In the article in the O.P. it was stated that the man gave HIS PERMISSION to the officer to search the car.

This is where the mistake is made. If you give your permission to them to search your car, they have done nothing wrong.

You have a right to remain silent. You have a right to refuse to allow a search without a warrant. If you give up those rights, then they can search your car.

Don't let them, don't be stupid. Refuse to give them permission.

How do you know they won't plant drugs in your car? If they are out to get you, don't think they won't do it.

They might search it anyway without your permission. If they do it without a warrant, it is very likely that they can't use anything they find against you.

Make sure you make it clear to them that they must have a warrant.








try refuse the polite request of Group of wellarmed S-Troopers,and see how far you'll get.
Your very refusal will be taken as an admission that you are hiding something!
And a Judge to grant permission to search is as close as the Phone!

Doesn't matter if they don't honor your request. IF you give them permission, you don't have a ground to stand on as far as your legal rights.

If you politely tell them you do not give permission for their search without a warrant, and they do it anyway, then they have violated your legal rights according to the constitution.

At sobriety checkpoints they may have the right (according to some judge) to stop you to check to see if you are drunk, but they do not have the right to search your vehicle, open the trunk etc. without a warrant.

If they do it anyway, then they will probably make up some stupid excuse about "probable cause" that makes no sense, like you didn't smile or you didn't roll down your window far enough.

They are violating your rights, no doubt in my mind. If the system continues down this road, soon we will not be so stupid or delusional to call this country "free."

and if people keep acting like sheep and giving their permission they are giving away their rights and eventually they will have no rights because it will become standard procedure to search anyone for any reason and anyone who objects will be slammed against the vehicle, handcuffed and hauled off to jail as a suspected terrorist.

PEOPLE NEED TO KNOW THEIR RIGHTS AND DEMAND THEM.

Or else they will loose them.

I love cheech and chog. I just bought two of their movies. They are classics. "Up in Smoke" and "Cheech and Chong's next Movie."

They are two of the greatest characters of all time. I lived the hippie generation, and they really do a great job.

Refusing a search request is not an admission of guilt and does not give the officer the legal right to search or detain you. In fact, most avoidable police searches don’t occur because police have probable cause. They occur because people get tricked or intimidated into consenting to search requests.

If police search your car and find illegal items despite your refusal, your lawyer can file a motion to suppress — or throw out — the evidence in court. If the judge agrees that the officer’s search violated the 4th Amendment’s probable cause requirements, she’ll grant the motion. Unless the prosecution has other evidence, your charges would be dismissed.
