Wishing bad on other humans is a sign of mental unwellness though. IMO

I never liked Bush but I never wished anything bad on him. Because it shines badly on me to do so.

wasn't california's constitution that guaranteed his right to free speech. was the first amendment.

I mean if you had the same conversation and someone happens to overhear you it's no big deal either, but he blasts it on you tube..did he say, "I am going to shoot Obama?"

I think the significant part of the story was 'reasonable person'

many people arent

there have been many cases decided differently though where people WERE convicted for threats of this nature against public officials who were able to testify that they 'did feel threatened',,,,

If OBama wasnt sweating it,,then there wasnt much of a prosecution,,,

Based on this it doesn't matter if he was president or not.

You can't even kick someone off your front lawn if they are threatening you, You have to drag them into your home in order to protect yourself.....SO if a man makes a "verbal" comment online from a different state, How would they prosecute that when no physical harm has actually been done?

Your statement makes more sense than mine, i admit, i am just saying that with laws like that in place how can they enforce a free speech law?
