seems if there were/is evidence of a 'broken' door having been 'kicked in',,,,it would/will be a clear case of self defense
they are also kind of screwed for both grabbing a glock but answering the door hard to prove there wasn't knowledge beforehand and intent,,,unless there is no peephole ,,,,,,further details will emerge,,,, |

Don't intervene in a crime just run away. Don't try to protect your neighborhood, STFU and run away. A girl getting beaten on the streets by her boyfriend? Run away. An armed robbery? Run away. A suspicious guy wandering your neighborhood? Run away.
Capitulate to the criminals. Give them the high ground. Just run away and let the crime happen. Don't get involved and don't get all heroic just let it happen. If you don't then the law will get you not the criminal. You could and should have just walked away. That's what they want,and pretty much already achieved here in Europe! When seconds count,the Police is Minutes away! |

When attacks/crimes are being committed there is something called the rule of 9's. The rule of 9's is that police show up 99.999% of the time after the attack/crime has been committed. |

The Glock was picked up the first time that the intruder came to door due to the late hour. By kicking in door and advancing on homeowner .... he got what was coming to him. |

if someone knocks at an odd hour to make you alarmed
you don't answer it, you call 911 but he did answer it, at that point no threat. there was an argument and he closed it than, ALLEGEDLY the door was 'kicked in',,, yet the body was found on the porch if the man he shot wasn't armed if there isn't proof of a life threatening altercation,,, it becomes a suspicious situation at the least and premeditated murder at the worst ,, |

In the State of Colorado, if a person breaks into your home we have what we call the "make my day law" and you can indeed shoot them. Armed or not.
I couldn't find information on what state this occurred in. The point is, a person should not have to be forced into hand to hand conflict with an intruder IN THEIR OWN HOME just because he does not have a gun. Anyway, at two o'clock in the morning there is no way to tell if an intruder has a gun. So, msharmony you are mistaken and wrong to suggest that "if a person is not armed" you can't shoot him. YES YOU CAN. |

In a city in a high crime area it would probably be a good idea, but how many people do you think would do that, and how would the police like to be called on 911 every time someone knocks on a door at an odd hour? This thread reminds me that I need to get a peep hole and a dead lock put on my door. |

No one has yet challenged that aspect of the story so one could reasonably assume that it's accurate. At least I would think. And if the door was, in fact, kicked in, that constitutes a very strong threat. Especially to anyone with any training... The rest is hard to prove. There are multiple witnesses with collaborating stories in the defense and that's all you can go on (besides a broken door). Thing about the legal system is, by design, you shouldn't be imprisoned unless you are PROVEN GUILTY, not just suspected of it. |

One can justifiably assume that if a person comes to your house in the middle of the night, and breaks down your door after you closed the door on them, that they are a threat. and If you really think that "property" is not worth anyone's life then why do soldiers in a war die in defense of a hill? It is basic animal instinct to protect your living area and your family. |
