Nonbinary now a legally recognized gender in Oregon residents can now legally change their gender to “nonbinary,” according to a circuit court ruling. Nonbinary refers to individuals who identify with any gender identity, and The Beaver State is the first in the nation to recognize it.

An umbrella term for anyone who does not identify as just male or just female, nonbinary, for the first time in US history, is being legally recognized as a gender.

Everything was put in motion by Jamie Shupe, an Army vet who has been transitioning gender since 2013, the Daily Dot reported.

A petition filed by Shupe in late April included two letters from their doctors that state their gender should be nonbinary. Shupe, who prefers not to use gender pronouns, first petitioned to change their gender from male to female.

"I was assigned male at birth due to biology," Shupe explained to Oregon Live. "I'm stuck with that for life. My gender identity is definitely feminine. My gender identity has never been male, but I feel like I have to own up to my male biology. Being non-binary allows me to do that. I'm a mixture of both. I consider myself as a third sex."

"Male and female are the traditional categories, but they fail to properly categorize people like me. So I challenged that," Shupe told the Daily Dot.

The attorneys at the Transgender Law Center believe that this may be the first ruling of its kind in the US, Transgender Law Center's legal director, Ilona Turner, said in an email to the Dot.

Nancy Haque, a co-executive director for Basic Rights Oregon, told Oregon Live that while this was a “momentous day for genderqueer Oregonians,” it was not a total victory for nonbinary Oregonians.

Haque explained that nonbinary is still not an option for driver’s licenses or state-issued identification cards. She claims that some nonbinary individuals are denied medical services, because they do not have a conforming gender identity.

“In all the ways our lives are gendered in ways they frankly don't have to be, it can be a barrier for people whose identities aren't easily put in a box," Haque said.

Nonbinary Legally Recognized Gender

IMO this isn't necessarily bad.

I'm really hoping the push for a greater number of "gender" recognition leads to greater necessity to curtail the number of enforceable laws passed.

The more individuals lawmakers have to take into account as a law effecting, the fewer laws they can actually pass since all groups or individuals are equal, as they're going to negatively impact someone.

Of course I'm mostly just fearing and expecting the status quo of flavor of the week victim that needs more protection, which cause laws to be passed that conflict with each other so people can't do anything at all without doing something illegal.

Like OSHA and EEOE. Where you legally have to hire a midget to comply with equal opportunity, yet can't accommodate them with a little step stool to reach the counter/register (which is mandatory) since it creates a hazardous work environment, violating OSHA standards.


It would be a good thing if the government were basically tied down by their own laws, rather than tying everyone else down, IMO.
The more people they have to recognize and accommodate legally as groups or individuals, the more their hands are tied.
So, IMO not an inherently bad thing.

No, it's the genitalia he was born with that determined he was male, it wasn't "assigned" to him. It's his in utero biological development that determined his gender.

If a seed is planted and a tomato plant grows it's a tomato plant even if someone decides to call it a pepper plant.

Minor mention to the people who think everyone really is definitely male or female at birth, you folks need to study more actual biology, and stop assuming that cultural bias determines reality.

In other words, humans can be born with a wide variety of sexual factors, not all of which match up with the organs which present physically.

You can look it up if you want to be better informed.

What's more interesting to me, is the idea that laws in general, might be better for all of us, if gender didn't matter to them. Really. How many things have to be different, under the law, for males and females?

From what I have learned, we are all females at conception. After some time the DNA assignment is made. For whatever reason God made it this way. I'm not sure of all the rest. Wonder how insurance companies are gonna deal with this? Binary was in an accident. Binary has won the lotto. Binary is taking command of the fire team. Well, I've been told I'm an old fashioned dinosaur. Homophobic and backward. Guilty as charged. Funny at one time I was just known as an American. Pretty soon, there will be binary citizens. MILWAUKEE, June 9, 2016 (LifeSiteNews) – A gay pride parade has rescinded its invitation for a nationally known lesbian activist to be its grand marshal, because she supports privacy in women's restrooms, showers, and intimate facilities – a rift that further highlights the brewing conflict between biological women and the transgender political agenda.

Miriam Ben-Shalom served in the Israeli armed forces before returning to the United States and joining the U.S. Army. However, she was discharged in 1976 after two years of service when she publicly announced that she is a lesbian. She lost a lengthy court battle against the Army in 1990.

She founded Gay, Lesbian and Bisexual Veterans of America (GLBVA) and chained herself to the White House fence on more than one occasion to protest the armed services' ban on open homosexuals serving in the military.

When President Obama signed the repeal of “Don't Ask, Don't Tell," Ben-Shalom - who was widely hailed as a hero of the LBGT cause - was on hand to witness the event.

But the sexual revolution moved on, and transgender issues have eclipsed homosexual and traditional feminist concerns as the cause célèbre of the Left.

While Ben-Shalom reportedly did not write anything about the brewing national controversy over biological men using facilities intended for women, biological males who identify as women reported that she reposted items indicating that she supported separate facilities based on biology.

“It was brought to our attention that your Facebook page contains a number of posts asserting that transwomen are a danger to young girls in public bathrooms and locker rooms,” the Milwaukee Pride Parade Board of Directors wrote to her in April. “We cannot have a Grand Marshal who has publically and repeatedly denigrated transwomen.”

She responded, addressing her letter "To you bunch of Moral reprobates – so cowardly you can’t even post a name.”

She affirmed that she does, in fact, believe that “women born of women have the right to safe spaces of their own.”

“I see that Milwaukee Pride cares more about men than it does about women’s safety,” she said.

She concluded by saying, “You are no better than the Army.”

Since being disassociated from the pride parade, she has linked to the story of Maya Dillard Smith, the African-American who quit as leader of Georgia's ACLU chapter over its transgender policy, commenting, “More sanity kicked out from the world.”

Like Maya Dillard Smith, Miriam Ben-Shalom is far from a conservative. She considers pro-life laws part of the “war on women" (in her words). She calls herself a penis exclusionary radical feminist (PERF) who believes "gender roles ought to be abolished," because they are based on "binary stereotypes which are artificial and not biological."

Yet hostility has erupted as feminist, and sometimes lesbian, goals clash with those of the newly ascendant transgender political movement. Transgender activists pressured Cardiff University to cancel a speech by Germaine Greer, a '60s radical feminist leader, after she denounced the notion of transgenderism as a form of patriarchal misogyny. Greer lambasted Glamour magazine's decision to name Bruce Jenner its “Woman of the Year,” questioning the notion “that a man who goes to these lengths to become a woman will be a better woman than someone who is just born a woman.”

The Milwaukee gay pride parade is scheduled for June 12.

This is a very slippery slope,

when we start allowing legally allowing people to change REALITY bases on how they FEEL.....well it's going to end very very badly.

Reality is you are what gender you are, you are either Male or Female. .period. ..

what happens when it goes farther? 40 yr old man caught having sex with 13 yr old....what if he says he 'identifies' as a 12 yr old? ....if biology doesn't determine what we are, who are we to question whether or not he is really a 12 year old?.....

Some things are binary, how you FEEL should NEVER influence what is the TRUTH
