Topic: A Question Of "Legality"...

In another thread, someting my friend Alziemer said got me to thinking... Is there a descending order when it comes to legality? Should ALL "illegal" offenses be punnished ALL the time?

We are all aware of certain obscure laws that are still on the books... Everything from spitting on the sidewalk to sodomy... Should ALL laws be abided by...just because they're on the books? Who here has NEVER broken a law?

The laws you speak of simply need to be removed. Of course, that might require a little effort from the politicians.

Some laws are stupid to me but they are the law when you let one pass why not another one. I have broken the law often some stupid ones and some very good ones. I ain't proud of it but like all people I'm not perfect.

I can be bad when the right lady requests it, but I'm not bad naturally.

Doubt anyone can say they have never broken a law since there are few who know most of them. I just hope the scales of justice are tempered with mercy. That is why mandatory sentenceing makes me nervous.

here in new orleans (under still existing napolianic law)...spitting on the sidewalk is still punishable by beheading on the square at dusk...that seems a bit excessive to me.

If all offenses should be punished all the time is not the real question. It's WILL you?

I got arrested (in LA) for beating a guy after discovering that he slapped my 4 year old nephew in the face so hard it left his handprint in a bruised welt. I probably did over-do it a bit but he kept getting up. Had heart..gotta give him that. ( A guy told me a long time ago "too much heart can be detrimental to your health") Got arrested, went peacefully, didn't lie about it. Paid the bondsman. Went to court. Jury let me go after deliberating 31 minutes.

SHOULD we get arrested for everything? No. WILL we? Probably. But you're still gonna miss that day of work and pay the bondsman no matter how it goes.

I personally think that the cops should have taken me to jail for that. And I expected to do a little time even before I did the crime. I considered it beforehand, as I do most things.

But I also think that if I want to sit in my house and smoke a joint rather than gelinate my liver with alcohol to relax, they should leave me alone.

As society changes so should the laws. It does require effort from law makers and citizens to get them removed if they are no longer applicable.

If you were questioning the gray areas of guilt, yes, there are gray areas. It can be confusing as to the punishment of someone who is starving and shop lifts some lunchmeat to feed their family for example. Are they wrong, sure, but the reason for the infraction is a valid one. It is an adult's responsibility to feed their family.

But the question here is how far does it go. If someone kills the man who raped his 8 year old daughter what is the perception of his guilt? Do we understand this man? Sure we do. Is he guilty? Sure. But should he be in jail all his life or face the death penalty because of this crime?

I always tell people the black and white of right and wrong is not so clear when dealing with humanity.
