I was wonderingif anybody could help me out with an estimated time frame... I filed for divorce december 12th and my soon to be ex wife processed the papers on december 18th with her attorney. My wife in no means objects to the divorce as she wants the divorce. I'm just curious as to how long does anybody think it will be before I get into court. Thanks much.

In my area, it generally takes about 2 to 3 months for a court date to be scheduled. But keep in mind, all states have different times when it comes to getting divorced. Here in Virginia, once you are officially separated, the divorce is not final for another 6 months w/out kids, and 1 year with kids.

Divorce takes longer than dissolution.

My divorce took 13 months.

My friend's dissolution took 120 days, start to finish.

Ask your lawyer....

It might depend on the size of your court system and all that. Mine (dissolution) didn't take but just a few weeks until we had a date set after he signed the papers. Also though, my lawyer said we needed to get it done fast before his "anger" phase set in, so she was pushing to get in on the docket.

You say she wants the divorce, too, but what about the custody of your child? Is she going to willingly hand over primary custody?

How long depends on many things, what state you're in, how much property is involved, whether there are children involved, whether either one of you is going to be petty about stupid issues, whether you're in perfect agreement about everything, etc.

Like someone said in Virginia, you have to be separated for 6 months with no kids or one year with kids before you can even file for divorce.

mine took 2 months. I imagine each state is different tho..

in Ohio it took me from mar 26th fileing date till july 9th finaliazation.. but she refused to show at any of the court dates which is funny had she it would of been sooner... In Ny.. it takes about a year.... and then this is with no children involved and it a simple we both want out situation..... and I had a friend in wv that it took 2 years they fought over everything and even then there were no kids involved... so my answer based on others and my own experience is ........ be patient and remember it will happen for you eventually..

In general most states have a reconciliation period of 60-90 days from the date of filing. They do that in case things can be worked out(which is what you are supposed to be doing,LOL).In Texas a final date can not be set inside of that time frame. After that is is dependent upon how busy the court is as to getting a date set.Your lawyer should know an approximate date.Call him/her.

Mine (a dissolution), we seperated in September, finally decided in January to divorce, we didnt hire any attorneys (nothing to fight over) I filled out the paperwork, and we just had to agree on a date to go down to the courthouse. The allow walk ins to see the judge. Took about 20 minutes in front of him, and then he signed our papers! Took a total of about 2 hours total if you figure in the time waiting to see the judge, the time it took me to fill out the papers, and the time it took to have it recorded.

Oh and in IL you have to have grounds or be seperated for 2 years first. I claimed mental cruelty against him (we agreed on it).

thanks a bunch for the information. My wife and I don't have anything to fight over other than custody of our daughter. She doesn't want anything out of our home and thank the lord that my home is in my grandfather's name so she can't get it. My attorney does't think that my wife even has an attorney because we haven' recieved an answer yet. As to her signing over custody... Well, it's hard to believe, but for 5 months my wife wanted nothing to do with our daughter and to this day, I still don't think she does. I think she sees my daughter as a living doll... she plays with her when she wants to and then hands her back to grandma to take care of. I think that my wife doesn't want our daughter, being that she won't even work with me for the sake of our daughter when i'm over there seeing her, but that she wants me to fight for her. I believe I have plenty to stand on to be able to get custody. My wife has no job, no income, no education and isn't doing any of the reccomendations issued by (and yes unfortunately) C.P.S., where I am obliging to everything, have a steady home and an income... even if it is only disability. My MDA doctor and a physical therapist from MDA are both going to right me letters of reccomendations stating that I can take care of my child. For those of you who don't know what MDA is, it's the Muscular Dystrophy Association. They didn't even grant me any holiday visitation for christmas. That's right I had to miss my daughter's first christmas. The biggest plus for me is that my wife doesn't breastfeed. May the lord be with me on this one when I go into court because my lil' girl needs her daddy.

It is the same way for Washington, but there is nothing stopping you from filing for your court date within that period, since it will likely be set a few months out any. Once it became apparent that we could not settle out of court, that's what my lawyer did. I originally filed on July 27th, 2007, and our court date was March 21, 2008.

It was SIX months for me to get my court date..... then THREE more until it was final!

Check with your lawyer. Some states take longer than others.

Hang in there know it can be rough. When I got my court date the ex showed up with her current boyfriend. How rude.
