The Obama administration announced last week that it would effectively halt any enforcement actions (on an alleged “case-by-case” basis) against any illegal alien who hasn’t committed any other serious crime.

After more than a year of denying that “stealth amnesty” was the official illegal immigration policy of the Obama administration, the Obama gang has finally fessed up. Illegal aliens will not be deported or pursued. Amnesty is here.

The Obama re-election campaign jumped into full operational mode with an announcement by Janet Napolitano, U.S. Department of Homeland Security (DHS) secretary, that illegal aliens in deportation proceedings — whether border-crossers or visa overstays — who have yet to commit an additional crime, will be allowed to remain in the United States and obtain work permits.…

Low-priority cases, which she believes waste enforcement resources, will be dismissed in defiance of existing U.S. immigration laws passed by Congress and signed into law by previous presidents.

So that’s it. After more than a year of denying that “stealth amnesty” was the official illegal immigration policy of the Obama administration, the Obama gang has finally fessed up. Illegal aliens will not be deported or pursued. Amnesty is here.

And don’t believe the Obama administration’s lies when it comes to illegal aliens with criminal records. We already know from documents we uncovered in July that Obama administration officials are actively considering the dismissal of charges against illegal alien criminals, even those convicted of violent crimes! (If you need anecdotal evidence, just look at how Janet Napolitano’s Department of Homeland Security (DHS) handled the case of the nun-killing illegal alien.)

As if that were not enough to get your blood boiling, JW now has even more evidence of the Obama administration’s contempt for the law and the U.S. Constitution. While Uncle Omar was busy endangering the public, our investigators were sifting through 2,600 pages of documents we uncovered from the Obama Department of Justice (DOJ) as a result of two Freedom of Information Act (FOIA) lawsuits. And look at what we found: The records detail an orchestrated campaign by the Obama administration to suspend deportation proceedings against “one of the DREAM [Act] kids” and other illegal aliens, even though Congress had not passed the legislation!

The DREAM Act would have permitted certain immigrant students who have grown up in the U.S. to apply for temporary legal status, eventually obtain permanent legal status, and become eligible for U.S. citizenship if they go to college or serve in the U.S. military. It could initially provide amnesty for over one million illegal immigrants and would have cost over $6 billion a year. Despite repeated attempts by liberal members of Congress and the Obama administration to push this legislation through, the DREAM Act has failed to garner enough votes.

But that didn’t stop the Obama administration from bulldozing forward anyway, creating and implementing law, all on the administration’s unconstitutional own initiative. The details:

In an April 20, 2010, email from Melissa Crow, former DHS Acting Deputy Assistant Secretary for Policy in the Office of Immigration and Border Security, to Roxana Bacon, Chief Counsel for the U.S. Citizenship and Immigration Services (USCIS), Crow states: “Since we met, I’ve done my best to encourage ICE to grant deferred action in the DREAM Act cases…brought to my attention.”

An email chain about “one of the DREAM [Act] kids” who was being detained by authorities suggests confusion at DHS regarding how to handle requests for “deferred action” from illegal alien students. In the email chain, ICE (U.S. Immigration and Customs Enforcement) Chief of Staff Suzanne Barr writes to DHS Deputy Press Secretary Matthew Chandler, “we r f’ed up,” to which Chandler responds, “Yep. And we wonder why pp’l FOIA us.” The student was granted a stay of removal for six months.

In response to a USA Today inquiry into whether aliens are required to carry identification, DHS General Counsel John R. Sandweg writes, “Ugh. Yes. Fed law does require aliens to carry their paperwork. I don’t know if it is a criminal offense, but this provision has gone relatively unnoticed by media and [redacted].…I think some groups of aliens are exempted from this requirement as they don’t really have paperwork (folks who were issued deferred action). Either way, it is not routinely enforced.”

In a memo from Mariela Melero, Chief of the Office of Public Engagement of U.S. Citizenship and Immigration Services (USCIS) to USCIS Director Alejandro Mayorkas, entitled “Stakeholder Input of Administrative Reforms,” Melero sets forth suggested reforms “outside of Comprehensive Immigration Reform,” which includes the opinion that the director – unless otherwise required by law – has the authority to judge if the evidence presented for deferred action is “probably true.” Another reform would allow a 501(c)(3) organization [such as Project Vote/ACORN, perhaps!] in “good standing…to design and implement voter registration programs at USCIS offices across the country.”

The Obama administration’s decision to suspend the deportations of most illegal aliens has been subject to intense scrutiny since 2010, when the press uncovered a United States Customs and Immigration Service (USCIS) memo that contemplated various “administrative alternatives” to bypass Congress and implement stealth amnesty for illegal aliens.

A subsequent Houston Chronicle story exposed an effort by the administration to suspend the deportations of illegal aliens who supposedly have not been convicted of any “serious” crimes. Documents uncovered by Judicial Watch show that DHS officials misled Congress and the public about the scope of the immigration enforcement policy change, which gave wide latitude to local immigration officials to dismiss illegal alien deportation cases.

And then came the Obama administration’s public announcement that, indeed, illegal aliens of “low priority” will no longer be deported. The administration denied that this was a blanket or categorical amnesty, but these new documents show otherwise.

The documents show that the Obama administration is obviously lying about its stealth amnesty activities and indicate an alarming contempt for Congress and the rule of law. Frankly, these documents show that Obama immigration officials don’t even know what the law is!

The Obama administration cannot simply pick and choose which federal immigration laws it will enforce. In its zeal to curry favor with the illegal alien lobby and secure Hispanic votes for a second term, the Obama administration is exercising raw executive power to change the law by granting illegal aliens amnesty in a way that strikes at the heart of our constitutional system and the rule of law. This is a festering constitutional crisis on which we will keep you updated.

So why are me and my girlfriend worrying so much about her getting a student Visa? Shouldn't she just save her money and come here on an ESTA and just stay as long as she wants to? lol

but If it becomes some type of amnesty program that allows some immigrants in front of the line of those following the law to get in,, it makes two policies so far that Im not the happiest with from the administration...

I was seen celibrateing in a mexican restaraunt last evening I was drinking Dos Equis beer and eating salsa and chips I had a burrito durrango my girlfriend and daughter both had the chicken taco supreme a good time was had by all.

I enjoyed the good service I recieved from the Latino staff and allways get treated well being I am a 20% tipper.

It was a celibration of the taste buds.

I wish they would do something about illegal immigration.

I don't live anywhere even remotely close to the Mexican border or the Caribbean, and yet illegal aliens are rampant in my area. They drive cars with out of state plates past 90 days without getting pulled over. A DMV worker was arrested for selling fake driver's licenses and Social Security numbers. A landlord was charged with harboring illegal aliens after 20 of them were found hiding from INS agents in a basement of the house they were "renting". Most of the immigrants are brought by plant nurseries from all over the East Coast. Many of them come on work visas, but refuse to leave when the visa expires. They always wants to be paid under-the-table to avoid a paper trail. They drive unregistered vehicles, and do not carry insurance. They pay no incomes taxes, FICA, or Medicare. They are ghosts in the system, and they are taking away jobs in the industry I work.

Yes, I have worked with them which is how I know about them. Many of them don't even speak English. Some want me to help them learn the language. I've even had a co-worker deported while on the job....because he was a high-ranking gang member from Columbia who was trying to lay low after something went down in Hartford.

Not only that, but because they work cheaper, they are lowering the average wage a restauranteur is willing to pay his help. Some of the people that are being affected had to shell out $60,000+ for a culinary education in the hopes it would translate into a higher wage. Instead, they are lucky to make only a couple dollars more per hour than someone with less training or experience. If it wasn't for required schooling and licensing for many trades up here, the illegals would be pursuing jobs in those fields as well, as they have in other areas of the country. Instead, they generally stick to sheetrocking and painting. A few have tried becoming handymen, but CT requires licensing for that too, so most don't last.

Connecticut is a job poor state. It once thrived on manufacturing, especially defense contracting, in addition to being the home of Stanley Tools and Colt Firearms. Now most of the manufacturing is gone. Defense contracts are smaller and less frequent. Stanley Tools has shrunk, and Colt Firearms is gone. Even the insurance companies that once made Hartford their home have repeatedly cut back jobs. People ages 25 to 35 are leaving the state in record numbers, primarily in search of well-paying jobs. We don't need excuses like "[illegal immigrants] are filling the jobs nobody wants" (as George W. Bush put it). What we need is jobs for those who were born, raised, and stayed here. Some of those jobs have traditionally been second jobs for people trying to support a family. Now those flexible schedule part-time jobs are disappearing. This is going to become an increasing problem throughout the country so long as nothing is done to stem the flow.

Perhaps it is time to stop focusing on just the border, but start focusing on enforcing visa expirations.

so, I propose this

,,,people come here for WORK, and Employers hire based on profit margins,,,,take away the motivation and you take away the numbers coming illegally for work


When employers are caught hiring undocumented workers, they should be required to do three things

1) pay whatever wages were promised to the worker for work completed as well as expenses for the worker to return to their home country
2) pay whatever wages they pay the worker to the government in a penalty fee/tax, or whatever you want to call it
3) register on an immigration offender list(like sex offenders do)for potential consumers to review in whatever area they live or are thinking about living

...This does three things,,

1) it takes away the employers incentive to pay half or less of what a job is worth because they will in the end pay the whole price anyway if caught

2) it takes away the employers incentive to hire people strictly because they can get away with paying them half, thus increasing the odds that they will go ahead and hire people above board and legally for fair wages

3) it stigmatizes the employer publicly so that they risk actually losing business and profit from consumers who find out they are involved in such practices


the immigrant would also be placed on an illegal entry list and have an extra penalty fee added to whatever costs they incur during their LEGAL immigration process,,,

By law, in most jobs, it is illegal to ask for identification or age verification when hiring an employee. This means the employer is legally barred from asking an immigrant to produce a green card. There are exception clauses, some of which apply to the restaurant business. For example, a server/bartender is required to be 18 years old in order to serve alcohol, and minors are not allowed to handle knives.

So, in many cases, the law actually prevents businesses from screening out illegal aliens during the hiring process. It's a Catch-22: if you ask for an ID or refuse to hire an illegal alien based on a "hunch", you may be violating the law. The latter falls under discrimination laws, primarily due to ethnicity.

When I have a legal question, I often look up statutes, and read them several times to make sure I understand the wording. In a state like CT, nearly any law can be looked up on the web through a government website. If that's not enough, the local library has a complete up-to-date set of the books of statutes. Between the two, anyone can research the laws around here, but most don't, not even the business laws.

I don't think this information is accurate. Each state has their own child labor laws that make it illegal to hire under a certain age so age verification would be too necessary to be 'illegal'.

i'm not real sure where you got your information, but i know that here, at least, my employees must fill out an I-9 before beginning work. while this document doesn't specifically account for age, it's for the purpose of identity.

i've hired many an illegal over the years, but all of them had proper legal documentation. it's NOT an employer's job to ensure that the documentation isn't fake.

If the government would just enforce the laws on the books, there wouldn't be an illegal problem.

The Democrats see them as potential voters and want them in.

The Republicans see them as cheap labor and want them in.

Both parties fear any Hispanic backlash for offending them or Hispanics in general.

The "official line" that they don't take jobs from citizens is just a big lie. I see plumbers, electricians, painters, masons, and just about every other trade hiring illegals here.

this is not quite true, there is no law that all americans agree on but that has never been a factor on whether it is enforced as law

its not even as personal as not wanting 'them' here ,its a matter of wanting the laws enforced for everyone and not just ignored for some,,,,

there are people who dont want them here and people who are indifferent, and employers who would prefer to hire those they dont have to be financially or legally held to fair standards for

if the immigration laws as they are would be enforced , there would be less of a problem, and fewer here illegally

nothing is gonna stop EVERYONE , anymore than laws against stealing stop there from being THIEVES,, but we would see fewer numbers if we started to show that we will actually ENFORCE laws for those who are caught breaking them

I was speaking about laws and ways to enforce laws that would discourage and lower the numbers of illegal immigrants.

laws are pretty useless when it comes to immigration in my opinion.

They need to pass a law that states if an employer hires an illegal knowing they have bogus ID's that employer MUST go to prison for 4 years, straight time! This is may bode very well for filthy democrats come November now that the illegal population will be registered democraps.

That's the problem though. State laws will not allow an employer to ask a prospective employee for identification unless the job falls under the exception clause, and a photo ID is required to fill out the I-9.

In the restaurant business, paying help under-the-table means that no I-9 ever gets filled out anyway. They're off-the-books. No paper trail, or both sides can be penalized. Same thing in lawn care and landscaping, which a lot of people are involved in around here.

However, there are other jobs, like in the home healthcare business, where many immigrants, both legal and illegal, seek jobs. Such work does not fall under the exception clause within the state law, and so employers are barred from asking for an ID. Hence, the only way for a prospective employee to fill-out an I-9 is if they volunteer the proper papers such as a visa, green card, driver's license, etc.

So why create a state law which obstructs pursuance of federal law? It doesn't make sense even though the intent is to prevent job discrimination, and is thereby linked to federal discrimination laws by the structure of the law. It's a mess - one that a judge will likely have to rule on to provide clarification.
