I was going to the store to get cat food and going to get me lunch at Runza or Wendy's.
The lights were flashing. I had yellow. She had red. I was going straight through in the inside left lane. She was making a right turn. She stopped, and then went through, making a wide turn so she could turn into my lane. The cops didn't issue a citation, from the sound of it. I guess because the lights weren't on the normal red and green setting. I had the right of way and even if she had at least turned into the right lane like one is legally supposed to do, my car wouldn't be crunched and my knee wouldn't be killing me. And now I just realized I have to go back out to my car to get the paperwork to call her insurance company. I should have just stayed home. But I was going stir crazy, up since 5:30, and really wanting to get out of the house. |

I feel you Baby. Kind of like my brother-in-law pistol whipping his own brother across the face on christmas day (about 15 hits...I ended up taking him to the sheriffs dept to turn himself in then bailed him out after stitching him up and setting the broken arm)....accidents just seem to happen.

Oh, my front passenger side corner is screwed. I got it home, but I don't really think it is all that drivable right now.

A person can preach and preach how someone is supposed to turn into their nearest closest lane when turning onto a multi-lane road, and THEN make any proper lane changes from there, yet I constantly see people deliberately failing to do this. To top it off, they're the ones who will try to claim innocence when that accident occurs.
You'd think if a person attended Driver's Education class, they would've actually learned something (gee, where have I heard something similar to this before?). |

Get a reputable attorney. Ticket or no, the insurance adjuster(s) have the power to make practically any decision they want. Get medical attention (not EMT ER stuff only) and never say you're okay until time passes. Yes, accidents do just happen.

Ouch! I wouldn't worry so much about the car, that can be fixed. I wouldn't settle though, until you are sure that your knee will be ok. I know it's an inconvenience, but better to be safe than sorry.

I didn't do anything honey!...just dealt with the aftermath...I think this holiday sucked for just about everyone that I know. I would have been thrilled to settle for a car wreck...(my family owns a paint and body shop) |

Yes, her insurance should be responsible for the damages to the car and to you, but to seek punitive damages like some are suggesting is just shallow and rediculous.

Exactly, and it's been my experience and from seeing others go through the same thing, that if a citation is not given, the insurance company will only pay for their customer's damages. The only other way to get them to pay is to sue them. |

Exactly, and it's been my experience and from seeing others go through the same thing, that if a citation is not given, the insurance company will only pay for their customer's damages. The only other way to get them to pay is to sue them. It depends on how hard you push. There is also go away money. But in this case, I think I can push. I've learned a bit since I started working for an insurance company. Not a lot. I just set up claims for the examiners to handle. But I've learned enough to not let them bully me. |
