crap, there is laws for evading responsiblity.... why hadn't anyone told me about this earlier.... maybe rule #1 is not to tell anyone the rules!

very funny peeps!! Unfortunatly I have a court date on Monday 7/7 for hitting a curb and not stopping.... can they charge me with evading?? I didn't do any damage!

If you are thinking of not showing for court...you will have a bench warrant if you evade this one.

it depends on the circumstances.....were you fleeing??? drunk??? just a bad driver???? trying to run over your EX??? all of these scenarios can lead to multilpe charges....... details please.

Here in Alabama(as I'm sure else where in the state, of US)...if you have a ticket/summons to appear in court...and you don't show up...then a "bench warrant" would be issued for your arrest...and an additional charge of "Failure To Appear". Then you would have 2 issue to answer to. Best bet, in my opinion(having been a police officer)is to appear as instructed. JMO

Well thats just part of it, I was charged with a DUI after leaving the bar, i only had 3 drinks in three hours! I didn't know the area very well and looked down for a second and hit a curb. Because I didn't do any damage I kept driving. They pulled me over and arrested me, charging me with evading and a DUI....... heres the catch the legal limit in CT is .08 I was .085.... they also didn't read me my rights til after I got to the station..... I just wanted to find out if they can charge me with evading since I did no damage....

If you left after hitting the curb, yes they can. My advice: get an attorney.

I believe that it would be at the arresting officer's discretion as to whether or not you appeared to not want to stop. That would depend on the distance you continued to drive away...after the lights/siren were turned on...with out stopping.

I just wanted to find out if they can charge me with evading since I did no damage.... get an attorney now!!!!!! they dont need to read you your rights until you are charged. how long was it from the stop til they drew blood??? this will affect your bac. a good attorney will get this reduced to careless driving and the other charges dissmissed....JMO
