It never had to. The site is privately owned and administered. The owners and admins have the right to set up whatever rules they wish. The decision to abide, or not to abide, by those rules is left to each individual member. But violations can have negative repercussions. Check out the Terms of Service.

....that the first amendment doesn't apply to this site at all anymore. This site is a dictatorship, all sites are. The ones who own it can do what they want when they want with it, that's their right to do so.
