l. What you say to the police is always important. what you say can be used against you, and it can give the police an excuse to arrest you, especially if you bad-mouth a police officer.
2. You don't have to answer a police officer's questions, but you must show your driver's license and registration when stopped in a car. In most other situations, some state's laws doe not make it a crime to refuse to identify yourself to a police officer. Check your individual state laws on this.
3. You don't have to consent to any search of yourself, your car, or your house. If you DO consent to a search, it can affect your rights later in court. If the police say they have a search warrant, ASK TO SEE IT.
4. Don't interfere with, or obstruct the police-you can be arrested for it.

had rode my bike to the store, needed the exercise, bought milk and eggs, had them on the luggage rack clearly visible. a couple of cops pulled me over this was just a little before dark, the first question have you been drinking today,my answer he11 yes, question what and how much, answer coffee a couple of pots. two very mad cops.

Good stuff Duffy. I look forward to the next one. I know a few tips myself, here's a really good one...

You are not required by law to take a roadside sobriety test. Their purpose is to document your supposed impairment so that it will be easier to convict you of a DUI. Don't take them.

That doesn’t mean be rude to the cop, just tell them politey that you understand that you aren't legally obligated, and that you decline to do so.

It's not that hard to fail these tests just from being nervous, so don't give yourself a chance to.

In Canada you are obligated to take a road-side breath test...Otherwise they charge you with refusing to provide a breath sample...The consequences are the exact same as an impaired driving conviction!!!!!!!

Wow something about Canada that I don't like. Who knew?

I was actually just talking about the tests where they make you walk in a straight line and stuff like that.

As far as the roadside breath test goes, I know that you can refuse that too in Colorado, but I think that you are required by law in some other states.

Yes you can refuse them here too...they are called road-side dexterity tests...BUT they will just give you a road-side breath test anyway or not even ask you to do the dexterity test and go right for the breath test...that just gives a pass or fail reading and gives them cause to take you in for a formal breathalyzer test if you fail!!!!!!!!!!!!

Because I am a paralegal Allen and I have represented people on both refusing a breathalyzer and impaired driving charges...UMMMMMMM So it's my job to know the law so I can defend them...Anymore questions????bigsmile
