Mother & son fail to show up at hearing for refusing chemo

Minn. judge: Teen medically neglected' by parents, must see doctor

New Ulm, Minn -- 13-year-old Daniel Hauser and his mother were no shows at a Brown County courtroom Tuesday and the boy's father says he doesn't know where they are.

A judge set the court hearing to reveal the results of a court ordered chest X-ray to look at a cancerous tumor.

A doctor who administered the X-ray says he told Daniel and his mother yesterday the tumor had increased significanly in size and the cancer has spread. The doctor suggested the family make a hospital appointment immediately, but they said "no" and left.

Daniel's father, Anthony Hauser, testified in court today. He told the judge he had not seen or heard from his wife, or his son since yesterday and he has no idea where they are.

Daniel has vowed to resist chemotherapy by punching or kicking anyone who tries to force it on him.

The Hausers stopped chemotherapy after one treatment and opted for "alternative medicines," citing religious reasons.

Daniel's mother, Colleen Hauser, testified at an earlier hearing that her son "is not in any medical danger."

She said she had been treating his cancer with vitamins, herbal supplements, and other natural alternatives.

This prompted Brown County authorities to intervene.

The cancer is regarded as highly curable with chemotherapy and radiation, but likely fatal without it.

Daniel has a lawyer specifically representing him. His lawyer says his client is in danger and is recommending the county take custody.

Does it talk about a boy that can't read or write and will die from cancer if he doesn't get chemotherapy and if he gets it, there's over a 90% survival rate? What about that boy!!


Winx - I'm not picking on you - I know you have a big heart like many others here. But it's important that everyone NOT be taken in by statistics.

First of all - that 90% rate you speak of is not accross the board. For example, the cancer institute, the lymphomia society, the .gov website and a few others, have percentages ranging from 74% to that 90% and all are based on a "5-year" survival ratio.

Again the percentages differ for the 10 year ratio and they are lower. Often those who have died are said to have died from something other than the lymphoma they were treated for. What they rarely tell you is that they died of complications, some consider, related to the CURE.

A study I ran accross a while back indicated that those who survive beyond 5 years and into the 10 year range are more likely to develop other cancers. Many scientists believe this is related to the treatments as the prevalence for later cancers is so much higher in those who have already undergone other cancer treatments.

Finally, when you hear that 86 to 90% are "cured" - you must not only remember that is a "5 year" survival quote only, but you must also look further because there are numerous side-effects of the treatments that many will suffer from for the rest of their days.

Knowing all this, does anyone really want to have this decision in their hands? I don't. I'm sorry for the boy and his family, but I believe the boy has the best chance to survive, the best chance for quality of life, if that life is left in the hands of his parents.

yep my brother-in-law died from it and the chemo made the time he did have miserable

changed his personality

so many think well it is a way to live longer (i ask at what cost to your quality of life)

so he lives what 5-6 years maybe 10 but he is sickly and cant eat and is in bed the majority of that time

it is a shame that busy bodies are taking away what time he could be enjoying with his family away

they should be charged with something

what gives anyone the right to over rule the constitution

don't forget to go get your flu shot this fall (after all if you don't you could get a warrant out for your arrest) [just hope it is not an experimental drug they want to try on people]


be careful what you say should happen here cause the erosion of one blade of grass weakens the hillside and soon it will become a mudslide

Arrest ordered for mom of boy, 13, resisting chemo

NEW ULM, Minn. – Authorities nationwide were on the lookout Wednesday for a mother and her 13-year-old cancer-stricken son who fled after refusing the chemotherapy that doctors say could save the boy's life.

Colleen Hauser and her son, Daniel, who has Hodgkin's lymphoma, apparently left their southern Minnesota home sometime after a doctor's appointment and court-ordered X-ray on Monday showed his tumor had grown.

Brown County District Judge John Rodenberg, who had ruled last week that Daniel's parents were medically neglecting him, issued an arrest warrant Tuesday for Colleen Hauser and ruled her in contempt of court. Rodenberg also ordered that Daniel be placed in foster care and immediately evaluated by a cancer specialist for treatment.

The family belongs to a religious group that believes in "natural" healing methods. Daniel has testified he believed chemotherapy would kill him and told the judge that if anyone tried to force him to take it, "I'd fight it. I'd punch them and I'd kick them."

The boy's father, Anthony Hauser, testified he didn't know where his wife and son were but had made no attempt to find them. He testified he last saw his son Monday morning, and he saw his wife only briefly that evening when she said she was leaving "for a time."

As of Wednesday morning, the mother and son still had not been found, said Carl Rolloff, a sheriff's dispatcher.

Officials distributed the arrest warrant nationwide. Brown County Sheriff Rich Hoffman said Tuesday that investigators were following some leads locally, but declined to elaborate.

"It's absolutely crazy. It's very disappointing," James Olson, the attorney representing Brown County Family Services. "We're trying to do what's right for this young man."

A message left at the Hauser home in Sleepy Eye early Wednesday wasn't immediately returned. But in an interview in Wednesday's editions of the Star Tribune of Minneapolis, Anthony Hauser said he knew places where his wife might have gone though he did not know where she was.

He said he and his wife had a plan for Tuesday's hearing and he was a "bit disappointed" she didn't follow it. "We were going to present a treatment plan to the court. If they didn't go with it, we would appeal it," he told the newspaper.

"I know many people around here who have had cancer, they did the chemo, it would come back," Hauser told the newspaper. "They did the chemo again and again and they are all in the grave. Chemo isn't foolproof."

Daniel's Hodgkin's lymphoma is considered highly curable with chemotherapy and radiation, but the boy quit chemo after a single treatment.

The judge has said Daniel, who has a learning disability and cannot read, did not understand the risks and benefits of chemotherapy and didn't believe he was ill.

The Hausers are Roman Catholic and also believe in the "do no harm" philosophy of the Nemenhah Band, a Missouri-based religious group that believes in natural healing methods advocated by some American Indians. Colleen Hauser testified earlier that she had been treating his cancer with herbal supplements, vitamins, ionized water and other natural alternatives.

The founder of Nemenhah, Philip Cloudpiler Landis, said it was a bad idea for Colleen Hauser to flee with her son.

"She should have gone to court," Landis said. "It's how we work these things out. You don't solve anything by disregarding the order of the judge."

Anthony Hauser now agrees that Daniel needs to be taken back to a doctor for re-evaluation for the best treatment, said Calvin Johnson, an attorney for the parents.

The family's doctor, James Joyce, testified by telephone that he examined Daniel on Monday, and that an X-ray showed his tumor had grown to the size it was when he was first diagnosed.

"He had basically gotten back all the trouble he had in January," the doctor said.

Joyce testified that he offered to make appointments for Daniel with oncologists, but the Hausers declined. He also said he tried to give Daniel more information about lymphoma but the boy, his mother and lawyer Susan Daya left in a rush.

"Under Susan Daya's urging, they indicated they had other places to go," Joyce said.

Daya did not immediately respond to a call Tuesday from The Associated Press. The court also tried to reach her during the hearing, but got no answer.

Daniel's lymphoma was diagnosed in January, and six rounds of chemotherapy were recommended.

Minnesota statutes require parents to provide necessary medical care for a child, Rodenberg wrote. The statutes say alternative and complementary health care methods aren't enough.

I understand what you're saying. What I've read in the past reading pediatric Hodgkins looks very optimistic. I do understand the long term issues that could happen with chemo and children.

As a parent I'm saddened that she's not giving her son the best chance of survival that she can.

you are permitted to be saddened as is anyone

but no one should be permitted to force them to go against their beliefs

the misinformation is from the medical field

my sister lived through it

and her husband suffered greatly for that couple of extra years

the families rights are being violated no doubt about it

The boy was informed that chemo would kill him.

Can you not grasp that the parents in this case, might be fanatics? I'll make that more clear, the Mom might be as the Dad has said that the child should be evaluated again...

Forcing medical care is against one's or one's family's inalienable rights.

Protecting their right to choose to deny what is recommended by doctors, is protecting everyone's rights to their own life matters.

Why is this so hard to understand?

My father went through several rounds of chemo... In the end, it was a long and miserable way to die. Nothing is garaunteed.

Think of it this way, it is not just about saving the life of the boy, after all, if it was mandated, almost all of us could be garaunteed a much longer life on machines.

Let them choose, because it is not negatively affecting anyone else's health. It is their decision to make, not the government's.
