We get some first aid training every year and one of the funniest things is if someone is choking you need to ask their permission to help them. If they decline your help and you help them anyway they can sue you. So, you have to wait until they OK you or for them to pass out. Once they're passed out though, you're automatically allowed to help them! Lmao

Hmmm....I didn't know that people could talk and give permission when they were choking.

They can nod yes or no when you ask them a question. They're choking but it'll be a couple minutes before they pass out.

If the woman who aided her had first aid training, which states that if there is any possibility of a spine injury,DO NOT MOVE, then she would have NOT been following the approriate guidelines and would therefore not be protected.

If she didn't have any training and the only reason she thought the car might catch on fire was because of seeing it on t.v.and movies, she would not be protected.

Now if she smelled gasoline all over the place, and there was a true risk of that, she might be protected, training or no training.

There are variables.
Oh, yeah, and the permission thing is there too.

Most states have 'Good Samaritan' laws which protect people from being sued in cases like this. I do not know the specifics of the Calif. law in question. If you are a trained medical professional the law may or may not apply. I've known EMT/Paramedics and nurses who would not help at an accident for fear of being sued.
Remember lawyers are involved, and this is how they make their money, by suing somebody. The judge that ruled that the lawsuit can move forward may be having this case go forward to force changes or clarification in the state law.

Exactly, when I teach, I teach "life over limb." There are methods for protecting the spine, even through something like CPR, but its much more important that they actually get air in their lungs.

The Good Samaritain Law here states that as long as you were acting within the scope of your training, you cannot be sued. The only reason that I could see for lawsuit being upheld is if her co-worker failed to get consent. As stupid as it sounds, as long as you are conscious and over 18, you have the right to refuse care.

It's absolutely ludicrous. People have become too "sue happy" over the years. It's almost gotten to the point where someone would sue you for farting in their direction if they could do it.

"Sorry, co-worker. You can die in that car for all I care, but you're not gonna sue ME!"

It is my nature to help people, it always has been, so sue me, here my last 15 bucks. Enjoy it, i think it would buy two packs of smokes, a tall cold beer and a lottery ticket...hahahaha, but i'm me, and when my head hits the pillow...i can sleep with a clean conscience. Or maybe it's because i stay up too late. :wink:

Be a sweet kind of vengence of the same lawmakers were in the given situation..."sorry mate, can't help you, might be sued!".

As if man hasn't turned its own back on humanity enough we go and allow this mush to happen...wouldn't stop me in the least though, I'd still help...as well if I was sued, I'd countersue.

i can not afford to fight a civil suit

and i am not gonna

i will call for help for them

but with my health issues now

i doubt i could really be of much physical value in a rescue attempt
