I JUST GOT INFORMED THAT THE MOTORHOME THAT I REPOSSESED HAS BEEN IN AN
ACCIDENT DOWN IN SOUTH DAKOTA. THE MOTORHOME HAD APPARENTLY BEEN
INSPECTED A YEAR AGO.BUT THE BRAKES FAILED.THE MOTORHOME GOT BROADSIDED
BARELY ANY DAMAGE TO IT. THE LADY THAT WAS IN THE MOTORHOME GOT A BROKEN
NOSE.THE GUY I SOLD IT TO(THROUGH ME MY DAD SOLD IT ON PAYMENTS.) WOULD
NOT LIKE TO PAY THE $1800.00cad.BUT A LOT LESS. MY QUESTION IS HOW DO I
TELL A STUBBORN JACKA$$ THIS NEWS? PLEASE GIVE ME GOOD ADVICE. NO I
DON'T WANT TO AVOID TELLING MY DAD. HE PUT ME IN CHARGE OF REPOSSESING
THE MOTORHOME.

Just a couple of questions, sorry, Did this stubborn jacka$$ have a
binding contract signed before he got in the crash? If so he is required
by law to still pay the agreed upon amount that is in the contract. Was
the motorhome inspected and was it sold as is... he therefor has no
loophole under the lemon laws. If you were going to repossess it he may
be liable for repairs needed to restore it to the original condition
minus normal wear and tear and depreciation or his insurance may be. You
may have to take him to small claims courtin order for you to get your
money.

Sorry, re read your post and realized that I got it wrong, the car was
in a crash before you got ahold of it. (My only excuse is that I had a
long day at work.) You want 1800 for it, he wants to pay you less. I
capish, how low are you willing to sell it to him for? Do you have any
other interested buyers?

you made a deal and a deal is a deal, so if they don't pay you got to do
what you got to do,,but give them time to think about it not 2 much time
but talk to the man, communication is always good.. and if it does not
work, don't say a word and get you veh..
you talk only to get things worked out and if it doen't
don't talk and do!! because it can lead on to trouble
and another thing, don't go alone, go with someone, and remember the
other persons feelings..just do what you most!!

no i repo'ed it before i sold it on my dad's behalf. and yes it states
"sold as is. where is how is. no warrantees or guarantees." i have more
than likely sold 34,979 vehicles in the last 16 years than most dealers
do in 5 years.

who was at fault in th wreck???
it is their insurance that should pay for it...

if th motorhome was not insurred,
th new buyer is liable for all repairs...
if it was sold as is...

but he is realy having a hard time telling the man to give him back the

Well if your in the process of fixing to repo it you dont tell them if
they have had ever chance to pay for it and are not you just go repo it
duhhh But if you have been in the business of selling vechicles should
you already know all the laws in your state and it also all depends what
the contract says if you had one drawn up and who's name the motorhome
is in at the time. If for some reason it is already in his name
completely whole new ball game your up the creek without a paddle he
will report it stolen if you repo it so with out the whole story hard to
say lol

ok square 1: motorhome was not paid for.
2.i repossessed it and sold it on my dad's behalf for the sum of
$1,800.00 on payments of $100.00 for 6 months then for the last 6 months
$200.00.
3 "sold as is where is how is. no warrantees or guarantees."
4 buyer had it inspected and it passed.
5 buyer was in accident. buyer wants to only pay a fraction of
$1,800.00.

did you have a contract drawn up on the payments and what was agreed
that he would pay and did he sign it and whose name is on the title of
the motorhome right now?

joe if you are in the business of selling cars then you should know all
the laws in your city/state. The laws are gonna vary from state to state
so why ask advice here. Take him to court and go from there.

when the motorhome is back in westlock alberta canada i just might tell
the guy that there is no room for lowering the price.and tell my dad
that i will buy it off him just to keep him happy.if it was not a friend
who is a pastor i would have said "too bad" and hung up.

I would not lower the price at all matter of fact I would tel him to get
the damages fixed too hope ya'll had all that in a contract.
