The prosecutors being to ambitious that's why Casey Anthony got off.

I think the biggest flaw in the Casey ANthony case was not having a cause of death

not a problem here,,,,

No, the problem is the prosecutor charged her with the wrong charge the jury thought was to harsh, just like this case where someone isn't charged at all.

yeah, a murder charge with no proof a murder occurred is a strike out.

A murder charge where death is known and the killer is also known, is not nearly as much of a strike out.

A murder charge where it isn't even a manslaughter..............

The prosecution is going to have to prove beyond a reasonable doubt that he had set out and always INTENDED to kill Trayvon Martin, if they don't then the jury has to aquit.

Trayvon's mother said she thinks her son's death was an accident. That precludes Murder 2. The jury will most likely agree with her and find him innocent.

not exactly what she said, but how people choose to paraphrase it,,,

her statement was ""I believe it was an accident," Fulton said. "I believe it got out of control and he couldn't turn the clock back."
"

exactly what I said,, his original intent was not to kill

I believe his original intent was to harass and detain

but it SPIRALED into a death instead which makes him culpable to be charged as he had

How does that fit the definition of Second Degree Murder?

I didn't say premeditated, but Murder 2 does have to show intent. Don't take my word for it look it up and check it out yourself. At best this is Voluntary Manslaughter.

it doesnt have to show intent ALL Along,,,,

it only which is what the post implied previously

it only has to be intent to harm at some point,, which ends in death,,,

Murder 2 requires an "obvious disregard for human life". That's going to be hard to prove, probably impossible to prove in this case. You have two witnesses who saw Zimmerman being beaten by Trayvon. To fit the qualifications of Murder 2, it seems that Zimmerman would have to have shot before being beaten.

I think this is an appeasement and nothing more. Gives people time to cool down and then Zimmerman goes free.

Second-degree murder is ordinarily defined as 1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion" or 2) a killing caused by dangerous conduct and the offender's obvious lack of concern for human life

second degree murder n. a non-premeditated killing, resulting from an assault in which death of the victim was a distinct possibility

depends upon the jurors points of view

you have witnesses who also saw Zimmerman STRADDLING Treyvon's back

he had disregard for THIS persons life, arguably, by the way he spoke about him, by following and approaching him while in possession of a weapon, and taking the chance that this type of thing might happen because of someone looking 'suspicious'

What witnesses would that be?

According to Mary Cutcher on Dateline NBC, she and her roommate both saw Zimmerman “straddling the body, basically a foot on both sides of Trayvon’s body, and his hands pressed on his back.”

Mary Cutcher told Dateline NBC’s Lester Holt in an interview:

“It sounded young. It didn’t sound like a grown man is my point. It sounded to me like someone was in distress and it wasn’t like a crying, sobbing boo-hoo, it was a definite whine.”

Cutcher added that Zimmerman told her and her roommate to call the police. “Zimmerman never turned him over or tried to help him or CPR or anything,” Cutcher said.

That was after Zimmerman killed Trayvon, not before. We have two witnesses who saw the conflict before the shot was fired and both agree that Trayvon was on top of and beating Zimmerman.

it doesnt matter if it was the night of or after, a witness is a witness

everyone saw them fight , that is not dispute, the nature and the cause of the fight, who was the AGGRESSOR in the fight,, is the issue

not who was seen being beaten at different points of the fight...

slaphead She saw Zimmerman and Trayvon AFTER the shooting, not before. NOT BEFORE. So of course Trayvon wasn't beating Zimmerman when she saw them. DUH!

The physical evidence should help with that, but they are also going to have to look at the character of both the individuals. Trayvon was a thug, that is going to influence any law abiding citizen.

not who was seen being beaten at different points of the fight...

Zimmerman was on top AFTER Trayvon was shot. Trayvon was a thug and he was beating Zimmerman. You need to come to terms with that.
