I ordered something on ebay as a pre-order.. now the seller is
saying he might not be able to fill the order and if he can't he's
saying he'll destroy my check.. is this allowed? does this sound
right??

Its a video game that isn't coming out until tuesday and Nintendo
didn't make enough as they planned. there's still a chance. but
shouldn't he return the check, like a refund?

make all contact with him go through ebay itself if it is under 100
dollars they will cover for you as long as you pay by credit card but
you said it was a check. If it was a recent auction that you purchased
it check the amount of time to leave feedback left. If you sent the
check via the US Mail it can become a federal crime if he cashes it and
does not send the merchandise. They call that Mail Fraud even though it
was online. I woud not put a stop payment as most banks charge like 25
dollars to do that. He will either send you out the product or you
should have him refund your money. Don't settle for him saying he tore
it up unless he plans on returning you the pieces as well.

already settled, he'll send my check back as refund if he doesn't have

Just a thought recently I have found alot better deals on the yahoo
auctions then on ebay but I always use e-snipe if I am going to buy in
ebay for a penny per dollar bid I have saved thousands over the past few
years.

I've heard about a few people getting ripped off on e-bey.

But I think the majority are honest.
