Sorry to stick my nose in this, but I have several female friends that have been through the same thing and this is what we've talked about.

How is that? If what you mean is he doesn't pay support he doesn't get to see he than be careful with that. Just because he doesn't pay CS doesn't mean he doesn't have a right to see her. And that may get you into trouble - if he's a... well you know..

My advice is to take him to court. It's in your best interest.

For one, it defines the custody. If you never have defined it, that really means he can 'take' her without ramification. I.e. pick her up from school and take her.

For another you can solve these CS issues. He probably still wouldn't pay and you'd still be in the same spot. But then you've got him by the short and curlies. And you can continue to take him to court AND you'd have the backing of your state's Child Support Enforcement Agency.

I know this seems like "what the use" but I'd say this to anyone in the same situation. He is preying upon the idea that you won't resist.
