotiations, not through unilateral declarations, not through going to the UN. Our position on that has been consistent in opposition.”

The Obama Administration would rather keep Israel shackled to the Oslo Accords while pressuring Israel to capitulate. In reality, the US has abandoned Res 242 and the Oslo Accords, de facto, by pressing Israel to accept security guarantees in place of secure borders and by pushing the Arab League Initiative. It is also pushing for the division of Jerusalem which is not required by the Oslo Accords.

It remains to be seen if the EU will follow the US lead on keeping Israel shackled. Angela Merkel during her recent meeting with PM Netanyahu said, “We are in favor of two states for two nations. It is not certain that unilateral recognition will contribute to promoting peace, and this will be our position in September.”

Regardless, the PA seems bent on following through with bid for UN membership. Some people think the recognition of the state of Palestine would be a disaster for Israel while others think not.

But at least, Israel will be free to act.

Israel will have no legal obligation to refrain from annexing Judea and Samaria in whole or in part. Her right to settle all of this land and to establish a national home on all of it for the Jews, which has been recognized by international law, will be legally unassailable.

Furthermore as conquerors of this land, pursuant to a defensive war, international law entitles her to keep it. When Israel conquered the land, no one had sovereignty over it including Jordan and the Arabs living there. In effect this war was a continuation of the ‘48 war. Thus it put an end to the Armistice Agreement and the armistice lines which the parties had agreed would not be the final borders in any event.

I had a conversation with Baker because I wanted him to reconcile the provision in the Interim Agreement calling for a settlement based on Res 242 and Article XXXI which provides “Neither Party shall be deemed, by virtue of having entered into this Agreement, to have renounced or waived any of its existing rights, claims or positions.” In my reading of these two clauses, I thought that the second was limited by the first.

He advised to the contrary, noting that Israel could assert any right she might have. I asked if that included our right to settle the land pursuant to the Mandate. He advised that the Mandate rights ended in the creation of Israel in 1948. I begged to differ, arguing that that would have been the case had the Arabs accepted a state on the rest at that time. But what do I know. He has been involved in this process for close to 20 years.

He did say that even if a state is declared, the PA will still have to negotiate borders and everything else so he isn’t fearful of such recognition. But the chances of reaching agreement after 25 years, are slim. A recent poll reported that 78% of Likudniks oppose the creation of a Palestinian state.

In the meantime, Israel should build as much as she wants and should extend Israeli law to all communities in Judea and Samaria in which her citizens live. Aside from providing housing for its citizens, it would put pressure on the Palestinians to compromise. If Israel were to continue with the de facto freeze, the Palestinians would have no incentive to make peace and could wait a hundred years while they build throughout Judea and Samaria and continue their campaign to demonize and deligitimate Israel.

Accordingly, Israel should welcome the recognition of a Palestinian state and the abrogation of the Oslo Accords.

THE COVENANT OF THE HAMAS - MAIN POINTS

The Covenant of the Islamic Resistance Movement was issued on August

18, 1988. The Islamic Resistance Movement, also known as the HAMAS,

is an extremist fundamentalist Islamic organization operating in the

territories under Israeli control. Its Covenant is a comprehensive

manifesto comprised of 36 separate articles, all of which promote the

basic HAMAS goal of destroying the State of Israel through Jihad

(Islamic Holy War). The following are excerpts of the HAMAS

Covenant:



Goals of the HAMAS:

'The Islamic Resistance Movement is a distinguished Palestinian

movement, whose allegiance is to Allah, and whose way of life is

Islam. It strives to raise the banner of Allah over every inch of

'Israel will exist and will continue to exist until Islam will

The Exclusive Moslem Nature of the Area:

consecrated for future Moslem generations until Judgment Day. No one

can renounce it or any part, or abandon it or any part of it.'

'Palestine is an Islamic land... Since this is the case, the

Liberation of Palestine is an individual duty for every Moslem

wherever he may be.' (Article 13)



The Call to Jihad:

'The day the enemies usurp part of Moslem land, Jihad becomes the

individual duty of every Moslem. In the face of the Jews' usurpation,

it is compulsory that the banner of Jihad be raised.' (Article 15)



'Ranks will close, fighters joining other fighters, and masses

everywhere in the Islamic world will come forward in response to the

call of duty, loudly proclaiming: 'Hail to Jihad!'. This cry will

reach the heavens and will go on being resounded until liberation is

Rejection of a Negotiated Peace Settlement:

'[Peace] initiatives, and so-called peaceful solutions and

international conferences are in contradiction to the principles of

the Islamic Resistance Movement... Those conferences are no more than

a means to appoint the infidels as arbitrators in the lands of

Islam... There is no solution for the Palestinian problem except by

Jihad. Initiatives, proposals and international conferences are but a

waste of time, an exercise in futility.' (Article 13)



Condemnation of the Israel-Egypt Peace Treaty:

'Egypt was, to a great extent, removed from the circle of struggle

[against Zionism] through the treacherous Camp David Agreement. The

Zionists are trying to draw other Arab countries into similar

agreements in order to bring them outside the circle of struggle.

...Leaving the circle of struggle against Zionism is high treason,

and cursed be he who perpetrates such an act.' (Article 32)



Anti-Semitic Incitement:

'The Day of Judgment will not come about until Moslems fight Jews and

rocks and trees will cry out: 'O Moslem, there is a Jew hiding behind

Role of the United Nations

The area designated as a Jewish state as over 75% desert; it had a population of 498,000 Jews and 325,000 Arabs. The proposed Arab state area had 807,000 Arab inhabitants and 10,000 Jewish inhabitants. The international trusteeship regime in Jerusalem would have a population of 100,000 Jews and 105,000 Arabs.

On November 29, 1947, the UN General Assembly, in its 128th plenary session, by a two-thirds vote (33 to 13 with Britain and nine others abstaining) passed Resolution 181 partitioning Palestine into two states, one Jewish and one Arab. The Jewish community of Palestine jubilantly accepted partition despite the small size and strategic vulnerability of the proposed state. Not only were the West Bank and Gaza Strip not included, but alsoJerusalem, most of the Galilee in the North and parts of the Negev desert in the South were excluded.

After the vote was announced, the six Arab delegations of Iraq, Syria, Lebanon, Egypt, Saudi Arabia, and Yemen stormed out threatening war and the annihilation of the Palestinian Jews. Pakistan’s delegation followed suit. The Arab national movement in Palestine, as well as all the Arab states, angrily rejected partition. They demanded the entire country for themselves and threatened to resist partition by force. Had they acceptedthe UN proposal in 1947, the independent Palestinian Arab state, covering an area much larger than Judea and Samaria (the West Bank) and Gaza, would have been created along with Israel. Instead, they rejected the plan and launched a war to destroy the nascent Jewish state.

Almost immediately there was Arab violence against the Jews in Palestine. Mordechai Palzur, the former chief of protocol at the Israeli Foreign Ministry, quotes a report published in Foreign Relations of the United States 1947 by Robert Macatee, consul general of Jerusalem:

* It is tragic that many of the present casualties comprise innocent and harmless people going about their daily business. They are picked off while riding in buses, walking along the streets and stray shots even find them while asleep in their beds. A Jewish woman, mother of five children, was shot in Jerusalem while hanging out clothes on the roof. The ambulance rushing her to the hospital was machine gunned and finally the mourners following her to the funeral were attacked and one of them was stabbed to death.

The Arabs were blunt in taking responsibility for starting the war. Jamal Husseini, the Arab Higher Committee’s spokesman, told the Security Council on April 16, 1948:

* The representative of the Jewish Agency told us yesterday that they were not the attackers, that the Arabs had begun the fighting. We did not deny this. We told the whole world that we were going to fight.

The British commander of Jordan’s Arab Legion, John Bagot Glubb admitted:

* Early in January, the first detachments of the Arab Liberation Army began to infiltrate into Palestine from Syria. Some came through Jordan and even through Amman . . . They were in reality to strike the first blow in the ruin of the Arabs of Palestine.

UNSCOP was prevented by Arab and British forces from doing a full investigation in Palestine. They reported to the Security Council on 16 February 1948:

* Organized efforts are being made by strong Arab elements inside and outside Palestine to prevent the implementation of the Assembly’s plan of partition and to thwart its objectives by threats and acts of violence, including armed incursions into Palestinian territory… This Commission now finds itself confronted with an attempt to defeat its purposes, and to nullify the resolution of the General Assembly.

Jerusalem became the scene of the bloodiest battles, in danger of destruction, which aroused international concern. On 6 May 1948, the Special Session of the General Assembly recommended that:

* … the Mandatory Power appoint, under Palestine legislation, before 15 May 1948, a neutral acceptable to both Arabs and Jews, as Special Municipal Commissioner, who shall, with the co-operation of the community committees already existing in Jerusalem, carry out the functions hitherto performed by the Municipal Commission. (General Assembly Resolution 187 (S.II).)

A Philadelphia attorney, Mr. Harold Evans, was appointed to the post, but he never set foot in Jerusalem. The General Assembly failed to decide on a Statute of Jerusalem, and turned down a proposal submitted at the decisive hour before the Mandate lapsed for a temporary trusteeship regime of the city.

The United States, the Soviet Union and most other member states of the United Nations immediately recognized Israel after it declared independence on May 14, 1948, and indicted the Arabs for their aggression. The United States urged a resolution charging the Arabs with breach of the peace. Soviet delegate Andrei Gromyko told the Security Council, May 29, 1948:

* This is not the first time that the Arab states, which organized the invasion of Palestine, have ignored a decision of the Security Council or of the General Assembly. The USSR delegation deems it essential that the council should state its opinion more clearly and more firmly with regard to this attitude of the Arab states toward decisions of the Security Council.

The initial phase of the fighting ended after the Security Council threatened July 15 to cite the Arab governments for aggression under the Charter. By this time, the Haganah had been renamed the Israel Defense Forces (IDF) and succeeded in stopping the Arab offensive.

During the summer of 1948, Count Folke Bernadotte was sent by the UN to Palestine to mediate a truce and try to negotiate a settlement. Bernadotte’s plan called for the Jewish State to relinquish the Negev and Jerusalem to Transjordan and to receive the western Galilee. This was similar to the boundaries that had been proposed prior to the partition vote, and had been rejected by all sides. Now, the proposal was being offered after the Arabs had gone to war to prevent partition and a Jewish state had been declared. The Jews and Arabs both rejected the plan. Bernadotte was assassinated by LEHI extremists in Jerusalem on September 17, 1948, an act that resulted in the elimination of the LEHI organization by mainstream Jewish leaders.

Although UN Resolution 181 is still sometimes cited when it is advantageous to the pro-Arab Palestinian position, the State of Israel has consistently maintained that the Partition Resolution became null and void when it was rejected by the Arab side in 1947.

As late as 1999, Resolution 181 was once again the focus of attention, more than 50 years after it was passed by the United Nations and rejected by the Arabs. The Palestinian Authority arranged for the United Nations Commission on Human Rights to pass a resolution calling for Palestinian self-determination only on the basis UN Resolution 181. This was a blatant attempt to rewrite all of the history of the years between 1947 and 1999 and it was swiftly denounced.

Ironically, the United Nations has been an anti-Israel institution since shortly after the UN was instrumental in the founding of the State of Israel. Unfortunately the UN was often subverted by a coalition of third-world countries, Soviet client states, pro-Arab and anti-Semitic forces who could use actions against Israel as a proxy for stabs against the United States and its democratic allies. After the collapse of the Soviet Union, this coalition was absorbed by the Middle Eastern forces seeking to destroy Israel. Today, the UN cannot be seen as a useful guide to world opinion or the moral course of action.



The United Nations will see it self in a new role this month as Palestine mounts a bid for membership in 2011.

A biker was riding by the zoo, when he saw a little girl leaning into the lion's cage. Suddenly, the lion grabbed her by the cuff of her jacket
and tried to pull her inside to slaughter her, under the eyes of her screaming parents.

The biker jumped off his bike, ran to the cage and hit the lion square on the nose with a powerful punch. Whimpering from the pain
the lion jumped back and let go of the girl. The biker then took her to her terrified parents, who thanked him endlessly.

A reporter saw the whole scene, and addressing the biker, said, 'Sir, this was the most gallant and brave thing I saw a man do in my whole life.'

'Why, it was nothing,' said the biker, really. The lion was behind bars. I just saw this little kid in danger, and acted as I felt right.'

'I noticed a patch on your jacket,' said the journalist.

'Yeah, I ride with an Israeli motorcycle club,' the biker replied.

'Well, I'll make sure this won't go unnoticed. I'm a journalist with the Post, you know, and tomorrow's papers will have this on the front page.'

The following morning the biker bought the paper to see if it indeed brought out the news of his actions. On the front page was the headline:

Time and Time again Israel ceases hostilities only to be attacked again.

Nobel Peace Prizes are handed out to the undeserving and war mongers!

And

Experts made the mess we all live in!

Now granted Israel's hands are not completely clean but they have far less blood on their hands than their neighbors do!

And all this time the money trail points to Iran and then back to England! So who is kidding who here?

It is British Global Banking that has been the worst of the serpents we need to box up and deal with properly! They could care less about standards as long as they are on top of the money pile!

There is stuff in space we have yet to come across and when we do we will not be prepared to face it when we need to fight to protect ourselves. I could care less what anyone else thinks and this is coming from someone far above average in intelligence, there are situations where muscle triumphs over mind but you cannot force your way though everything either.

Fighting is a necessary evil but we spend far too much time fighting with each other to face the facts we need to worry about far worst things in life like Overpopulation, destruction of our biosphere, rampant consumption of the world's resources, and many other issues that will pop up like when the next Super-volcano tosses us into a volcanic winter (like Nuclear winter) or we actually do spot a REALLY BIG rock heading our way from outer space.

Actually "legally" a nation does require a significant military plus weapons, that will fend off invaders, so "legally" you are correct.

But that does not mean that the people living there do not have any basic human rights. Right?

All you are really saying is that if you don't have a big enough gun to protect your home, that it is "legal" for any home invader to come in, and run you off or kill you, and take over your home and claim it as their own.

This world has made bullying and theft "legal."

Like i said. I believe in peace but likewise I am prepared to make war. The reason is far too man7y times in just my personal life I attempted diplomacy and likewise the whole turn the other cheek mentality and it only led to an escalation of violence against me until I let the beast loose.

Some people like dogs need to either be beaten into submission or flat out put down. I do not agree that in all cases Violence is the rule. But humans are creatures of extremes. Now comes a caviate to my belief. If I have to resort to beating someone down and they surrender I give them a chance BUT should I see any reason to believe treachery or in fact smell treachery i will do what I need to to prevent myself from getting a blade (or bullet) in the back.

Now for my approach to Islam: My preferred method, kill all the clerics, kill all those profiting from this mess, and show the people with education (and just the basics goes a long way, We don't need no Mind Control,. That is the Media's job (WhoooWAAAAA!)and stimulation of their economies as well as arming them to protect themselves from groups like the Taliban and Al Quieda. Stimulation does not mean hand outs. Stimulation means opening trade corridors for them.

A method that does work though is EDUCATION as long as you don't have politicians perverting it with bloated ideals of Tolerance. Likewise STAUNCH REFUSAL FOR ANY APPEASEMENTS AT ALL is a must! Education has been tearing away to the Christian faiths. Seriously, how can the murder of a man absolve me of my sins before god? I didn't ask for god or Jesus to act like that! God is one sick fuquer if that is his idea of love.

In fact the survivor is the one who kicks *** and is standing to talk about it the next day!

Not all Muslim people are bad. A good percentage of them are unaware of the lie they are believing like most Christians. ISLAM HOWEVER IS ONE OF THE MOST EVIL FAITHS AND IT MAKES SATANISM DOCILE IN COMPARISON!

What do you expect from a populace that knows nothing about the monetary system that made them debt slaves to the private international banking system that owns their country? They don't even know that their money is debt that they have to pay the interest on thru taxes.

Talk about a failure of the educational system...Wow! It almost looks like our banking lords deliberately conspired to not teach the monetary system in the schools, but that would be a conspiracy theory, wouldn't it.

selective ignorance is not only a choice of the sheep er, I mean masses vs. selective ignorance employed in schools. I still meet people who have a hard time grasping the idea of Evolution and that we are related to apes.
