Police: Man, 25, dies after being punched in the head at York park
YORK, Pa. —

Police say a man died hours after he was punched in the head at a York park on Monday night.

Authorities have identified the victim as 25-year-old Oscar Cherry III. His family tells News 8 he had special needs and was born with Spina Bifida. They say he was not expected to live past his first birthday or walk, but he persevered, taught himself to walk and graduated high school at 21.

The incident happened around 7:30 p.m. at Girard Park in the area of East Maple Street and Girard Avenue. Police say Cherry was baybsitting when a group of boys and girls began to make fun of him. They also threw rocks and sticks at him. At one point, Cherry told them that if one of the girls he was babysitting were hit with a stick, he would hit them with it. The group of kids left, but returned with a "bigger kid," identified by police as 18-year-old Kwamiere Durham.

Upon arriving at the basketball court, authorities say Durham asked the group: "Is he the person who hit you?" and the group answered yes. Cherry began to walk away, but Durham swung a punch at him, striking him in the face. Cherry fell onto the cement ground, striking his head. Police say Durham and the group of kids then fled the area.

When police arrived on the scene, they found Cherry lying on the basketball court unconscious with blood coming from his ears. Officers began CPR until EMS arrived and took over. They transported him to York Hospital where he was rushed into intensive care. He passed away on Tuesday morning.

Police have charged Durham with homicide.
