SAN FRANCISCO — A federal appeals court on Monday tossed out a veteran's conviction for wearing military medals he didn't earn, saying it was a form of free speech protected by the Constitution.

A specially convened 11-judge panel of the 9th U.S. Circuit Court of Appeals ruled that the First Amendment allows people to wear unearned military honors.
Elven Joe Swisher of Idaho was convicted in 2007 of violating the Stolen Valor Act, which made it a misdemeanor to falsely claim military accomplishments. President George W. Bush signed it into law in 2006, but the U.S. Supreme Court struck it down in 2012 as a violation of free speech protections.
Investigators looked into Swisher's military claims after he testified at the 2005 trial of a man charged with soliciting the murder of a federal judge. Swisher wore a Purple Heart on the witness stand.
Swisher testified that David Roland Hinkson offered him $10,000 to kill the federal judge presiding over Hinkson's tax-evasion case. Swisher said Hinkson was impressed after Swisher boasted that he killed "many men" during the Korean War.
Prosecutors say Swisher enlisted in the Marine Corps a year after the Korean War ended but was never wounded in the line of duty. Swisher was honorably discharged in 1957, and discharge documents indicate that he didn't receive any medals, according to the 9th Circuit ruling.
During his 2007 trial, prosecutors showed the jury a photograph of Swisher wearing several military medals and awards, including the Silver Star, Navy and Marine Corps Ribbon, Purple Heart, and the Navy and Marine Corps Commendation Medal with a Bronze "V."
Swisher's attorney Joseph Horras of Boise, Idaho, couldn't immediately be reached for comment Monday.
After the Stolen Valor Act was struck down, Congress passed a new law making it a crime to profit financially by lying about military service. President Barack Obama signed it in 2013.
After Swisher's conviction, Congress removed a provision making it illegal to wear unearned medals.

unless one is lying under oath or on a contract or impersonating a government employee or officer,,,,


Lying to gain profit is called fraud, plain and simple. These guys use those awards, medals and fake SEAL claims to get free drinks, vacations ect.

That is a crime.

It's Stolen Valor regardless what the Idiots call it!

Next time I see any kids trick or treating dressed up as policemen, or soldiers, or even firemen, I'll make sure to cause them to feel horrible for stealing valor.

Next time I see a movie where an actor is dressed up in a military uniform with all sorts of medals, decorations, and ribbons, I'll make sure to write a nasty note to Hollywood decrying them.
I'll be especially harsh if it's not a biopic.



I don't see any trick or treaters wearing Medals of honor or purple hearts.

But if they are trying to pass them selves off as a service member and getting the free perks that come with it, that is fraud.

not so plain or simple

fraud has to leave the victim in worse condition and the victims actions have to be reasonably expected

someone getting someone a drink has not left them in a worse condition, nor is it REASONABLE to give someone a drink for free without accepting the risk that they have lied

unless they whip out a military ID to get a discount,,,


being impressed with the metals and awards someone achieves is subjective and your own risk,,,

fraud would be showing a fake military ID to receive military discounts

Imitators and wanna be's or even those who wear medals for a variety of legit or illegal reasons irritate me but their dishonor no way diminishes the honorable and I just pretty much ignore them.

Have I gotten jaded and know that some do abuse the dignity and sanctity of those who have worn them and less likely to take them at face value? Yea sorry to say I have.

Especially on line where if a guy is a vet I will take them saying it with a grain of salt because I have seen so many who have served short hitches pushing papers or in non combat venues but not notably and to me then it was a learning experience and a privilege and they should be thanking taxpayers for the perks they have.

Personally I think more of the problem military should have been stripped of all their benefits just like some of the problem dependent wives. It makes me furious when I see vets ripping off the VA hospital system for prescriptions and supplies and selling them. Or self inducing various health issues and then trying to get that rated as and upgrade for veterans disability.

I suppose so, but I'm not a fan of Trump, so that doesn't affect me. He's got a big mouth and in my opinion he's a loose cannon BUT.. he did MAKE the money he has.. like him or not, he built his business and worked to get to where... by doing.. not bullshitting people

What he did not do was reply on and expect people to donate money to him in order to bankroll his lifestyle, then classify himself as a man of God... to avoid taxes. as Sharpton has done.

But maybe I'm wrong... Since him and I are both in NYC, please tell me exactly what church the good minister preaches to his flock at each Sunday and I will be more then happy to stop in and listen to him spread the word of the almighty... then I will be glad to retract that using the "cloth" as a tax thing I mentioned.
