I hate to be the lone female on the other side of this but I agree with Isaac. I would never let my PMS make me emotionally unstable at work, well not if I wanted to keep my job anyway. I actually agree as well. Losing your cool and blaming PMS just doesn't cut it. I can understand being mad because someone took a picture without permission, but there are other ways to handle it... especially if you work with customers and have to remain professional towards them. |

It honestly sounds like you had something else on your mind(besides pms, i don't buy that) and you took it on your customer...i would have fired you too. At work you HAVE to seperate your feelings from the work place(as hard as that is to do) Excuse me I would have been fine IF the b*tch did not take my picture. And you try being a woman just for one month and tell me how your hormones are during that time OK? I have four sisters...only one acted differently when she was "pmsing" and she was naturally b!tchy anyway. and she has even ADMITTED that she used it as an excuse more often than not. I'm just being honest...i know you're looking for sympathy but I'm looking at it through the eyes of the boss as well. If i came out and seen one of my employees screaming at a customer(regardless of the reason) i would have fired them too... There is a level of professionalism that i'd expect my employees to have..that's all i'm saying whether they pissed you off or not. I wasn't judging you...I was merely stating the fact that your boss had every reason to fire you. That is all. I know it's not what you want to hear. But it is the truth. Maybe it's just cause I'm a woman and more sensitive to this but didn't you realize that her point of the post was to vent. She didn't ask if she was right or wrong or for you opinion in that matter. She recognized it was her fault but her purpose was to vent. Here's a life lesson for you: when a woman is venting be supportive. If we were asking for your opinion there would have been a question... was I wrong? But there wasn't. I think reading carefully before opening mouth and inserting foot would be a good way to go. |

Whether she took your picture, called you a name, or anything else i would expect an employee to maintain a professional demeanor, and if they were unable to do that then i would have fired them as well...maybe i'm a$$hole but you can't have a decent reputation of service if one of your employees is yelling at a customer, it doesn't only effect that one customer it sets a tone for the place in general if there are other customers around. |

Privacy Law
The unwritten industry standard for commercial photography dictates that any identifiable person in a photograph should sign a model release. However, in Ontario, the Privacy Act does not protect it's citizens against unwanted commercial use of their image (see Ontario's Privacy Act below). Other provinces may have provisions in their Privacy Acts (or similar regulations or statutes) for allowing a person to control their image, likeness, voice, and other attributes, which does apply to photography. For Quebec, see Quebec's Human Rights Code, for Saskatchewan, see Saskatchewan's Privacy Act. Regardless of province, you may photograph and publish a photo of anyone, with the exception of young offenders, who are newsworthy, doing newsworthy things, or are public figures or celebrities. But she was NOT a reporter, I was NOT a public figure OR a celebrity. So she had NO right to take that picture. |

Whisper, don't take it lying down, they can't fire you like that unless in their employee manual they state it's their policy as well as your state laws which have to equal or exceed federal law.... You are setup pretty well for a lawsuit, especially if they are over 50 employees... The state matters too but 50 + employees automatically sets Federal into place.... I agree though, definitely check and see if the woman had to ask permission first. it's not only that.. I mean I don't know Canadian law but I do US and Cali... You cannot just fire someone.. If you live in an at will state then you fire them for not reason, if you give a reason then they sue you and you have to prove your reason... Proof takes paperwork and write-ups... But as I said, no clue about Canadian law... I can ask some people that I employ and see if they know... Hmm... Whisper, is there any documentation that your supervisor could point to as a precedence for "unprofessional" behavior or temperament? Employee evaluations, maybe? What about property rights? She wasn't on the street, she was inside, right? |

Was it 'commercial' photography though? private photography(for photos not being published) have their own set of laws. |
