A federal judge has ordered Wisconsin to pay for the gender reassignment surgery for two transgender Medicaid recipients. Cody Flack, 30, and Sara Ann Makenzie, 41, filed a lawsuit in April, saying a state rule denying coverage for surgeries to treat gender dysphoria violates the Affordable Care Act and their right to equal protection, the Milwaukee Journal Sentinel reported. The state rule that excludes coverage for undefined "transsexual surgery" was adopted in 1996. U.S. District Judge William Conley granted a preliminary injunction Wednesday barring enforcement of the rule. He suggested the injunction could be expanded to include any transgender Medicaid patient whose doctor recommends the surgery. "The likelihood of ongoing, irreparable harm facing these two individual plaintiffs outweighs any marginal impacts on the defendants' stated concerns regarding public health or limiting costs," Conley said in the 39-page order. Flack could get his surgery in two or three weeks, said Attorney Rock Pledl. He said Makenzie may have to wait a few months because of her status on the paperwork process with an HMO. Flack, who has cerebral palsy, uses a motorized wheelchair and relies on Supplemental Security Income for the disabled as his sole support. He first identified as a boy at age 5, according the lawsuit. Makenzie is also is disabled and relies on Supplemental Security Income. She has been living as a woman since 2012. "This is tremendous," Pledl said of the ruling. The state's Medicaid has a budget of approximately $9.7 billion to cover about 1.2 million eligible residents. An estimated 5,000 of enrollees are transgender. So now we the taxpayers are splitting the bill...same thing with Bradly Manning, we paid for it while he was in prison...on treason charges, no less...Obama is just a freaking idiot... |

I agree ..it's not like this is any type of injury that requires medical attention...and as far as Obama being an idiot..well what's new .. And I have yet to figure out why we had to pay for a traitor's surgery...that one made absolutely no sense.. |

I'm not really understanding why they are doing this with people that aren't healthy either...I can somewhat see them justifing them doing this to a person with a long life ahead, but not people who don't...are the doctors just that greedy?

I fall into the opposite category. My med records has "TERMINAL" written on it. Doctors won't even try to help me. But they will prescribe nice expensive Rx. Plus, the Rx that has helped in the past, they will not give me. Its been 3 years since a doctor has even examined me and this is at two different VA medical centers. Then there is the Medicare fiasco that only covers preventive meds and procedures with a serious co-pay and benefit return delay. That's IF you can find a doctor willing to take new Medicare patients locally. I've been "Put out to pasture", "Written Off", "Rendered Invisible". |

Medicare is wonderful if you have the money to foot the co-pay. If you can find a dr that takes new medicare patients locally and if you have the out-of-pocket cash to pay the annual deductable that has to be paid before they pay any percentage. Then, there is no Rx coverage included with parts A and B. That costs extra. Plus, you have to pay then apply for reimbursement. With the VA, I pay nothing except the Rx co-pay set at $8 per Rx 30 day supply. Some VA's are outstanding but the ones in this region are terrible. |

Personally, I see the people seeking the surgery as idiots. I just can't get my head around someone that is: "Flack, who has cerebral palsy, uses a motorized wheelchair and relies on Supplemental Security Income for the disabled as his sole support. " saying to themselves "you know what? If I just have a penis/vagina added/removed, my life will be better! All my problems and inability to see myself how I want to and act how I want to all stems from the incorrect external genitalia! And if my problem is based on how other people see me? Well changing what no one really sees will change my life completely maybe even make me happy!" Other than that, I don't see Obama as head of the insurance companies or sitting in the oval office reading everyone's medical file with a big "approved" stamp to the side. I don't see Obama as the idiot in this. I see the people who have decided that requesting medicaid to pay for this is something they should try or are entitled to are idiots. IMO little different than people that go into a candy store and ask "hey, can you help me? I really need the lightbulb for a 1978 Kenner microwave. Well, can you just check? What surprised me was the "you HAVE to register for medicare the year you turn 65" letter. It read like there was no choice. Medicare A and B will leave one with lots of bills. Instead of plan D I signed up for plan F. Plan F is $150 a month more but I have no doctor or hospital co-pays. Prescription coverage is not a good as before I retired. I've checked out the formulary lists of the major suppliment companies and they all seem to be very similar. It seems of the 1200 (or so) medications that medicare allows 50% are in tier 3 or tier 4 which means one pays roughly 40-45% of the cost. And guess where most medications used by retirees end up? You guessed it: in the 40-45% region. So for those who think medicare is a free medication program check the facts. Many people on medicare have to pioritize the meds they need. Many forego meds because they're to costly. |

If this continues, our taxes maybe as high as other Countries like Demark. It was on the radio this week they pay 60%of their earnings in Taxes. Local radio station. : |
