Tacoma, Washington -- A strange quirk in the law is allowing an accused child rapist to watch child pornography inside the Pierce County Jail.

Marc Gilbert is accused of sexually assaulting young boys and videotaping the abuse.

Under the law, defense attorneys are allowed to review material tied to the case. And because Gilbert has chosen to act as his own attorney, he has had unlimited access to the pornographic footage.

Therefore, the jail says it has no choice but to allow Gilbert to review the footage times over with no limits. Restricting his access would risk a mistrial.

Investigators seized from Gilbert's possession more than 100 DVDs containing 28 hours of pornographic footage. Some of the material was allegedly shot by the former jet pilot, and feature the young boys he's accused of luring to his home and exploiting.

The prosecutor and the sheriff say the results of the legal loophole are sickening in this case, but say the state Supreme Court has ruled in Gilbert's favor.

"Make no mistake -- I don't like it," said Pierce County Sheriff Paul Pastor. "But it is not my choice whether to do it or not to do it. There's no question that I don't like it. There's no question that this makes me grind my teeth."

"We don't like it. We don't want to do it, but we have to follow the law. The fix here is to change the law," said Pierce County Prosecutor Mark Lindquist.

To make sure no other inmates get a chance to see the pornography, Gilbert is made to review them in a separate room.

Child advocates say allowing the tapes to be viewed further victimizes the victims.

Jesus!!! Although, acting as his own attorney, I have to believe that is his right. It does not matter though due to he will lose his case due to not hiring a professional.

Yes, this disturbs me, however it is within his lawful rights as acting attorney. It is DISGUSTING. But, nothing we can do about it.

It is all about changing the laws. As soon as we change them, then this sort of sickening act may not occur.

well, if he's waiting for trial, he's still in county, not prison... they can't really do that in county lock up...

Depends on where they are at. They can and have housed people in prison who have waited on trial, all though it doesn't happen a lot.

They can still do that in jail also. My brother is a Corrections Officer and works on Death Row here at NSP. I also have a lot of friends who are cops and have heard a lot of the stories about jail and prison, and have talked to former inmates when I catch them stealing at work. There is a lot of crazy messed up crap that goes on in there, hell they can even get to people who are in protective custody.

let the other inmates watch his dvds with him he will be gone in 5 min

if he is 'convicted' that would be another story, but I have never been too overly keen on treating people criminally before they are convicted or proven to be criminals,,,

an allegation doesnt make one guilty,, in my opinion,,let the courts decide,,

ummm.. he's sitting in jail watching the videos he made of himself with young boys....

'allegedly',,,,of course, if it is actually child porn, the laws against viewing it should supercede the right to view it for court,, but then the court has to decide if they are indeed pornographic,,,,,

not the media,,,

nothing "alleged" about it... he's sitting in his cell watching the acts that put him in there...
