If Kagan gets appointed as the new 'justice' to the Supremes, those of us who understand and appreciate the protections currently afforded our 'Right to keep and bear arms' under the Constitution of the United States have just been put on notice that she intends to remove that protection as soon as possible. You may want to let your Senator know your thoughts on her being appointed as the 'Obama Surrogate' to the highest court in the land. Once she's in, it's all over but the cryin' ...

Kagan Said She Was `Not Sympathetic' Toward Gun-Rights Claim

By Greg Stohr and Kristin Jensen - May 13, 2010

Elena Kagan said as a U.S. Supreme Court law clerk in 1987 that she was “not sympathetic” toward a man who contended that his constitutional rights were violated when he was convicted for carrying an unlicensed pistol.

Kagan, whom President Barack Obama nominated to the high court this week, made the comment to Justice Thurgood Marshall, urging him in a one-paragraph memo to vote against hearing the District of Columbia man’s appeal.

The man’s “sole contention is that the District of Columbia’s firearms statutes violate his constitutional right to ‘keep and bear arms,’” Kagan wrote. “I’m not sympathetic.”

Kagan, currently the U.S. solicitor general, has made few public remarks about the Constitution’s Second Amendment. The Supreme Court in 2008 ruled, in a case that overturned the District of Columbia’s handgun ban, that the Constitution protects individual gun rights.

As a nominee to be solicitor general last year, Kagan told lawmakers that she accepted that 5-4 decision in District of Columbia v. Heller as a precedent of the court.

“There is no question, after Heller, that the Second Amendment guarantees individuals the right to keep and bear arms and that this right, like others in the Constitution, provides strong although not unlimited protection against governmental regulation,” she said.

Review Denied

The Heller decision left room for states to require registration of weapons. The majority also said the ruling didn’t cast doubt on laws barring handgun possession by convicted felons and the mentally ill, or restrictions on bringing guns into schools or government buildings.

The lower court ruling in the 1987 case, issued by the District of Columbia’s highest court, said the Second Amendment protects only the rights of states to raise militias, and not individual gun rights. The ruling upheld Lee Sandidge’s conviction for carrying a pistol without a license, possession of an unregistered firearm and unlawful possession of ammunition.

The high court refused to hear the case, known as Sandidge v. United States. The memo to Marshall, found in his papers at the Library of Congress, includes a handwritten “D,” indicating that he was among those who voted to deny review.

Considering that too many lunies have guns now and I am not just talking about criminals, our everyday "think they are perfectly gun toting normal", have guns and shouldn't have them at all.

We need more restrictions on guns, all guns. If you cannot pass a psyche eval you shouldn't be allowed to own one and I know this is really not good enough but it is all we have to prevent the lunatics with guns from killing all those without.

If someone wants a gun because they are crazy or they want to commit a crime, they will get one. They won't follow the laws to get one. The bad guys can get them all the time illegally.

The honest people go about it legally. It's the ones that aren't honest and probably up to something that do it illegally. Those that go about it illegally do get prosecuted.

Guns aren't the only way to kill people. Even if they destroyed all of the guns in the world....people will find other ways without them.

I agree, but if it were an ABSOLUTE 'right' there would be no situation in which it was illegal,,,,,

the regulations have substance and significance,,,

What I am saying is that there are laws to own guns now. Either people will follow the laws now or break them. People that don't want to go about it legally will find a way around the law. So adding more restrictions or whatever won't do any good. Those that don't like the law, won't follow it any way.

oh,, no no no no, ,I wasnt advocating for more or fewer gun laws,

I was only posting about the notion that gun regulations violate a constitutional right,,,or that those who are upheld to those regulations should have empathy on some constitutional basis

of course, I am only going on the word of literature and my BLACK FAMILY members who lived during that time,,, it may have been more peaceful to sit back and take whatever the segregationist laws and racist authorities(those who were racist, not stating at all that every authority was though) did to him or his loved ones or his community,, it may have been EASIER for all for those discriminated against to just accept second class citizenship,,,but he chose another option which I think for the conditions in those times was understandable....

when faced with being excluded from representation or aknowledgement in their country they are told on one hand they should be 'doing it for themself' and then on the other hand (when they do it for themself) they are accused of 'reverse racism' or discrimination

which is it,, should people fight for their own rights when their rights are non existent or violated or is that just SEPERATIST, DEFEATIST, and RACIST behavior

Man, they sure play the victim real good.slaphead

I reckon that's why the clan, I mean the panthers, called for overthrowing the Gov. and killing Americans. I guess they are justified.{no, I ain't clan. It was just a pun.)slaphead

Aw, heck! Give those extremists more guns. Just don't give 'em any ammo.laugh laugh laugh

This is what I read about a year ago. And there are more sites discussing it.
http://www.newsnet14.com/2009/01/04/ammunition-accountability-legislation/

Ammunition Accountability Legislation

Remember how Obama said that he wasn’t going to take your guns? Well, it seems that his allies in the anti-gun world have no problem with taking your ammo!

The bill that is being pushed in 18 states (including Illinois and Indiana) requires all ammunition to be encoded by the manufacture a data base of all ammunition sales. So they will know how much you buy and what calibers.

Nobody can sell any ammunition after June 30, 2009 unless the ammunition is coded..

Any privately held uncoded ammunition must be destroyed by July 1, 2011. (Including hand loaded ammo.) They will also charge a .05 cent tax on every round so every box of ammo you buy will go up at least $2.50 or more!

If they can deprive you of ammo they do not need to take your gun!

Man, they sure play the victim real good.

lol,, so now people should IGNORE or DENY their mistreatment or they are playing victims,,lol

Im sorry, but my idea of a 'victim' is someone who has bee violated in some way,, where as PLAYING VICTIM refers to someone who refuses to do anything about the violation and chooses to stick in their current predicament for the pleasure of receiving empathy

jim crow laws were REAL, segregationist and supremist attitudes were REAL, and many minorities went through REAL oppression and abuse behind people in positions of authority who happened to hold these philosophies,,,

it is always odd to me , the bully who wants to beat someone down and when they hit back cries 'no fair'

the black panthers were a reactionary group that was responding to the issues of the time,,their platform was as follows

The ten points of the party platform were:

1) "Freedom; the power to determine the destiny of the Black and oppressed communities.

2) Full Employment; give every person employment or guaranteed income.

3) End to robbery of Black communities; the overdue debt of forty acres and two mules as promised to ex-slaves during the reconstruction period following the emancipation of slavery.

4) Decent housing fit for the shelter of human beings; the land should be made into cooperatives so that the people can build.

5) Education for the people; that teaches the true history of Blacks and their role in present day society.

6) Free health care; health facilities which will develop preventive medical programs.

7) End to police brutality and murder of Black people and other people of color and oppressed people.

8) End to all wars of aggression; the various conflicts which exist stem directly from the United States ruling circle.

9) Freedom for all political prisoners; trials by juries that represent our peers.

10) Land, bread, housing, education, clothing, justice, peace and community control of modern industry."

I dont see this as any more hateful or violent than the curren TEA PARTY , they were just in a different time facing different issues they perceived as injustice

where in their platform (posted above) did they call for government overthrow or violence?

the panthers chose to fight back against violence already being DIRECTED AT THEM, they chose to protect their communities that police were woefully neglecting to protect and were even sometimes violating themselves, they chose to give community services to their neighbors,,,which others would not

if obtaining guns is promoting violence, by that same standard the NRA are terrorists

if calling for a change to Government or overthrow of the current system is promoting hatred and terrorism,,,the TEA PARTY are terrorists,,,,,(except , like the panthers, nowhere in their platform do they encourage OVERTHROWING anything)

I think many great minority americans did more than put their big boy pants on , they made an impact that aided in equal rights in America. I think it is those who want to cry that their descendants should now be happy to be EXCLUDED from mention or aknowledgement in the educational system (after all that was done to insure they were INCLUDED), are the ones who need to take off the pampers and get over THEMSELF.

A lot of firepower to apprehend a non-violent group, don'tcha' think there, Mable?VVV

The latest battle between Panthers and police erupted in Los Angeles last week. It came against a background of continuing racial enmity, worsened by last May's re-election of Mayor Sam Yorty over black Councilman Tom Bradley. At 5:30 a.m. last Monday, two Panther offices and one private home were attacked by 300 Los Angeles policemen armed with arrest warrants, search warrants, shotguns, AR-15 rifles, tear-gas grenades, satchel charges, one helicopter, 6-ft. steel battering rams, a National Guard armored personnel carrier, and a fire department "jet-ax" used to cut through the roof of burning buildings. The principal target was Panther headquarters, a two-story brown-and-white brick building at 41st Street and Central Avenue. There, the battle raged for four hours and 45 minutes.

your support has come with few links either and links alone are no more or less proof of something(particularly links to commentaries) than the word of those who lived through it (namely my family members)

but it is interesting to note that the ones you consider contributors with the exception of king jr are all artistic, and nothing political, or intellectual, or social,,,,

as it relates to the other thread you referred toP african americans (And other minorities)were much more than entertainment,,and there is no reason not to include that in the educational system they are required to be a part of,,, and THAT was the original point of my posts,,,,,,if you find personalities that cause too much extreme controversy, remove those personalities from the subject,,,banning the subject altogether is quite ridiculous

It's a shame a no-nuttin' redneck has forgotten more about the panthers than some are likely to ever learn.slaphead

forgotten more of what you READ about than I have learned of what my parents went through? doubtful

your support has not come with few links either and links alone are no more or less proof of something(particularly links to commentaries) than the word of those who lived through it (namely my family members)

but it is interesting to note that the ones you consider contributors with the exception of king jr are all artistic, and nothing political, or intellectual, or social,,,,

african americans were much more than entertainment,,and there is no reason not to include that in the educational system they are required to be a part of,,,

I lived it.

You haven't a clue what I know or have experienced.

I was in the middle of it. Jr high when desegregation was implemented. The blacks there fought against it the same as the whites. They were happy in their neighborhoods and their schools. Back then, they were called the quarters.

The kids got split up and shipped to 3 different schools. They were taken from their teachers and friends.

What you see on tv is watered down and biased.

I think your teacher is biased.

The panthers chose violence and hatred. And by any means they deemed necessary.

In todays language, they would be classified terrorist. Federal Law. It's a crime to call for the overthrow of da' gubbament.

You lose. sorry.

Tell the poooor victims to put their big girl pants on and get over themselves.

BTW Angela is no longer welcome in the panthers.

Kagan is a socialist playing by Husseins rules. IMO.

where in their platform (posted above) did they call for government overthrow or violence?

the panthers chose to fight back against violence already being DIRECTED AT THEM, they chose to protect their communities that police were woefully neglecting to protect and were even sometimes violating themselves, they chose to give community services to their neighbors,,,which others would not

if obtaining guns is promoting violence, by that same standard the NRA are terrorists

if calling for a change to Government or overthrow of the current system is promoting hatred and terrorism,,,the TEA PARTY are terrorists,,,,,(except , like the panthers, nowhere in their platform do they encourage OVERTHROWING anything)<<Either a blatant lie or someone lied to you.

Granted, there were a lot of blacks who were great contributors. Maya Angelo, da stud King Jr., Cassius Clay, ( I loved watching him in action), George Foreman, Jimi Hendrix, (I used to trip with him) and a lot more.

Alas, I so tire of this game.

You spew false claims. No facts or links to back it up.

I will give you one more lesson on panther black history.

"There is a pig upon the hill. If you don't kill him, the Panthers will."

Black Panther Coloring Book shows a black man shooting a pig-faced policeman as a young black girl looks on.( How sick can they get?)ill

They carefully kept order at an Oakland rally the day Panther Defense Minister Huey Newton's trial began, even cleaning up the street after the crowd left; but they maintain alarming arsenals that include grenades and automatic weapons.

In a last month issue of The Black Panther, Information Minister Eldridge Cleaver wrote: "We call for the violent overthrow of the fascist imperialist United States Government."(Is this a lie??)

That's all the lessons for today.

I will step up and call a truce here but believe me my 'teachers' are no more biased than you friend,, my teachers LIVED it too ( but on the RECEIVING end of the racial injustice, profiling, and brutalizing,,,)

if you werent in the communities the bp were protecting , just that you lived through bussing and fought discrimination doesnt mean I should expect you will have an unbiased monopoly on the 'truth' of everything that was going on in those communities..

never ends well when we start down a condescending road, because we in fact DONT know what others have lived or learned,,,touche
