A $5 million federal suit filed by Sean McGinn accuses the company of fraud and deception for failing to tell subscribers some of their "matches" aren't active on the site. McGinn, 37, said vulnerable romantics pour out their hearts in e-mails and then are crushed when they don't hear back. "They are left feeling they've been completely ignored and rejected," attorney Norah Hart said. "For some people, it could affect their romantic future." On May 30, subscriber "ajsky65" sent an e-mail to a former female subscriber called "traehi" and was informed that she was online, the lawsuit says. Over several weeks, "traehi" received 33 e-mails and hundreds of so-called "winks" from subscribers but could not access them, the lawsuit claims. "Match misleads paying subscribers by charging them for the ability to write e-mails to members who can't reply to their e-mails or even read them," the lawsuit charges. Hart, who is hoping to turn the suit into a class action, would not say whether McGinn has found true love. |

Wonder if Dr. Phil will have these people on his show to talk about it...he was involved with Match at one time, and may still be... This is true of many paid sites, if you pay you can email and do other things, where the people who do not pay, cannot. This will be big lawsuit if it goes forward!! |

It'll never go forward. The guy has no case. He's a putz! He took a chance just like anybody else who (foolishly) signed up at a paid site. From what I understand, at the end of the day, he DID wind up with a ladyfriend, so his so-called "lawsuit" is bunk.

stranger lawsuits have been won! and whatever he is, he found a lawyer to file this case for him....and to do that, there would have to be adequate cause to file it, or the attorney can be in trouble for filing the case in the first place. It will depend on exactly how the wording is/was in the TOU and blah blah blah.... interesting... (dang, I wish I would have thought of this!! ) |

A world-wide dating website, Match.com, is being sued by a New York area man for deceptive marketing practices. New York general litigation attorneys representing the plaintiff accused Match of misleading customers with dating prospects who are not actually, paid members of the Internet dating service. The Brooklyn man claims he was humiliated and disappointed due to unresponsive profiles on Match.com, as reported by Reuters. The plaintiff, Sean McGinn of Brooklyn, filed the lawsuit against the dating giant, Match.com, htttp://www.match.com, on Tuesday. According to New York Federal Court reports, McGinn claims members of the dating Internet website suffer rejection when attempts are made to contact a prospective date and the inquiry remains unanswered. This lack of response leaves members with the sense of humiliation and disappointment. The lawsuit cites Match.com profiles do not clearly state whether or not the prospective single has a current paying subscription, which is inflicting anxiety, fear of rejection, and further defrauds the consumer of their time and emotional investment. McGinn alleges Match.com’s business practices are deceptive and his suit requestes unspecified damages. Match.com, owned by IAC/InterActiveCorp, which has a membership following of more than 100 million people since 2000, states the lawsuit lacks merit. Attorneys representing the social media giant assert they will defend the allegations vigorously. According to the dating service, profiles can be made without any charge to the person. Through this profile, prospective members can search the databases for singles and prospective dates, but will be unable to contact anyone or respond to any messages without paying a fee to join the service. It is clearly stated on the website that looking around, and creating a profile is free to everyone, but you have to hold a paying membership to email, wink, and “enjoy all that Match.com has to offer”. So, that's his beef. He's pissed off that he didn't have his dream girl fall into his lap just because he signed up on the site, so he's gonna try to sue them. I'm sorry, but he's a moron. I've said it a million times before, sites like these are NOT "The Boyfriend/Girlfriend Store". Too many people fall into that trap of thinking that just because they sign up onto some website, that it's just gonna "happen". It doesn't work like that in real life, so why should online be any different? People never cease to amaze me. |

![]() Good thing I found somebody here just before I was going to go try Match. I'd sure hate to go wasting all my time writing e mails only to be "crushed" when they don't come back with a response. I don't really think it's a great idea to 'pour one's heart out' in the first e mail anyhow. |
