that is a good idea kristi. although the son would still challenge a will. but everything she has is Randy's.

Well the only thing he would be able to base it off of would be that she was not competent to make a will at the time so do a head start have her checked out by a doctor first and make him put it in her medical records she was at the point that she knew what she was doing when she makes the Will then make sure it is done within a few days. Kinda hard to fight her medical records at the time. Just make sure the lawyer knows the situation ahead of time that way he will make sure that all necessary steps are taking just in case. Hell just get a step ahead of the son for once.

UPDATE: I found a lawyer that couldn't believe the situation and would do all he can to help.

I spoke to Randy yesterday and it hit me....the son either doesn't know about common law marriage or lied about it

Truth of it is the son don't give a **** about anyone but himself or he would not have put her off by herself and skipped town as well.

the son some how....Randy is finding out how this happened....took her disability checks out of Randy's joint checking account. I don't know if he did something at the tearchers retirement office that pulled the checks out or what. the disability is paying for the nursing home. so money is involved with the son and the home

according to my step dad (retired cop) only a judge can declare someone incompetent...which hasn't happened. step dad said he should go to Commanche (where the home is) and speak to the cops there and get them to escort him to the home to get her

the cops aren't to get people in trouble...but to avoid it and to enforce Randy seeing his wife and taking her home

Yep hope it all works out for him sucks to know some kids are that cruel. Hell I would rather my kids leave me the hell alone if they are going to isolate me and no intentions of even being around me at all.
