Man hoping to get fired and collect unemployment allegedly trashes eatery
The Associated Press ~ 7:43 PM EST, February 13, 2009 MADISON, Wis. - A restaurant worker was accused of trashing the place in an attempt to get fired and collect unemployment compensation. A criminal complaint filed Thursday said a 35-year-old man showed up at a Qdoba restaurant and started throwing brownies and cookies on the floor. The man then went into the kitchen and threw pots and pans around, then went into a storage area and threw boxes of hot sauce on the floor. dont think you can collect unemployment if you get fired either. i think its just if they let you go

For unemployment You can collect if fired. There is a penalty period depending on y you were terminated. Ranging from 10 weeks to I believe 20 weeks. There is also a clause in their that says if you were fired for being malicious then you are not able to collect.

Actually, you can collect unemployment if your are fired, sure, it takes 3 - 4 months and a telephonic hearing, and provided they don't dispute the claim..but it is possible.
He can still collect food stamps in the meantime, well.. until the unemployment kicks in, then he'll be making too much money and the food stamps get turned off. So, either way he still walks away with something. even if his actions were wrong. And the rest of us are still paying to support him now matter what they decided to do with him. |

If this is true, it is crazy. If you no show you can get fired. I know I got sick when I worked for Nextel and after three days they fired me for being sick.
I guess he can have my unemployment benefits, every time I left a job I never filed for benefits so that will balance it out. |

None of that is true in Illinois...at least I don't think so. I was fired once from a company I'd been with for 8 years. I filed for unemployment online giving a brief description of the reason I was let go, and my claim was accepted, no questions asked and no waiting period.
I also recently filed for unemployment from a company I quit after a year and a half, again..brief description of why I left, no further questions..no waiting period. Edit: I should probably state that both times I filed, it was not due to an type of infraction of company policy or anything..the first was a health issue and it was basically a mutual agreement for me to leave the company, the second was pretty much also mutual as my personal situation changed and scheduling was an issue..management handled the situation poorly and knew I had justification if they fought my claim. |

Depends on whether the company contests it. If you were terminated for cause they will often contest it and you may not be able to collect or may have to delay collection.
