Constitutional Law Expert: “It Appears the ‘Yes We Can’ Means ‘Yes We Can Do Most Anything That We Want’ When it Comes to Unlawful Programs.”

Constitutional law professor Jonathan Turley is slamming the Obama administration on its continuation of Bush spying policy:

In yet another break with its campaign promise to fight to restore civil liberties and privacy, the Obama Administration has made a breathtaking claim of state secrets to block a public interest organization from suing the government for illegal surveillance. There is not a scintilla of difference in the legal position of President Obama and the position of President Bush in trying to quash any effort to challenge unlawful surveillance by the government. It appears the “yes we can” means “yes we can do most anything that we want” when it comes to unlawful programs.

All you really need to do is look at the constitution itself to understand how it's being trampled on or flat our ignored.




"Amendment 1 - Freedom of Religion, Press, Expression. Ratified 12/15/1791. Note

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."



- Google the Fairness Doctrine. Remember how Dr. Paul was against prohibiting the free exercise of religion? Yet somehow that was being a religious extremist.



"Amendment 2 - Right to Bear Arms. Ratified 12/15/1791. Note

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."



- Google HR 45. They are pushing to regulate the hell out of firearms as of late. Although im not sure that any of it will pass.




"Amendment 4 - Search and Seizure. Ratified 12/15/1791.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Amendment 5 - Trial and Punishment, Compensation for Takings. Ratified 12/15/1791.

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."



- BOTH OF WHICH are overridden by the Patriot Act. Thank you Mr. Bush and President Obama...





Article 1 section 8:

Congress has the power to;

To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;

To provide for the Punishment of counterfeiting the Securities and current Coin of the United States;



Kinda goes against our Federal Reserve doesn't it?


Article 1 section 10

"No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility."



Things that make you go hmmmmmmm.....

It is an attempt at correcting the measures by which immigrants come into the US.

That is the real problem here that the government is entirely responsible for.

If it is a measure of National Security, why then, is the focus not only upon those types which are suspicious?

Why is it on natural born citizens who come from a long line of American heritage?

I'm pretty sure everyone on this thread was just as against Bush doing this. My wonder, is why the people that were against Bush doing so, AREN'T against Obama doing the same thing.

Actually, I have only been Politically voicing for only a few years now.
I knew, when Nixon got busted, not to trust Politicians but, had kids to raise and hadn't the slightest clue about computers. The only way I was ever informed then, was what was on the news.
In a way, I kind of wish I hadn't learned as much as I know now.
On the other hand, I have my plan of escape and will be outa' here, the US, in a matter of weeks. Dual residency.

People are stupid and naive to believe that the consitution was merely a set of suggestions that the people must follow.

Unfortunately it is a set of limitations and regulations not on the people, but the government.

It is also stupid and naive to believe that we have progressed to a time beyond the possiblity of tyranny and fascism.

Stay informed. Any time they amend the constitution there should be so much formal public debate on it, people should be sick to death of hearing it.

The reason for this is simple. Consitution is to limit government power. it is the natural course for the government to want to override these shackles that bind them. Remember that. But it is the necessity of the governed to ensure these shackles are never lifted.

Constitution is the second of all the greatest inventions of human race,
with first being the Monotheism, back around 1400 B.C.

All other events are small and insignificant stuff,
on the scale of human history.
They pale in comparison with these two, in any case.

Between the invention of Monotheism and the US Constitution,
the human race lived in the same stage.
Our "new" world, started with the constitution.

Before the Constitution, humans did not know how to use the government as a positive tool only.
The Constitution describes those rules.

The fact that we are almost ready to erase the Constitution,
is no amazing at all. It is rather normal.
This is because the average intelligence is still way below that of Founding Fathers.

A point that many do not understand. The Bill of Rights does not grant any rights. It only serves to keep the government from infringing upon those rights by limiting said government from doing so. And without people willing to actually stand up and enforce the constitution, as it was written, the document is virtually meaningless. The government is supposed to be accountable to the people, but when you have an overabundance of ignorance and apathy among the people who are supposed to hold government accountable, you get a government that holds no regard for the constitution or the people it is supposed to represent.

SO Constitutional Attorney Jonathan Turley, who was just as much against Bush's trampling of the Constitution, comes out as a fair man, who cares not one whit about political affiliation and blasts Obama for doing the same, thats a "Conspiracy"?

How about shooting Randy Weavers unarmed wife through the head right in front of her children? Or maybe burning women and children alive at Waco? I suppose these people dont have rights, because you leftists think anyone that doesn't act like you should be done away with.
