An Occupy Pittsburgh protester has been arrested for failing to register as a sex offender, authorities said.

James Francis Hoff, a homeless man who referred to himself as "Blue Thunder" while blessing the protesters on Thanksgiving Day, was arrested on Dec. 31 after Pittsburgh police responded to a report about a man squatting in a home. The owner of the home declined to press charges, but investigators learned that Hoff had failed to register with Pennsylvania authorities as a registered sex offender.

Hoff, who was convicted of involuntary deviate sexual intercourse in 1999, will be formally arraigned for failing to register as a sex offender on March 6, according to Michael Manko, a spokesman for the Allegheny County District Attorney's Office.

Hoff, who remains jailed, waived his preliminary hearing on Jan. 18, Manko said.

Attempts to contact his court-appointed attorney were not immediately successful.

Jeff Cech, a spokesman for the Occupy Pittsburgh protesters, told KDKA that no one was aware of Hoff's criminal history.

“When it became aware, he left," Cech told the station.

Former Penn State defensive coordinator Gerald "Jerry" Sandusky waived his right to a Dec. 13 preliminary hearing on charges that he sexually abused 10 boys over a 15-year period, moving his case closer to a trial in early 2012. The move to waive a "probable cause" hearing also avoids early testimony from Sandusky's accusers.

Sandusky and his attorney have maintained that he is innocent of the charges, which stem from a grand jury investigation. The former coaching assistant says he merely "horsed around" with the boys, all of whom he met through his Second Mile charity.

Penn State University fired long-time coach Joe Paterno and president Graham Spanier on Nov. 9, four days after Sandusky was initially arrested. Athletic director Tim Curley and a vice president, Gary Schultz, are accused of perjury and failing to report suspected child abuse. Both have stepped down from their posts.

The scandal has shocked the Penn State community.

Involuntary Deviate Sexual Intercourse basically means rape, but can also include other types of sexual assault. See the Pennslyvania definition below:

Section 3123. Involuntary Deviate Sexual Intercourse.

(a) Offense defined - A person commits a felony of the first degree when he or she engages in deviate sexual intercourse with a complainant:

(1) by forcible compulsion;

(2) by threat of forcible compulsion that would prevent resistance by a person of reasonable resolution;

(3) who is unconscious or where the person knows that the complainant is unaware that the sexual intercourse is occurring;

(4) where the person has substantially impaired the complainant's power to appraise or control his or her conduct by administering or employing, without the knowledge of the complainant, drugs, intoxicants or other means for the purpose of preventing resistance;

(5) who suffers from a mental disability which renders him or her incapable of consent;

(6) who is less than 13 years of age; or

(7) who is less than 16 years of age and the person is four or more years older than the complainant and the complainant and person are not married to each other.

(b) Definition - As used in this section, the term "forcible compulsion" includes, but is not limited to, compulsion resulting in another person's death, whether the death occurred before, during or after the sexual intercourse.

so he could have had sex with another homeless person who was deemed later to suffer from a mental disability


thing with those tags is there are so many DIFFERENT offenses that legally call for 'sex offender' status ,,,,

anymore than Sandusky being a perv makes All coaches a perv!

a group in Portland have been marching, protesting, supporting a single mother who was being foreclosed on by Wells Fargo and Fanny, today her hearing was dismissed.
She and her children get to stay in their home and not have to go to a shelter, for now. Isn't that great news??????
I mean..you ARE happy for them , right?

They have to list the place they are sleeping even if it is on the street somewhere, in a vehicle at certain location, a shelter whatever. They then also have to notify the city and state when they change locations.

He isn't the only OWS protester getting arrested for SERIOUS crimes committed durung the OWS protests. It is a pattern of lawlessness by these criminals.

Oh yea, he committed a crime to move to join the movement and didn't register that he moved, so yes you can blame it partially on the movement.

Oh yea, he committed a crime to move to join the movement and didn't register that he moved, so yes you can blame it partially on the movement.


I didn't see that stated in the article, that's an assumption. It said a homeless man. BTW, you have to give a physical address and if you are homeless that could be anywhere everyday.
