Yes..I know...why state the obvious? Well in this case this guy may escape trial and that's a problem.

Make note the KKK Imperial Wizard's son is too stupid to stand trial for murder with his dad according to a judge. Behold, the master race!!

Humm good thing this guy isn't on trial in Texas where they execute....well everyone they can it seems whether they or even their lawyers understand the law.

Looks like a way to let this guy walk to me. People with limited legal understanding and even those who are "mildly mentally retarded" are tried all over the place. Especially by law and order types.

A state judge today found an alleged Ku Klux Klan member incompetent to stand trial for obstruction of justice in connection with the killing of a Oklahoma woman who tried to back out of a Klan initiation ceremony in a remote part of St. Tammany Parish.

State Judge Reginald "Reggie" Badeaux ordered Shane Foster, 21, to get tutoring in the St. Tammany Parish Jail for the next 90 days by a court-appointed forensic coordinator with the hope that it would "restore" Foster's competency and make him ready for trial.

Dr. Michelle Garriga, who was appointed by the court to examine Foster and did so on March 16, testified on the stand today that Foster does "not have a factual understanding" of the law or its procedures.

She said he has "cognitive deficits," "an ignorance of legal understanding," and that he is "mildly mentally retarded or a little above that."

Garriga, who works in Eastern Louisiana Mental Health System's forensic division, said Foster does not understand the role of judges, attorneys, jurors or defendants; does not comprehend the difference between guilt and innocence, and is not aware of his legal rights.

He is the son of Raymond "Chuck" Foster, the alleged imperial wizard of a Bogalusa Klan group who is facing second-degree murder in the shooting death of Cynthia Lynch in a remote area of St. Tammany Parish on Nov. 9, after she reportedly had told him that she wanted to go home.

While his father is not scheduled for a hearing until May 18, today two other alleged Klan members, Frank Stafford and Danielle Jones, also appeared for hearings in front of Badeaux.
Stafford also is facing an obstruction of justice charge, while Jones is facing accessory after the fact.

Nothing further happened in Stafford's case, but Jones' bond was reduced from $300,000 to $25,000, an amount her attorney said her family could afford.

Badeaux agreed to the bond reduction because the initial bond had been set when Jones was facing an obstruction of justice charge. The grand jury instead decided to charge her with accessory after the fact, allegedly for giving authorities false information immediately after the murder.

The obstruction of justice charges carry a maximum of 40 years in prison, while with the accessory after the fact charge, Jones is now only facing a maximum of five years.

I do not support racism, bigotry, or any other form of discrimination. Disclaimer out of the way, I have to make an observation....


It's interesting to me how hypocritical viewpoints can be. Had this been a downtrodden minority who had killed someone of a "better social standing", I'm willing to bet that mental competency and lack of ability to stand trial would have been argued in the killer's favor. After all, how could he/she help it? The environment the child was raised in, the constant abuse, yadda yadda, would all have contributed to their inability to tell right from wrong, to make sound decisions, etc.

Yet, if the killer is someone who has a viewpoint that goes against the moral beliefs of the reader, well then it's obviously a ploy to get out of a prison stint. This person couldn't possibly have legitimate mental issues, right?

I realize that the insanity/temporary insanity plea is used to death in the legal system. However, a person's beliefs should NEVER impact their right to utilize the defense, especially if it happens to be legitimate.

that is different from morally wrong. I don't agree with the KKK...but like i have said before...they are entitled to their beliefs like everyone else is. as long as no laws are broken (not in this case) then everyone is entitled to their beliefs. My understanding is someone has to be mentally competent to stand trial....even texas. correct me if i am wrong

My observation on this is that alot of criminals are "mentally incompetent" regardless to the motivators (in this case hate)

Think about it this way. The criminal mind thinks differently from the average person to begin with, right? They have all the criminal attributes, entitlement (not the same as the racists use for justifying welfare demeaning but similar at obscure levels), lack of conscience, anti social behaviors, etc.... All that signify compromised mental processes.

The technicality of it in court is really a joke as most criminals are mentally incompetent to begin with.

I defend people's right to say whatever they want, that doesn't mean i respect the person saying it nor does it mean i respect their opinion. I think bigotry of any type is ignorance at its most basic level. I was merely using this case as a way of communicating those views. If the person in question is truly mentally impaired to a degree that makes him unable to be held legally accountable for his crimes then so be it. thats the law. but that says nothing of the others involved in the crime and THEIR role in allowing this mentally incompetent person to participate.

There were several KKK members in the government, less than 10-20 years ago. Today, Robert Byrd, West Virginia senator, he is a former KKK. So was David Duke, grand wizard, Louisiana Representative and in the 30s and 40s several members of the US Supreme Court.

Think about it this way. The criminal mind thinks differently from the average person to begin with, right? They have all the criminal attributes, entitlement (not the same as the racists use for justifying welfare demeaning but similar at obscure levels), lack of conscience, anti social behaviors, etc.... All that signify compromised mental processes.

The technicality of it in court is really a joke as most criminals are mentally incompetent to begin with.




Let us not attack all people, just because on this very narrow subject the law seems to be having a correct view, but an incorrect action, still. This little case does not mean that we can make a blanket statement that anyone who is a criminal is mentally incompetent.

It may be stupid to be racist, but it is not not bad. The law should not prohibit private parties from any discrimination by race, since such action is ridiculous, unneeded, and tyrannical itself. Obviously, the government should be strictly prohibited from discriminating.

As for the criminals, a lot of them are very smart people. They have "chosen" to be criminals, because they were given no choice to not be a criminal.

For instance, if you prohibit ownership of Abrams tanks by private citizens (to which you have no right by the constitution), then you make a person have that tank illegally, i.e. criminally.

If you collect taxes based on the never properly ratified 16th amendment, then you force some people to withdraw from robbery by hiding their assets.

If you ban drugs from being the subject of the business transactions, you have just forced millions to do in in the back market.
