btw..this is a weird different situation...this wasnt actually supposed to be a "hook up" thing...it happened after the fact, he was awesome at first then like he got comfortable and all hell broke loose....hard to explain

I'm sure it is, like a good salesman he got his foot in the door and just bogarted his way in. Not sure how long you have been in this situation, but first seek legal advice. If that doesnt work, lets get a family reunion going (get it)
